    Thank you so much for this video. It saved me from a big mistake. I got dupped, suckered, and punched in the gut. While on vaca in Orlando, Florida, my family went to a "Wastegate" promotion for theme park tickets. The sales guys was smooth as butter and I couldn't say no. I really felt trapped. Needless to say that night while sleepless I read through the contract. I submitted my recission letter on the 6th day. I mailed 2, 1 certified and 1 first class. Total I wasted about 20 bucks to send their junk back and the letters. I received my full refund of cancellation within 2 weeks of sending my letter, so relieved. This video really helped, thank you so much. I will look into timeshare but one I can buy cash. Do not go to a Westgate promotion, it's a total waste of time!!

      That is great. Westgate is one of the worst. If you do your research, you can find some great timeshares and timeshare systems out there and they do provide for great vacations. Just be sure to look into the resale market, you can get them for pennies on the dollar when compared to buying from the developer.       I did the same! Sent my letter yesterday. I sent it certified. They were trying to make me wait 48 to speak to someone to cancel. They did not call until after I sent my rescind letter

      @@jazzyjaysc4063 Wastegate did not call me, I doubt they will. Once the rescind letter is sent they cannot stop you from cancelling. Give it 2 weeks. Once I saw the CC refund, I jumped for joy and my letter of confirmation arrived 1 week later.

      @mayram4662 Yes, send all their junk back, or they will charge you for it. Most important is the letter of recession in the contract timeline.

    Yes after the aggressive sale pitches and holding me hostage during the tour. I felt hustled. I couldn't sleep and started doing research. Eventually I landed on your video and read over my contract to find the Rescission policy, but it was under the purchaser's nonwaivable right to cancel. I mailed the letters to the post office as well as personally handing in a letter to the timeshare developer. I got my refund and out of my timeshare. Thank you so much for this valuable information.

      I am so happy to hear this. Just warms my heart that you were able to save thousands! If you are still interested in owning timeshare, look to the resale market. You can get these for pennies on the dollar compared to what you were going to be paying the developer.       @@mirrorsedge1972 no I didn't get penalized. It's been so long, that I done forgot about it. If there's any doubt in your mind, you should get out of the timeshare before it's too late. Decisions like that shouldn't be made in a day.

      @@musikeradaw I did it the next day. I couldn't even enjoy my vacation week at the timeshare until I put my letter of rescission in. You should do it before it's too late.

    I just came to thank you sooooo much for this video and all of the information you gave. When my guy and I purchased this timeshare we were in a total rush while on vacation. Once we made it back home and did research we seen a lot of destinations and things of what they told us was not really included. So we wanted out of this and I thought it was no way because the guy that sold us told us we can't cancel. We I saw your video before the 5 days were up. I sent my form and letter in on time. And I just checked my account and got the refund back. I cannot thank you enough ❤

    I just wanted to thank you for this video. I overnighted my rescission letter on Monday, On Thursday I received the signature card back and on Friday I received a confirmation email that our timeshare was canceled. I can't believe how quickly this was handled. Thank you so much!

    We just got out of ours. Thank you for the info! I watched this video on our way home. We mailed a certified letter and a regular stamped letter too.
    My husband was in contact with the salesman. He had asked him if we could cancel. He told him yes, asked him what was going on because “they take cancellations very seriously and we are going to make him look bad” 😅

    I rescinded my contract today within my 10 day rescission period from watching your videos. One reason was I couldn't get any information after I signed. I couldn't log into the website to do any research on what was available to use with the points I purchased. With all the different programs and such it was very confusing. I emailed & called my rep but no call back until this afternoon-day 10 of my cancellation period. I emailed letter and mailed 2 letters one certified today so I should be good to go.
    Thank you for the great information. The folks were really nice at the presentation so I feel bad cancelling. However I do believe it was the right decision as it wasn't cheap for a low amount of points and I don't think would meet my needs.

      Never feel bad. Their job is to be nice. That is why they are so good at what they do. Given the one time chance, it is always best to cancel. You have a long time to do more research but the clock is always ticking on that recission period.

