ATV Rider Gets Hit By Sport UTV / Who's At Fault?

- ATV Rider was going slow because he was having problems with the fuel pump when all of a sudden a side by side comes out of nowhere and hits the rider, luckily nobody sustained severe injuries. Who's at fault?
This video is posted for the purpose of bringing awareness to safer riding at the dunes, always look both ways when trying to cross and reduce your speed in challenging areas where somebody can appear out of nowhere.

Neither are at fault. But that atv rider could find a better spot to putt around at 1 mph besides a blind cross trail.
There wasn't a better place to go, to get back to camp was either up a hill or there, I had nowhere else to go
