      petition is about to be approved soon. A Sent back the RFE with some very simple documents. Our adjustment of status got denied due to an error on our end. Can I still submit DS260 with no problem if I-130 is approved? Regardless if 485 was denied due to a simple error? My wife has to travel to Europe for an emergency

    My husband and I have never hired an attorney or lawyer for any of of visa process. We’ve done it all on our own. And now I am currently waiting on my green card and work authorization! 🙂 it was a stressful process but overall pretty simple. Just do your research and everything will work out just fine!!

    Is there any consideration/exception for Affidavit of support (consular processing) right now if a sponsor's current income is lower than poverty guidelines/ unemployed due to Covid-19 ?

    Do you know if your case is complete at nvc and are waiting to send to embassy for interview and biometric if the new law passes for credit reports and bank statements will it be retroactive or only after the date its signed to law

    Is there a process for someone who had residence status, a Green Card, was required to relinquish it when the person pursued a 25 year teaching career overseas and now wants to reestablish residency with her husband, a US citizen, in order to retire to the US? Or, is the only path to start the process of obtaining a Green Card from scratch? This person is currently residing overseas.

    Hello, what happen if your i130 approved but priority date is not current. Do I just wait until its current, thats like another year and so? Until then, should I contact the NVC at all?

    Hey Stephanie, my sister initially applied in 2013 for us ,which was for me my son and my husband .My son was was under 21 years.My case got approved by the USCIS in October 2021 and my son is 28 years old now so would he get the green card along with us...Thank you

    Hi. All our papers was sent to NVC and stated that its completed and waiting for an interview but we havent recive any schedule date we sent the papers last April 2022 until now no schedule yet. When we checked out status its still completed. I have an accompany (2 children) what should we do to make it easier. We sent a request for expedition of our case but they did not approve it.     If I am 485 pending and yet to receive the combo card, can I still travel and return to the US on my H1B visa? Can I go to Canada or Mexico to get a new H1B visa stamp (I have three years H1B visa left).? Thank you.

    I am currently in the United States, and I have an approved form i-360 as far back as July 2023 but on the approval, letter was stated that I am not eligible to file an adjustment until I observed some certain steps with NVC for proper forms and payments in order to avail immigrant visa before I could adjust. I was asked to contact NVC since I am here in the United States and my question is: ca I apply for adjustment of status now with a visa waiver form or needed to wait to hear from NVC on the next phase since I am running out of time since my SD6 approval notice.

    My mother I-130 was approved on 02-12-2008. I lost her alien number I went to immigration and the give me this receipt the start with the letter EAC. Immigration told me that NVC have my case but I never received a welcome letter. My mother is here in USA . Can you help me . What to do next.

    Your video and the subject sound interesting. I want to apply for NIW, and I would like to adjust my status through I 485 or 245A. When I applied for asylum, I was in status (F1), then I fell out of status after graduation, and I got OPT (my lawyer did not advise me to get it). How can I adjust it, or must I do a consulate process?

    Hi! We're doing consular processing. We got approved yesterday but when we checked on our uscis account, uscis sent a message saying that our card is being produced. This is impossible. We haven't gone to nvc nor have any interviews. We expedited our case for military reasons

    I wanted to ask this question me and my husband are gay and got married this year in Florida living in Massachusetts we filed our paperwork in August we received a receipt number but still waiting for biometric and ead for me to work and travel
    We are worried now with what is happening in the Supreme Court and if they do take away gay marriage what does that mean for me ?

    Dear Angelo, I have been selected for the 2023 DV lottery. My question is if I should go for AOS since I'm physically present in the US. I'm concerned about the processing time for AOS which takes 8 to 14 months to approve. My case number is AS24000, would that be an issue because of the large number and if the cut-off number going to be later next year about this time, then I might as well go back to my home country to go for an interview at the US embassy, just a thought.

    Also, when my AOS is finally completed, is the Perm Res card conditional or is it all completely done...(like it would have been if I stayed CP? Thanks again!

      Hey Clay, I will also be switching to AOS as I just qualify by using a travel document. Btw, NVC has already approved all my documents submission and I'm just waiting for the interview appointment.
      Anyhow, I have the answers to your question.
      When submitting your i-485 package include i-765 and i-131 which at the moment both are free to apply when submitting an i-485 application.
      Btw, on the video I did not hear if we need to contact NVC to send back the i-130 to USCIS or we can include a copy of the approval form, do you know by any chance?

      2 years for Canada? Then I think AOS is better then - even if it takes longer then at least you’ll be with your spouse AND be able to work after getting the EAD card

      Hi Nam_123 in my opinion, adjustment of status would be more suitable. #1 is that flying outside of USA would cost more #2 I just feel safer to be interviewed within the USA (I am from the Philippines and whenever I go for consular processing, I always see people getting denied left and right. (I think that they are stricter there than here).
      However, if ALL the requirements have been met, then there would be no problem.
      I am not an immigration lawyer however, I am a fellow foreign applying for Permanent residency. Hope this helps you and have a wonderful day!