    I went today to send my letter, everything was close due to memorial day. I started searching how long will my letter get to the resort since I will be sending it tomorrow morning.

      So happy that you found this video. Timeshare sales pitches certainly can be high pressure. The most important thing is to follow the rescission instructions as they are in your contract. Don't go back in to the sales office to try to cancel.

      The sales office is not responsible for processing legal rescissions. Their job is to keep the sale and talk you into not rescinding. Their commission depends on it. They will string you along long enough to get past the rescission period. Do not talk to sales!
      The way to legally rescind is to use the instructions provided in the contract which will indicate to send your letter to the correct department that processes rescissions.

      @@Drod11z Capital Vacation told me I couldn't see all the resorts until I was fully loaded in the system and it would take about 30 days. That didn't sound right since I had ten days to cancel. I resend my membership and got a refund.

    Thanks for your information. Even though the letter I sent was postmarked within the grace period I was concerned since the letter did not arrive till one day after the grace period. You video was helpful.

    I was able to. signed timeshare with gevc rci yesterday and after sleeping on it which left me without being able to sleep peacefully I didn’t know I would be able to but searched the laws in my state with timeshares therefore learned about the recession period and that I am entitled to a refund. I found a sample letter of recession and emailed my recession request and sent a copy through usp I already got a response with the cancellation notice and refund that will be processed. I replied and let them know they will receive my recession letter in the mail in three days and asked for a cancellation letter sent to me. I hope everything works out and they send me something in writing. Now looking at your video helped me confirm my doing. If I didn’t read the state statues of my state regarding this I wouldn’t have known what recession was to be honest. I hope this helps someone as naïve as I was

    On my experience, Florida state law gives 10 days, and Nevada state law gives 5 days to rescind the timeshare purchase contracts. Need to use Certified Mail or Priority Mail Express (with Signature).

      Your number of days is correct. Though signature required isn't really necessary. Keep in mind that, legally, Certified Mail doesn't have to be accepted by the receiving party and they don't have to sign for it. I don't think any timeshare companies would play those games, but it is a reason I like to advise sending the letter with some trackable method and also with a regular first class stamp. Proof of delivery/tracking is good for piece of mind more than anything else.

    We just rescinded our Marriott Vacation Club purchase after getting charmed by a salesperson with a great personality. She was low on information, so that huge red flag went ignored by me and my spouse. After getting home, talking about how much money we just signed for, and looking around for our own info and watching your videos, we decided to back out. Thanks for your info! For what we would have spent on MVC, we can get so much more vacation out of by renting from TS owners, buying on the resale market, or just doing the old fashioned hotel stays. We like Marriotts, so with the name attached it seemed like a good thing. Come to find out MVC is a separate thing only loosely connected with Marriott hotels. My contract stated I could rescind by notifying them by email, fax, or post, so I did all three (certified return receipt for the letter). I got an acknowledgement email from a paperwork processor at HQ and am nervously checking for my refund.

      Wanted to update that I got my refund within 2 weeks of my request, even after a call from the salesperson offering some bonus points for the first year, which we obviously declined. Getting the gift for attending the presentation was another matter- it took several calls to different offices until I finally ran into an mvc customer support agent who ensured the promised bonvoy points were actually transferred to my account about 2.5 months after the date of the presentation. Thanks again for your helpful videos!

      Sent the regular and certified mail on Monday along with an email on the 24th, the contract was signed on the 19th. The letter was received today on the 28th at 11:45am. The only thing they have done was cancel auto pay it doesn't say closed. I also did the claim on the charge on the card but that still pending. I have sent Follow up emails no response.

      Yeah, many people find out too late about rescission. You still own a good vacation product that if used correctly can get you great vacations to create memories with your family.     Wow I do not know why I didn’t think of looking up about this topic before 😭, I got so uncomfortable in that presentation and the sale rep changed his face as soon as I said I need to think about this, you are giving me too much information, they gave me many options until the point I ended up signing up 🤦🏻‍♀️, I did not read the contract when I flight back home until it was over 2 weeks. This happened at the end of July, and now I am screwed

      Unfortunately you only have a limited time to rescind. Your purchase looks like it was over a month ago, so that would be outside any timeshare rescission period that I am aware of. Your best option now is to look at what you own, understand it and learn how best to use it and not let it go to waste. There is nothing wrong with timeshare if you use it for great vacations.

