Trespass laws in most states typically say something on the lines of “an individual commits the offense of trespassing if said individual does not leave the property after being asked to”
I'm pretty sure one doesn't have to give ID if one is getting trespassed. Once you refuse to leave or step foot again on the property after being trespassed then you are breaking the law and therefor have to show ID. Even getting loud with the cops isn't being disorderly, because cops can't be the complainant. You just can't use fighting words. These police officers escalated the situation by demanding ID, they just needed to inform him on the trespass and let him be on his way.

(yet) That first time you're allowed to leave scot-free, once they demand it. It's the SECOND time, when you trespass AFTER being warned, THAT'S when you've finally committed a crime and your ID must be provided. ...So they can't (lawfully) demand his ID, _just for the trespassing part._ But it sounds like they whipped up another charge, by the end.

I started reading at the age of 3 and was reading novels by the time I was in 1st grade. Treasure Island, lassie, old yellow were the first 3 I read. I have never been unemployed and I have not had a minimum wage job since I was 17. I've owned my own business (road service company) I was a union printer for about 18 years have owned my own homes since I was 21, I've raised 5 successful children (mostly, I do have 1 son who has had issues with drugs but got past it) people can overcome even their own screw-ups. I'm not defending this idiots behavior, I'm just saying it's not always an educational issue. Drugs and alcohol are probably the biggest factors in most cases I think. I am also definitely not advocating that we don't need a education, I wish I had the sense to stay in school but I was beyond bored and pigheaded. All of my children are at least high school graduates and my youngest daughter will have her PHD as a neuroscience research biologist this year. If we had more than a 20 min look into these people's lives I think drugs and alcohol would be a more common issue than lack of education.

They told him to leave, which also indicates they were no longer detaining him, which is a critical moment, legally. This wasn't a criminal trespass call, therefore there was no Reasonable Articulable Suspicion of a crime being committed or about to be committed. The instant he left the DG property, the interaction was over. At that point, the one officer called him back, told him to return to the DG property, after they just told him that if he returns he'll be arrested. That's where the civil rights violation began. This could be considered entrapment, at minimum it was an unlawful order. The police then pursued him onto the adjoining property, the trailer park. They made several more unlawful orders, and threats of a warrant for obstruction and disorderly. At that point, he had been released from being detained, and there was no crime, therefore there was no investigation, hence nothing to obstruct. He was on private property (the trailer park), not public property as the officer tried to convince him, and had no legal obligation to identify himself, not by drivers' license, SSN, or even verbally. If the police wanted to detain and identify as part of an investigation into a crime for which they had RAS, they needed to do it while on the DG property, as part of the trespass notice. If a police officer walks up to you on the street and demands your ID, and you aren't being detained as part of an investigation for which they have RAS of a crime being committed or about to be committed, you are entirely within your rights to run, walk, drive, or otherwise remove yourself from the area. There are scant few places in the USA where police have the authority to stop and ID. Further, while not relevant to this interaction, William was correct about the spray paint. It is Federal law that aerosol paints shall not be sold to minors, and many state/local laws reinforce this.

As a loss prevention officer the reason they were banned from all properties is due to it being a chain and to keep the other stores from having to deal with things like this and theft and so on! Walmart and certain grocery chains also do the same banned from one banned from all locations!

They knew it, and as you can tell, the other cop acts completely different from the first. I also believe that he realized his partner was out of line, that's why he actually got out and loosened those handcuffs. 1. up until the arrest, all the conduct on film was 1st amendment protected activity. the officer said this filmed conduct was the disorderly (so it wasnt anything he did inside dollar general) retaliating for it would be a first amendment violation.
and in his explanation he says he's obstructing because hes trying to get his (ds) to trespass them. you dont need to ID for a trespass, only criminal things. retaliating for not giving up your 4th amendment rights during a consensual encounter is a 4th amendment violation, that includes threats of arrest for not obliging the officer wiht your ID.
(nvm, the supremne court doesnt agree with me on this, but theyre wrong, in the5-4 opinion in HIIBEL v. SIXTH JUDICIAL DISTRICT COURT OF NEVADA, where they erroneously ruled the 5th amendment doesnt apply to ID)

but yes, at the point you are running, or resisting arrest, regardless of wether the arrest is justifiable, or however much your rights were violated, or wether the arrest is even lawful or not, you typically must just comply, depending on the state, so at that point he is likely guilty of that.