    I am currently on the consular processing track and been waiting for an interview date for over 15months and I AM TIRED of waiting. I do have a B1/B2 visa (visiting visa) and I plan on going to the US and doing the adjustment of status.
    Even though consular processing is typically faster, clearly it's not in my case.

    I am in India now and I have approved I140 and it was filed when I was in USA so it has specific instruction to file I824 to request for consular processing. My question is when I start consular processing by filing I-824 and if I get my non-immigrant visa stamped in between. This makes me eligible to travel to USA. If I travel after my I-824 is approved for consular processing, will I be able to apply for adjustment of status when I travel to USA or I have to stay in India to complete consular processing when my priority date is current?

      New birth certificates...new marriage certificate...irs transcript of ladt year..or 1040...last year w2....letter stating you realtion with person tou are sponsoring...medical exam....2 visa photos...passport...and copy needs to have copies of all certificates...no translation...embassy appointment letter...sponsor proof of citizenship..or green card...sponsor id copy

    Hi! Thanks for the very informative video on AOS and Consular Processing.
    I have a question for you on this. I have an approved EB2 NIW I-140 petition that NVC has begun processing via Consular Processing through the US Consulate in Mumbai India. They have sent me a Welcome Letter with an NVC Case number and an Invoice ID number. The Welcome Letter also has a Document Cover Sheet that lists the Supporting Documents and a list of documents under the Affidavit of Support.
    Now, when I log into CEAC, under the Fees tab, it shows
    - Affidavit of Support (AOS) Fees - Status EXEMPT
    - IV Application Processing Fees - Status PAID
    Since the AOS, and hence the associated fee, is exempt for my case, does this imply that I am not required to submit any documents to the NVC listed under the Affidavit of Support in the Document Cover Sheet i.e.
    IRS Tax Transcript, Federal Income Tax Returns, Form(s) W-2, Proof of U.S. Status, Proof of Domicile, Petitioner's Civil Documents, Proof of relationship (only for I-864A), Evidence of Income, Social Security Earnings Statement, Proof of Assets
    Your advice will be much appreciated.

      Hi, we are from hyderabad,India. We are also planning to apply GC through Counsular r process. we are bit scared. Could you please share your experience. you got your GC? if yes ,how long it will take. do we have to apply from hyderabad only?

      @@sujithakatla5793 Hi Sujitha, to give you a brief background on my GC process:
      My I140 was approved back in 2012. I applied in EB2 NIW category. Last Oct 2021 my date became current and I got a notification from NVC to submit my documents. I submitted all my documents and as of today I am documentarily qualified by the NVC, and waiting for them to schedule an interview at the Mumbai consulate.

      @@sujithakatla5793 if you are eligible for EB2 NIW, you can apply from anywhere, inside or outside the US. But I would recommend you go through a good immigration lawyer based in the US. They can help you out better, although it is a bit expensive, but less chances of making errors in your application. I paid around 6000 USD back in 2012 to my lawyer, and she filed EB1-A and EB2 NIW for me. My EB1-A got declined.

      @@sujithakatla5793 if you get your I140 approved in the EB2 NIW category, and want to go through consular processing, then I believe it will be at Mumbai Consulate, as only Mumbai consulate does EB2 NIW GC interviews, as far as I know.

    A USA citizen parent makes a petition for his son...his son visa is aproved and he comes to usa and get his green card..in order to apply for his son citizenship(N600)THE PARENT NEEDS TO LIVE 5 PREVIOUS YEARS IN USA IN ORDER TO APPLY FOR N600?

    hi, thanks you for asusual great content. My 485 is in progress (eb1) , it was filled in aug 2020. Now if I use premium processing to get EAD card, will I get my advance payroll card/document too with EAD ? Or it will just expedite the EDA only.

    Assuming the i140 was approved for AOS basis and when PD becomes current after many years (such as EB2 india) when the primary applicant is still working in US on h1b but his spouse and children are in India, how will they do ? will the primary applicant file for AOS, and his family file for consular processing? Sometimes the AOS can be done on "Date of filing chart" basis while consular processing is done on "Final Action chart" , if so then his family will apply much later because Final Action chart is usually follows the other chart.

    I never got the Original copy of the I-601A Approval Notice. I only have my lawyers copy. How bad is this? Interview in Juarez is coming up soon...

    This video is great but the consular processing is long, painful, expensive and downright sadistic. If you are from a third world country its going to be almost impossible to get the papers the ask for. This process makes me want to rip my eyes out I don't wish it on anyone and of course there are no guarantees. Good luck fellow foreigners well need it.

    My US citizen sister who filed my i 130 is approved i m in USA already on h1b visa , whats your opinion shall i file AOS or go with consular processing please help