      Hello and welcome to the channel! Sorry you found this too late to rescind. That said, MVC is still a great product with fantastic resorts. The best way to make the best of it is to simply use it. Many people get disgruntled and then pay for a timeshare for years all while never using it. Timeshares can provide for great family vacations and Marriott is a quality product. Thanks for watching!

      @@salviarojas9464 Unfortunately once you are beyond the rescission period, there aren't any easy ways out without potentially impacting your credit or having tax consequences if they write off a loan balance.
      While Wyndham sales practices are very bad, their resorts are actually quite nice and offer a great vacation experience. Just avoid the sales presentations in the future. Check out TUGBBS.com and the Wyndham forum and learn how to best use what you own so you can get the best vacations possible.

      It depends. The address should be included in the contract you signed. Do you have a copy of your contract?

    I am glad I found your video. You are helping sooo many people. I was suckered into signing up for Sapphire Resorts in Las Vegas. I hand delivered them the cancellation paper that was provided in the contract package. It included the contract number, mine and my husband's signature. I also sent it to them via USPS express. I saw that my deposit/downpayment is pending a credit back to my bank account. However, I am a little worried about future charges because we didn't draft the letter ourselves. We signed what was provided in the contract package which stated the recession period and our right to cancel within 5 calendar days. Should I lose sleep over this? Thank you soo much for your help.

      You should be just fine. Nevada has that form that they include with the contract. It seems to be a Nevada thing. Congrats on finding it in time to cancel.

      @@DestinationTimeshare I am so nervous now. My card showed pending for a refund since December 19th then today, December 24th, it went missing. I called the credit card company and they said the merchant revoked the refund. So I tried calling the phone number the recession manager said was his contact number, and the message said "this number is not in service". Do you have any suggestions what I should do? My brother lives in Las Vegas. I was thinking of asking him to help go there and talk to these guys. I'm freaking out. How can they just revoke it? Is it because of the form and that I didn't write it out myself?

      Not really sure what to suggest. Most cards I have don't show pending refunds. It is also possible that you got bad information from your bank and the refund will show as posted in the next day or two. If you sent everything as you should have and have documented delivery, then all should be fine. You could try calling Sapphire Resorts if you don't see the refunded posted by early Next week. You probably won't get a lot of response over the holiday.
      The people he would be able to talk to would only be in sales and they wouldn't be there to help with a recission and he probably couldn't act on your behalf.

    Hey there thanks for the informative video.
    I really wanted to see in my case if it is worth canceling. It’s been less than a week that I’ve purchased into Hilton grand vacation club and my wife and I been really been scratching our heads to see if we really made the right decision or not. Could you please honestly tell me if we should rescind or continue?
    We purchased 6,200 HGVC points for $24,000 with $5k downpayment, so we’re financing $19k. Also, we got 35,000 bonus point and 75k Hilton honors for attending the time share.

      You should definitely cancel. This is really your one and only chance to do so so easily before you are locked in for a long time, a lot of money and endless payment. You can buy double or triple the number of points you did on the resale market for less than what you paid. In fact you can probably buy the 6,200 points just for less than what you paid in the $5,000 down payment.
      Also, if you are financing you are adding a lot to the cost in interest. Buying direct and financing are two of the biggest mistakes one can make buying timeshare. Look at resale to save thousands.
      Take the opportunity now to cancel before it is too late then it will give you the chance to do more research and learn if timeshare or even HGVC is the best option for you.

      @@137Huzaifah It is based on postmark date. So for sure send it today and by Certified Mail. I also suggest sending a second letter, just First Class with a stamp. Though also ask for a Certificate of Mailing with that. It only costs a few dollars. A backup delivery method is a good piece of mind to have. Certificate of Mailing provides postmarked proof to you that you sent something from an address to another and the post office will stamp it with the post mark.

