    As a retired petroleum engineer, I know that frequently the surface owner does not own the mineral rights to il and other minerals. They may have been sold or kept by a previous owner. You can check that by doing a simple Title search in the Parrish courthouse land records yracing the deeds back to a land grant. She might own the land but own all, some or none of the mineral rights.

    Land was sold at public auction or sheriff’s sale to someone else a long time ago for unpaid real estate taxes.👍🏻

    my question is where is the contract that allows this company to be drilling on their property and what are the terms?
    Doesn't sound like the family was close.

      Depends on when it was done. Many oil leases in the 70s and 80s had built in "as long as" clauses that allow them to hold the property as long as oil is being drilled or produced from it, so they could secure their interest from possible competitors. There's also the possibility that gramps or someone prior to him in the title chain sold off the mineral interests to someone else and they have the lease. The fact she wasn't aware of who had the lease or drilling rights tells me they are either operating off an old lease or someone else has an interest in the property she doesn't know about. She needs to get a good title examiner or attorney to check into this.

    40 acre is a lot of land, worth looking into it. But I would like a dave said see if there any money from the oil/natural gas. And I would ask a realtor about appraising the land to make sure its worth it before paying the lawyer fees of course.

      I think Dave's point was, there might be others who also have a claim to the land. Her grand father had two sons. How many kids did the second son have? If he has 6 kids and they're alive, and the land is 30k, that's 5k per grand kid, and you end up being 1.5k and you did all the work.

      Here is a poor European looking at land of £40,000 a acre or £20k-25k for land in the middle of nowhere sold as a small isolated patch without utilities / planning permission.
      People in US say they can’t afford land or a house when the country is so large and almost everyone drives USA should sort out there benefit system/ healthcare considering all the taxes they pay then more people could save up a little money even if in very low income.
      Average worker in USA on a average salary if single could technically save up some money towards something in the future and as a couple even more even if it won’t be a $300-$500K or even more house is plenty of little cheap ones in rural parts outside of the urbanised areas.
      The education system there is rip off too but most smart people who have a house go to a trade school or lower tuition higher education.

      @@jamesk8891 yeah you can easily get good forested land for $2000 an acre in the USA in most states. many poor people in the USA own land, but in the UK land ownership is pretty much a rich or upper middle class thing

      @@Big-Government-Is-The-Problem $2,500 minimum average is $3,000 for the most part in WV. Nothing but junk land too. Good land is going between 10-25Gs an ACRE. A lot of oil & gas activity but I don’t understand how it’s this high when all the value has been stripped away? Lol no timber, royalties are held on to, and the land is basically useless.

      It sort of seems to be where he wants with the show these days. He’s spent a long time building a stable of on air personalities and appears to enjoy the show more when his team takes a larger role.

      I can see his point. If the land was valuable and generating oil/gas royalties, the prior holders were MORONS to not fight to get the proceeds. Something here doesn’t pass the stink test. I’d say if she spends $$$ to investigate, she’s entitled to that money back minus her share of the cost among all the beneficiaries, but if there’s nothing more coming out, odds are there’s nothing left. This is a hard question because lots of poor and poorly-educated people get shafted on mineral rights law because they don’t know how to get what’s owed to them and may not have a large enough share for a lawyer to take the case. This is an issue in Virginia.

      And that is exactly what Dave said: dig around and find out more like where have the Royalties been going and land succession and how many relatives would have a claim etc before you drop 3500 on a lawyer.

    This is a he said she said situation. I heard a rumor in the family that we have land somewhere which has oil. We’ve also never gotten any money off of it. That doesn’t make any sense.

    Wish the lady would post with an update since this was 3 years ago. When you have land you need to check who owns the timber rights, the mineral rights and if there is a legal easement. In states like WV and VA, you need to check the deeds carefully. Sometimes the deed with surface/timber is a separate deed. You don’t want to homestead and then the timber owner shows and destroys your homestead by cutting down his/her trees.

    Most counties have property records online. I guess in LA it's a parish. You should be able to find out who is listed as the owner and what the property value is assessed at. If nobody in the caller's family has been paying property taxes it would have been sold long ago and she would have no claim. In all probability it was willed to someone else in the family and again she has no claim. If someone in the family is listed as owner it may be worth paying a lawyer to search probate history and make sure they weren't improperly cut out at some point.

    I inherited a piece of a natural gas well. No land, the land owners don't have mineral rights. The well is old and not in operation now. Probably will never be again. I can't give it away. To give it to my cousin would cost more than it is worth. When the dividends get up to $25.00 they will send me a check. We are getting about $1.35 a year. I am 86 so I doubt I will see another check. I used to get a check for about $1.50 a year. The oil lease company won't take my part of the lease back. They don't want it. So, oil and gas wells don't always mean much. STILL, I love to mention my gas well in Kansas.