Trespass laws in most states typically say something on the lines of “an individual commits the offense of trespassing if said individual does not leave the property after being asked to”

I'm pretty sure one doesn't have to give ID if one is getting trespassed. Once you refuse to leave or step foot again on the property after being trespassed then you are breaking the law and therefor have to show ID.
Even getting loud with the cops isn't being disorderly, because cops can't be the complainant. You just can't use fighting words.
These police officers escalated the situation by demanding ID, they just needed to inform him on the trespass and let him be on his way.
One thing I learned in these body camera videos is that it is with 100% certainty that anyone who says the words, “I know the law,” indeed does not.

On the occasion of an initial trespass, which occurs before any type of warning was given/received, no ID is required since no actual crime has been committed. (yet) That first time you're allowed to leave scot-free, once they demand it. It's the SECOND time, when you trespass AFTER being warned, THAT'S when you've finally committed a crime and your ID must be provided. ...So they can't (lawfully) demand his ID, _just for the trespassing part._ But it sounds like they whipped up another charge, by the end.

@@STV-H4H education doesn't have any thing to do with character. I personally didn't make it past the 6th grade and don't think I went to school more than 3 to 7 days out of the month. I started reading at the age of 3 and was reading novels by the time I was in 1st grade. Treasure Island, lassie, old yellow were the first 3 I read. I have never been unemployed and I have not had a minimum wage job since I was 17. I've owned my own business (road service company) I was a union printer for about 18 years have owned my own homes since I was 21, I've raised 5 successful children (mostly, I do have 1 son who has had issues with drugs but got past it) people can overcome even their own screw-ups. I'm not defending this idiots behavior, I'm just saying it's not always an educational issue. Drugs and alcohol are probably the biggest factors in most cases I think. I am also definitely not advocating that we don't need a education, I wish I had the sense to stay in school but I was beyond bored and pigheaded. All of my children are at least high school graduates and my youngest daughter will have her PHD as a neuroscience research biologist this year.
If we had more than a 20 min look into these people's lives I think drugs and alcohol would be a more common issue than lack of education.

They told him to leave, which also indicates they were no longer detaining him, which is a critical moment, legally. This wasn't a criminal trespass call, therefore there was no Reasonable Articulable Suspicion of a crime being committed or about to be committed. The instant he left the DG property, the interaction was over.
At that point, the one officer called him back, told him to return to the DG property, after they just told him that if he returns he'll be arrested. That's where the civil rights violation began. This could be considered entrapment, at minimum it was an unlawful order. The police then pursued him onto the adjoining property, the trailer park. They made several more unlawful orders, and threats of a warrant for obstruction and disorderly. At that point, he had been released from being detained, and there was no crime, therefore there was no investigation, hence nothing to obstruct. He was on private property (the trailer park), not public property as the officer tried to convince him, and had no legal obligation to identify himself, not by drivers' license, SSN, or even verbally. If the police wanted to detain and identify as part of an investigation into a crime for which they had RAS, they needed to do it while on the DG property, as part of the trespass notice.
If a police officer walks up to you on the street and demands your ID, and you aren't being detained as part of an investigation for which they have RAS of a crime being committed or about to be committed, you are entirely within your rights to run, walk, drive, or otherwise remove yourself from the area. There are scant few places in the USA where police have the authority to stop and ID.
Further, while not relevant to this interaction, William was correct about the spray paint. It is Federal law that aerosol paints shall not be sold to minors, and many state/local laws reinforce this.

Plus, the Supreme Court has ruled, you have the right to pretty much speak to a cop with all manner of profanity and volume. A cop can't be the victim of disorderly from what is said to them. Settled law.

There was a truck driver around and a kid at a minimum. If your actions could alarm or annoy those people the cops have ras your commiting disorderly conduct. which is why the cops went to interview that truck driver.
You can’t say almost anything to cops. There’s may be a higher threshold for cops but it’s not impossible to be disorderly bc of an interaction with cops and be charged for it that’s in no way the law anywhere.

Overly vague laws are anathema to liberty, and abusing them like officers here did makes them no better than their counterparts in the CCP.
@@Ni73sh4d3 the law isn’t overly vague. It very specifically defines the kind of actions you have to be doing and you have to be recklessly doing it.
Higher courts have supported the disorderly conduct laws in Ohio I’m sorry that you don’t like it but than argue it in court don’t run from the cops.
Let’s assume just for fun that the law is struck down tomorrow as unconstitional. Even if that happened he would still be guilty of obstruction bc the cops had ras of a crime that exsisted at the time and he couldn’t sue the cops bc they didn’t violate a right thag was known at the time.
Like I said a higher court has said the law isn’t vague or unconstitional I can find that case if you’d like