      Yeah, they can be sneaky sometimes. If you recently bought HGVC and still in the rescission period, be sure to rescind. Hilton is one of the systems where if you buy resale you get almost all the same privileges that a direct from developer buyer gets, you just pay far less money. If you want to own HGVC, it is almost always best to buy resale.

      Did you receive a refund of any down payment or closing costs paid? Generally, their only obligation is to cancel the contract and refund any money that was paid. If you got a refund, then you are all good. If they haven't hounded you for any payments, then you should be covered.

    We have purchased a vacation membership in Mexico on November 14th 2019. We were promised incentives that we realized that wasnt even on the contract. When we got back in Canada and got a chance to review the contract, to our disappointment we are already 9 days from the purchase to cancel the membership. My question is, is there still a way to process a cancellation? Ofcouse, we are fully aware that our deposit will not be refunded anymore. As I spoke to their verification personnel, they are unable to cancel and they will just forward it to their legal department. Thank you so much!

      It is based on postmark date. So as long as it was sent within the recission period, then it doesn't matter when they received it or opened it.

      Chances are, you won't hear from them. Or if you do it will be to try to talk you in to not cancelling. It is possible that the next communication or indication you get from them is the refund. If they do try to call you, either don't answer or don't let them talk you into not cancelling. They will try to save their sale. As long as you sent your rescission letter in the legal time frame and per the contract, they will honor it. Even the lowest level timeshare companies don't mess with legal rescissions.

      Unfortunately there isn't. The best you can do is work with the timeshare company. If the timeshare is paid in full, many companies offer deedback programs through responsibleexit.com. However, if you still have an outstanding loan, that loan is the same as any other real estate mortgage and the timeshare company is unlikely willing to do anything to assist until it is paid in full.

    I got suckered into starting to sign some paperwork today but had to leave and was supposed to go back to finish everything tomorrow. They refunded my deposit and said they would have to re bill tomorrow and go over other information taking about 40 minutes. Is there anything aside from going back and saying I changed my mind that I need to do since I didn’t go through with the whole process?

      As long as you didn't sign anything and they refunded you already, you don't really even need to go back in for anything. They will do everything they can to talk you into buying. Why you are making such a big mistake by not buying. Yadda, yadda. If you truly never signed a single piece of paper and they have refunded you, you are under no obligation to return to the sales office. If you did sign something, then you are best to write up a rescission letter and give it to them since you probably don't have a contract. Thanks for watching!

    Hi there, I am cancelling my Hilton Grand Vacations contract as I write this. I need to put the name of the COMPANY but it only Says Hilton Grand Vacations on the contract in regards to the Points and Bonus Points. On the First page it says.ERGS Timeshare LLC, Do I put HIlton Grand Vacations /ERGS Time Share LLC with the Address of ERGS as it's on PAGE ONE... I do not recall them ever referring to ERGS at any point. Please Help.

      You need to find the section of the contract that will provide the address of where to send the rescission letter to. It may not be the registered address of the company. I don't think this section would be on page 1, it is usually buried in the contract. It will specify exactly where to mail the letter and who it should be addressed to.

    I am so glad I am seeing your video. I've made the biggest mistake. I signed up for timeshare with Wyndham in Florida. I read through my contract, Florida gives 10 days cancelation.
    Question- Will I need to send all the paper copies of the contract agreement along with my rescission letter?

      Generally no. However it might be a good idea to include a copy of the front page or whichever page references the contact number and perhaps a copy of the signature page. Though if your rescission letter references your contract number or way to identify the contrade being rescinded, then you would be fine.     Thanks Jeremy. i signed the purchase documents 5 days ago on Saturday. I just looked at the material given to me and there are no copies of the signed papers. The salesman said they would send out paperwork after they returned to their office in Phoenix. He also said there was a 10 day rescission period for Texas. Now I'm wondering if they will slow walk the sending of the documents and suddenly I'm locked into the purchase. Can they do that?

