- The plaintiff hosted a wine and paint party at the defendant’s house. He claims the defendant wouldn’t pay him because he refused to strip for her and her friends, so he’s suing for the remainder owed. The defendant argued the plaintiff showed up late and didn’t even bring enough paint with him, so she doesn’t think she owes him.

I'm fairly sure he said 35/person (when he provides everything) is his usual, but he did this as a special since there were so many and the lady bought the easels - he just provided paint. I may have misunderstood.

Common sense tells me that he had an initial fee that had to be met and then each person who painted had to be another $10.
The fact that he mentioned, and he seemed very believable, that he charge $35 a person when it was done in his studio is testimony enough for me. I think the judge was wrong. She didn’t use common sense.
I think if she would’ve asked him are you willing to do this for $10 a person he would’ve said no way. It’s not worth my time. My expertise. My artistic ability. To me that’s common sense.

I can guarantee that that guy wants nothing to do with future business with this woman. Hopefully, other vendors will stay clear of her.

According to the defendant she brought everything, he only supplied the paint and the location (and the easels which wouldn't cost him anything as he would already have them) and he didn't dispute that, so I'm guessing she wasn't lying.

That's crazy. Why would he take $200 to host a sip and paint for 20 (+) people but he charges $35 per person in his own establishment? I know that only 12 guests painted, but it's difficult to get ADULTS to behave in a large setting. Then he had to travel there, that's gas and toll(?), he has to set up at her venue, even if it only takes 15 minutes and then she wasn't even there and he was welcoming her guests in. $320 is $100 less than the $420 she would have paid if they went to his establishment. smh

Yes and no. 200 in deposit whether its 1 girl or 20 it is still 200. As you can see, there were only 12 girls and he still made 200 so you are wrong and dont understand the terms of that contract.
Its not 10 dollars per girl. Now where she got him was after that, the price should be higher for individually priced guests versus a bulk or group setting and that is where he should have gone to 20 or back to his 35 dollars.
All she had done is guarantee that he will not make less than 200 dollars based on a group pricing and if only 1 girl wanted to paint, she would still have to pay him 200!

I have an interesting little story about contracts. I used to own a very small general store. I hired a young man who was just starting his handyman business to do a couple of basic things, painting, some minor woodworking, and installing a couple of lights. The light installation was nothing more than screwing lights to a wall. No electrical work involved. We had to wait for the lights to come in, but everything else was done. When the lights came in, two weeks after all the work was done, I called the contractor. He came down, did the work, and then asked to be paid. I told him, let's look at the contract. And I had already paid for the light installation in the contract. He agreed with me, installed the lights, and that was that. Had we not had a contract, he could have walked away without installing the lights.
After that, I explain to him how important it was for him to have a contract for every single job. I also told him that if somebody wants more work, have a separate form called a change order so that you and the customer are clear the scope of the work and what you'll be paid.

I needed a couple of things done, and so I hired him. Wonderful young man, and I wish that I still have my store and things for him to do.

I've gone to these painting parties. They are expensive. It's not a party for strippers!! That's not the right setting for that. It's tacky. It's more mellow and the artists go around helping the guests plus it's weird for people not to paint because that's the whole purpose and there is nothing else to do.

First she said she wanted someone good looking instead of a female because she was having a girl's night and then later on she commented about how the strippers were better looking than him. She's trash. He wasn't thinking straight with all the strippers and asking him to take his shirt off, etc. That's not how those paint parties usually go. They aren't supposed to be wild.

The male artist at 190lbs would be able to vacate a room of 150 lb partaking Karans; he may be uncomfortable but he is relatively assured an exit if need be. The role reversal of a attractive woman artist surrounded by out of shape 230 lb intoxicated men; getting frisky is very dangerous for the female artist. It may not be fair, but a women artist is much more at risk than a male arrest. So no, it is not the same; legally it should be the same, but realistically it is not.

The fact that the woman had to take a cheap shot at the plaintiff’s looks shows just how shallow and insecure she is. She may have a lot of money, but that’s all she’s got. JM got this so wrong. I’ve been to painting parties. No way he agreed to that cheap. And the way she tried to demean him was pathetic on her part. I guarantee the women were groping at him. Defendant is a sorry excuse for a human being
JM had very little to go on and it all came down to the plaintiff's own text stating "$10 per person," which the defendant subsequently agreed to. If he was expecting more money, he should've been more clear (especially in absence of him having no written contract). Any judge would've ruled against him in this matter.

totally disagree with the judge on this one. There were only 12 maybe 13 people that painted but there were 50 people there that could have painted. Granted he wouldn't of had enough paint for all of them so she shouldn't have had to pay full price but a 50 people were there then the 200 being a deposit sounds right and she would then owe him 300 more. If I had been the judge I would've knocked off 150 for the fact that he didn't have enough paint for everyone if they wanted to paint, but she still would've owed him $150.
and on top of that he was only asking for 120 so I think that's reasonable personally. I think the judge botched this one.

The only way $200 would be reasonable is if she provided ALL the supplies. He likely brought $100 of just paint. That’s only $25 an hour for a four hour party which is too low. He needs a contract.
Truthfully the $320 he was expecting is too low. Those strippers made way more than that and likely only put in an hours worth of work.
She’s one of those, “give me a deal and I’ll use you in the future” types. You could hear it at the interview with Doug. Those deals generally don’t work out because folks get entitled and try to negotiate down from the bargain basement price as opposed to the market price. Also, you are not dressing me in a costume like I am a toy dog, touching me, or asking me to strip either. That’s all foul and inappropriate.
Considering he gave her the painting she begged for, I would have just paid the invoice, considered it a tip to cover the misunderstanding and not used him again. I’m not having a vendor take me to court over $120. My time is worth more than that. Even asking to split the difference and settling for $60 would have made more sense.

If a guy was having an attractive woman over to paint and they started pulling on her shirt asking for her to strip or if he said in court I wanted an attractive girl to show us how to paint and maybe strip the judge would bitch the guy out with how dare you blah blah blah...but since it's a guy that's painting it's party time for the judge because she has daughters and that's ok,also while the guy is giving his answer the judge can't stop thinking about the stripping and keeps talking about it while looking at him without a shirt and commenting on it....isn't that a double standard especially coming from this judge!
That's what makes men men and women women. Most Men wouldn't complain about this incident because they would find it flattering while women would find it offensive. At least that's how it use to be. Nowadays the roles are reversed.

Around 4 minute mark the defendant said she bought more isles incase anymore women wanted to paint . So i do believe it was 10 per person . Otherwise why buy more ? Should be only 20 . Also the fact he had to greet and entertain 50 or 70 people should be taken into account .
She's lying! This guy is gorgeous ! They probably did ask him to take his shirt off and that's not his job..He really should have charged more and in the future he must have a contract or something in writing

But you completely ignored the Judge repeatedly questioning the defendant of why she was asking the plaintiff to take his shirt off, because it wouldn't be cool to do that to a female artist 🤷♀️