    If that attorney finds out that it is worth a lot of money and you don’t do anything about it he could charge a ton of fees against the estate to get as much of that money as possible or he could research the property taxes as uncollected if they are and get it probably for a fraction of its worth and keep all of it and you won’t get anything. So, you should legally document whoever you’ve given your name and information to about this because someone could start claiming it and ghost you and you won’t be able to do anything about that. Contact the State on unclaimed cash and research the property taxes.

    "Drilling oil" doesn't really mean anything, which apparently confused Rachel Cruze into thinking that it means there's oil coming up. "Drilling for oil" (you're hoping that the drilling finds you oil below) means something, and "pumping oil out" means something (the earlier drilling for oil found the oil, and now you're pumping it out of the ground). For every 100 oil drilling activities, I betcha there's only one or two that turn up enough oil (and natural gas, perhaps) to pump out and make some money. And if there's oil coming up, and if there were/are royalty checks being sent out, and if the family knew/knows about this (for what sounds like at least three generations), Yolanda would not be hearing of this from her "dying brother." Her brother would simply point her to the company sending out the checks... or to the drilling company hoping to find the oil, or to the bank account where the royalty checks were/are deposited... something more substantive than sick/deathbed revelations. Smoke and mirrors, bayou monsters, and unicorns and sharks dressed as lawyers! Only the lawyer will benefit, if Yolanda writes that $3500 check (or puts it on her, ahem, credit card).

      this. the value of the land could vary wildly but even regardlessly of oil it's going to be between 20k and 1.5m. 3500 is nothing in that context

      I would definitely look into it. Dave isn’t realizing her family probably wasn’t the most educated in financial literacy and have been sitting on the gen not even knowing the full possibilities. That money is small in comparison of finding out once and for all.

    So who has been paying the taxes on the land? Wouldnt shock me if they havent paid taxes on land in years and it's not even the families land anymore. Not nearly enough info just he said she said. If she has the money I'd pay the $3500 to look into it after she had more info.

    Yes she needs to find this out most definitely. Because she could get a oil and gas lease from the drillers for the property at $5000 per acre plus royalties. I have family members who have oil rigs like that on their property and they had a similar contract.

    i hope she peruses it. as an African American it is very common that family land information is lost through the generations and people take advantage of that disorganization and prosper on it. Please go after the land and spend the $3,500. Possibly find a lawyer who will negotiate with you on a percentage they can get after versus you paying now. Go after the land.

    Definitely worth looking into it all yourself (public records, etc) but I agree with Dave that you need a lot more information before throwing thousands of dollars at it. If it was really making a lot of oil money then her brother, father, etc would have been collecting on it. My family owned part of a silver mine and liked to talk about it because it's a fun story but in reality it hadn't been mined for decades and the location made it too expensive to really excavate it. There were also so many heirs of a couple families involved now that my mom, etc all ended up selling their tiny shares to one family member to somewhat simplify things.

    Who is paying the property taxes on the land? Most states will auction property off when taxes haven’t been paid after a certain amount of time.

    If the family never collected royalties odds are they don't own the mineral rights. Hard to imagine 40 acres anywhere isn't worth at least $5k or so, but if you find out it's not yours what good is it. If you want to find out who owns it just go down there and block the road and put up no trespassing signs.

    Very good advice, Dave. There are too many unknowns with this scenario to make an informed decision about hiring an attorney. The caller needs to find out the status of any lease payments and/or royalty payments before spending a dime on the succession of the property. Any lease or royalty payments will include the division of interest in the minerals on the land. I personally know of many plots of land in Louisiana that are not worth the taxes levied on them. The heirs to the land may not even own the mineral rights for that land, a very common occurrence. No mineral rights means no lease or royalty payments even if a gusher is discovered on the land.

    I feel if those royalty checks were significant a lawyer would be chasing down the family. My aunt was contacted by a lawyer for unclaimed money from some great great relative. Turned out not to be a scam. With all the cousins 11 people had claim to it.

    I'd tell the attorney he can take a 10% cut or $3500 from the royalties (or sale) whichever is bigger. 40 acres would have to go for $3500 to lose money. That way she's not out of pocket, cost gets spread between everyone, and hey, even a $1000 check is still more than 40% of Americans have to cover an emergency. I'd take it if it was mailed to me. I'd probably pay a local to go out and photograph it too.

    Before I invest in a lawyer I would get a good real estate agent to do the dirty work and give me a price of what the land is worth, and he could find out what the dollar value of those checks are and any term on any contracts. It won’t cost you a nickel and you will probably have to sign a contract with the agent that should you sell, he gets the contract

    I think that once you let the fossil fuel companies onto your land you lost it. It need a lot of research especially when it comes to history of what deal were made between the company and your family who could have been duped by the company. If there is other kinds of energy such as a nuclear reactor or simply solar panels/wind turbines/batteries you could have much more benefit from looking into it.