      You should have been provided documents after signing. Sounds like they may be trying to slow things down for you. Did they give you a thumb drive? Where did you purchase the points? Was it at one of their "roadshow" events? You need to try and find the address (in Orlando) to mail a rescission letter to.

      This is not to be considered legal advice...
      The rescission law and timeframe is determined by the state in which you sign the contract or the state in which the timeshare you are buying is located. So if you are in Colorado when you sign the contract, the recession is determined by Colorado law. But if the timeshare you bought is located in California and California has a longer period, then CA law may take precedence. Colorado has a 5 day right of rescission and California has 7 days. What exactly did you buy and where was it purchased?
      Generally timeshare exit contracts aren't protected under rescission law.

    Great video. Quick question for you. We previously owned a timeshare for 3 years. A couple days ago here in Florida we upgraded (restructured) our contract into a new contract. So on this new contract the recision period is opened again. We are sending out letter to cancel on Monday, but will it just revert us back to our old contract?

      Yes, it will just revert to the previous timeshare you owned. They will unwind the deal you made to "upgrade". Good job on rescinding, "upgrading" is very rarely a good idea. It mostly helps upgrade the timeshare companies bottom line with little benefit to you. What did you own and what were you upgrading to?

    Hello, thank you for your video I found it very informative and helpful. My Fiance and I signed a contract on 12/10 in VA and regretted it once we arrive home the same day, we do not live in VA. I sent 2 rescind letters on Tuesday 12/13 1 first class and 1 certified. My 1st class letter arrived on 12/15 and my certified letter arrived on 12/16. I know I'm within the 7 days to rescind the contract, I am just worried as I haven't heard anything from the company on them receiving my letters. Should I call them? Should I call my credit card company and tell them I no longer approve the charge?

      Hello & thanks for watching. Glad you learned about your right to cancel on time. The timeshare developers are under no legal obligation to provide a status update or respond in any way. Most likely, the only way you know they have done anything is that you will see a refund of any monies that you paid on your credit card. I don't necessarily need to contact your credit card company. It can take them up to 30 days, or sometimes more, to fully refund you. You usually have 60 days from the time the charge first appears on a credit card statement to dispute it with your bank.

    Hello. My wife and I just purchased a timeshare at Vidanta in Mexico, and we immediately regret it. We were caught up in the idea of selling our time to other people to make the money back, and saving money for future travel with the perks. We now see that it will not be easy to get out of it what we will be putting into it. We are trying today to figure out how to rescind the contract. We found an address in the contract relating to the contract in terms of internal policy. We hope to find a way to get this mailed out today to cancel this contract!       Are you still in Mexico? If so, you may also be able to hand deliver the recission. This is not something normally recommended, but the postal system there is very unreliable. Just don't let them talk you back in to keeping what you bought and get a signed acknowledgement from them that they received your rescission letter.
      Is there also an option to email or fax? I suggest registering on the TUG Forums and asking your question in the Mexico forum as there will be many more there that can provide advice on how to make sure you successfully rescind your contract.     I have a question and I am hoping you could help me. I recently got sucked into purchasing a time share during my vacation to Orlando but long story short I was able to rescind my contract by letter within the 10 day window as stated in the contract and Florida law. I sent it as priority mail so it could get there faster and even bought a return receipt to go with it. I just want to know since the return receipt needs a signature from the receiver I want to know if they could refuse to sign it and therefore the package won’t be delivered and returned back to the post office and my ten day time window won’t work. I hope this isn’t the case but one just doesn’t know if this could be a possibility.

      I have often wondered this myself but many people send their rescission letters as signature required or certified and have no issues. Legal right of rescission is one thing that the developers won't play games with. So you should be fine. I often also suggest just sending a second letter with a regular old first class mail stamp on it.

In the contract it states that the notice of cancellation shall be effective upon the date sent and shall be sent to: Business name, ATTN: Corporate Sales Accounting Department, and then the address. The first package I sent had only the business name and address in the “To:”section but I’m thinking that maybe I should send the second letter with the “ATTN” just to be on the safe side. Do you think that part matters? I only added that to my letter but not the shipping label.

