    Very helpful, I use to be a realtor several years ago and then a loan officer. Now I buy Tax Liens and rent them out. The problem is I cant sell an auction property without a quiet title action. I have so many buyers calling daily and they wont buy on a quit Claim Deed. The process takes about 6 months, so I never been excited to really get going. Just found a company who can do it in 45 to 60 days. For an extra $400 in 30 days, but I knew I could do it myself but didnt know where to start. You start by doing your own search or paying a title company and then negotiating anything that may be there.

    I have my parents home, parents recently deceased, filed will with Recorder of Deeds and have title deed in possession, mother had a loan for $3,900 with PNC, PNC placed a lien on property, I negotiated a settlement payoff for $1,200. Before I pay this amount, what do I need from PNC to make sure that the lien has been absolved and that there will be no further collections?

      Hello! You should ask this to an attorney in your State - the following is just general advice. Generally: they should give you a settlement letter in writing confirming that once you've paid, they will release the lien (and consider the settlement as settlement in full - if that's what they agreed to). Don't send any funds until you have a settlement letter in writing. The letter will also likely tell you how long it will take them before they will release the lien.

    If you have solar panels, solar battery backup, or EV chargers , then you have a lien on the home. Those solar contracts are usually 20 years

    How can i find out if a reverse mortgage was taken on the house? If theres a lien? My grandmother passed with no will and heard she did this but cant see it on the title

      Hello! I would suggest you contact a local Title Company and pay for them to run a Title Report against the home - that will show everything that is currently attached to the house!

    is it true that the codes and statues in foreclosure dont have the three elements to be a valid law that is a title a body and an acting clous and hello you are doing a grate job

    What happens if my brother and I own a property that was deeded to us by our parents who are deceased and my brother due to the civil resitution he has owes has a jugement lien placed on our property? What happens to me, who had nothing to do with his crimes/resitution he owes?

      The judgment against your brother likely will not impact you personally but it will likely need to be satisfied in order to sell the home (or refinance the home). Please note that this is a general answer and not legal advice since I am not familiar with your situation. This is something that you should take to an attorney in your state so they can look more closely at your situation!

    Hi I’m in Florida and I tried to sell my house and when I got a title search it appears that I had a second mortgage this was 2004 I never received a bill or a letter from that second mortgage and apparently it went into foreclosure but in 2005 but it was released for some reason now it appears as a lien on my property I’ve been trying to find it and I cannot find it so I could not close the sale on my property they told me the title company that Bank of America had it last in 2010 and now Bank of America says they don’t have it and they sent me to another bank north star and they do not have it either what can I do ?

      Hi John! That's tough. I would suggest getting an attorney who knows how to track down liens to help you find it. North Star should be able to tell you where it went when they service released it - if not, you can maybe try a google search of "north star service release to" to see if the internet can tell you where north star usually releases loans to. You can also search the county records to see if there is any public recording of the lien's new servicer. You can also reach out to a Title Officer to see if they can help you search. If you truly can't find it, you may need an attorney to file a quiet title action to have the lender come forward. Run all of these strategies though by an attorney in Florida. As I'm not licensed to practice in Florida, this is only general advice - there may be other laws that can help you in your state.

      Hi Jason - I would reach out to a real estate agent or a Title Company in your area to see if you can get a Title Report ordered. A Title Report of your home will have that information.

      You need to reach out to the creditor to have them issue the lien release - you should probably consult with an attorney in your state to have them reach out with a timeframe to get the satisfaction recorded. The attorney in your state will tell you how you can keep checking. Sometimes, you can check with the county records online to see when the satisfaction got recorded.

    I have a whole lot of questions.
    1 ) If a person marries a person who has gotten a loan that they had repay back or lose their deeds to their home if the home was not repay pack. They gave have the estimate price but kept the other exm. The loan was 88 th. They gave 33. Th. and kept the rest saying it was for financial charges. But he was in charge of paying pay the full loan.After he passed away , the bank went down to about 66.th. And sold the home for only 6 th. To another.I seen the paper work and seen the amount given and kept.It’s a three bedroom nice size if fixed up.It is very confusing on why they kept the about 51 th.but request a full payment. Made the wife move out after the guy passed away.
    2)Question is The deeds why couldn’t the wife add her name to the deeds if the loan is a creditor agency and he filed bankruptcy, and I was reading up on bankruptcy and it’s supposed to stop and lien or creditors from taking the home. So why was she not able to sign the deeds if there was a bankruptcy in place. And the bankruptcy lawyer probably lied saying they couldn’t put the home under bankruptcy because it’s has a lien on it. But on line I read to day said any lien holders can not stop a bankruptcy Humm🤔🤔. So I’m sec to see if anyone agrees with the lawyer.
    3) The paper work said that they where taking this money for insurance on the home and just in case he can’t pay. But how is this so if he or family had to pay back the full loan🤔. And online it say to get an insurance for credit just in case you can’t repay back the loan. It sounds like to me a huge scam went on and many allowed this scam and cause many to lose their homes and it’s unjustly.Because insurance was taking out, plus they took over half of the money. And I was wondering why they only took 6th for a house at an auction didn’t make sense until I read the blog online.Wow. I’m just trying to figure out do you understand .

    Please HELP ! If a person loaned me money , then said they didn’t want the money back verbally, then they die , can their family put a lien on my house cause they want the money ?? Or is it that when this person dies so does the debt??
    Or if the person who gave me the money decides that they want their money back, & goes & puts a lien on the house and then they die?? How does this work???

      Most FHA modifications require clear Title in order to modify so if you have another lien on Title with an FHA loan - that may prevent your ability to get a modification. You should consult with an attorney in your state for more specific information about what your options are to get a lien release.

    Can you answer this for me please. I am trying to sell a property and CitiBank says they have a lien against my title from 2009. I moved out of the house they said they put a lien in 2008. The house was sold on 1/21/2009. A judgement was placed on 6 of 2009. I owned no property at that time for Citi to lien. I filed Bankruptcy in 2012. The debt should have been taken care of and there should be no lien as I did not own property at the time. I bought a condo in 2018. CitiBank is saying they have a lien on the property I own now, 12 years after they filed a judgement and 10 years after I filed bankruptcy chapter 7. Is this lien legitimate?

    Is having a HELOC on the same property considered a lien for Fannie Mae flex modification purposes?
    The HELOC has zero balance and is held by Wells Fargo who’s also the servicer of my loan.

      Hello! I don't believe that a HELOC held by the same servicer as your primary mortgage would cause a problem. I believe the investors are more concerned with additional creditors and IRS liens at this time. If you run into an issue with it though, let me know as the covid processes are still relatively new so I'm learning also.

      Yes! It does. It gets recorded as a subordinate lien, payable at the maturity date of your loan.

      I was offered a “term extension” which will just add the 12 months missed into the end of my loan and will just need to pay any “taxes and insurance” that was advanced on my behalf. I’m going forward with that and am curious to see what that amount is

    Is there a service out there that can monitor any new liens that may pop up at any time? I recently found out about a fraudulent mechanics lien being placed on my property.I only found out about it because the person that placed it was dumb enough to send me a notification of it. Otherwise I would have never known...

      I don't have a good answer for that as I don't know of any service but you can periodically check the county recorder's office to see if anything new has been recorded against you. Usually, counties have online records you can search.