    Hi, i got pressured into signing a timeshare contract with Bluegreen two days ago and im doing my recession letter today. They also got me into applying for their mastercard and use that to pay for the downpayment. My question is will the credit card also be cancelled upon cancellation of my contract or do i need to call teh credit card company and cancel it there too? Thanks!

      The credit card is a separate application through a financial institution and isn't subject to rescission like the timeshare contract is. I suspect they charged the down payment to the credit card? If so, you will first want to send your rescission letter to Bluegreen per the instructions in the contract. They may take some time to complete the rescission and provide the refund of the down payment to the card. After that, you can choose to keep or cancel the credit card. The credit card likely won't be cancelled when the timeshare contract is because the credit card is through a third party bank or financial institution.
      Congratulations on learning about and taking advantage of your right of rescission. You just saved yourself a lot of money!!!

    Beware of the 3DAY rescission. I was able to stop within 10Day rescission clause the “Bait & Switch” tactic on purchasing a New Smaller Timeshare at this CA meeting to EXIT a CURRENT TIMESHARE. My receipt from FEDEX or usps is proof mailed out & proof of signature receipt.

    Hello, If we signed contract in Vegas on Saturday and we have five calendar days to rescind I just overnighted THE NOTICE OF CANCELLATION FORM yesterday Wednesday (I did ask for signature). The form was hidden in a booklet they gave us. Was it necessary to send a separate written letter also with the the notification of cancellation form they had in paperwork? The form did not indicate a separate letter was needed. It send the notice of cancellation to address they listed.

      If they provided a form for notice of cancellation, that should be sufficient. As long as you followed the instructions provided in your material/contract, you should be fine.

      @@robynthompson4440 I wouldn't count on any real official response other than a refund of any deposit you paid. They generally don't provide status updates. You may get a letter later or you may not. If you paid a down payment, watch for the refund. Was this a Westgate?

    Today is 8/11and we purchased 1000 Marriott vacation club points ($15000) on 8/7 while staying in Aruba. I’m just getting very nervous after watching a couple of your videos. The fact that 1000 club points is not significant or that it’s really hard to book them. I’m thinking to cancel. In the contract it states that I have a 10-day cancellation period but I can’t find anywhere in the contract of the steps I need to take to cancel. Am I missing something? Btw they gave us a USB and I don’t have a computer here to check it. I travel back home tomorrow. Thank you for your videos!!!

      Rescinding is always a good decision. THere is only one limited time chance to rescind, but they will always take your money later if you decide to buy after doing more research. Here is a link to a TUG thread where someone had a similar issue, though they had access to the files on the thumb drive. I beleive there is an email address as well as a mailing address. This was in Arizona though, so the delivery information may not apply.       Yes, annual maintenance fees will go up. The cost to operate the resorts will always go higher with inflation. I am not exactly sure what you bought though, because a $200 yearly maintenance fee is very low. The average is more like $1000 for a two bedroom unit for a week.

    I have so much anxiety and what seems like millions of questions! I signed 4/25, seen this video the night of 4/27 (when I returned home) and mailed our letter 4/28. I have another question. We were brought into this purchase by those people of on the Vegas strip because of their coupons for food attractions, etc. Besides the gifts promised from the timeshare sellers, a Disney trip. Do I have to give back the coupons for food, attractions, etc? I used the food one (because we were hungry!) We gave one voucher away. And still have the vouchers. I am usually pretty good with not signing my life away. But I let my guard down that day and I’m fully regretting it. I just need reassurance.

      If the coupons and vouchers were promised by the person that signed you up for the presentation as a gift for attending the presentation, those don't need to be returned. Congratulations on finding this video and rescinding in time. Nevada has a very short timeshare rescission window.

      @@aprilmedina8549 I am pretty sure that California is 7 calendar days. In either case, it would go by the state where you signed the contract. So in this case, it would be Nevada which is five days.

      Do you have a copy of the contract or did they give you a CD? If they gave you a binder, check for the hidden puch where they like to hid the ROFR details. Not sure where you bought, but if it iwas in Florida you have 10 days. In Nevada it is much shorter. Can't speak to all the other states.
      Here is a TUG thread with some details provided by people that know more about Westgate than I do. I think an address may be provided. Don't try calling them, their job is to sell you and they will do everything to get you to not rescind. Get out now while you can, Westgate has a very poor reputation.
      Rescind based on the details in the contract. If it says to mail it, mail it. Sertified is also recommended. Do read through this TUG thread though.

    Hey I just faxed my recession letter today on the last day before 12am. Will they have to honor it ? Technically within 7 days Tuesday to Tuesday. Or should I also mail it ? It’s already the next day

      Was fax information provided in the contract as a method to rescind? If so, all should be well. Mailing on day eight also may be problematic as they may receive that and ignore the fax.       I recommend sending back anything they gifted you as part of the purchase. Not necessarily because they won't let you cancel if you don't, but they will probably try to charge you an inflated price for those gifts. They could withhold the inflated value from any deposit that they will be refunding. Don't send it with the letter though. Send the rescission letter on its own and indicate in the latter that the tablet will also be returned under separate cover. Ship that tablet back via the cheapest method with tracking possible.
      Congratulations on the rescission, Westgate is one system you are probably best to avoid.

Worst case is they deduct from any refund due, but I suspect it was separate from the purchase and it was your incentive to go to the presentation and thus you fulfilled that obligation and it should be yours.

      Where did you purchase? What resort and location? Are you saying the address in your contract to send the rescission to is closed? Going to the resort isn't the legal method to rescind and they will try to convince you not to. Following the instructions in your contract is very important. The address to send the rescission to won't always be the same as the developer.

      Your contract will specify the method in which you can legally rescind. In the United States, this will usually be by USPS mail. It is generally not advised to go back to the sales office to rescind because they are not the people that handle rescissions and their goal is to get you to not rescind. Read through your contract to find information regarding rescinding or cancelling the contract. Instructions and mailing address/fax/email will be provided there based on the legally recognized methods.

    I just got home from Vegas this morning. We signed up for a timeshare in Orlando after a long push and pull! After reading reviews this morning, I want out! So I signed with Westgate in Vegas for an Orlando location, and the notice of cancellation form has an Orlando return address. Should I automatically send back all the things given when I made the purchase? Should I put the Cancellation letter in the same box with the large binder and iPad they gave us?

      I would recommend just sending the rescission letter on its own with a mention in it that all provided materials will be returned under separate cover. Then put the other stuff in a box and ship it back the cheapest way possible. Definitely return the stuff, because they have at times charged buyers for that stuff and taken it out of any refund they pay.

      If you are past the right of rescission, your only options really are to sell it, give it away or default. If you owe any money on it, selling or giving it away it is almost impossible. Giving it away will cause you to lose everything you paid (which is typical in timeshare) . The latter, default, can have negative consequences to your credit.
      For most people who are past the recission period, my advice is to learn best how to use the product that you purchased. There was certainly something intriguing about it and the resort you visited to make you want to buy. Timeshare can be a way to save money on annual vacation accommodation.

      I don't recommend going into the office, they will certainly try to talk you out of the recission. If you are in the USA, I suggest following the instructions in the contract to the letter. Determine where you are supposed to send the recission to and perhaps send certified mail or at least with some kind of tracking. Any other method used, other than what is in the contract, may not be honored. Follow the contract. If you can't find recission instructions, perhaps check out www.TUGBBS.com forums for the specific developer and ask there where to send the rescission to. Other with experience with that developer may have the correct address.
      As a last resort, then going to the office is a possibility, but again, they are not there working in your best interest. They want to protect the sale and their commission. An unethical company could take your recision and drop it in the trash. When you send the recission per the contract, it will get to the right people that will legally need to honor your recission.

    Hi, I know this video is 3 years old but I was hoping you could help. I signed a contract yesterday at the Wyndham in Las Vegas , this morning went in to cancel the contract. The sales manager had me sign a cancellation form but we did not get a cancellation email or anything else confirming we cancelled. She said we didn’t have to mail anything but we are still getting emails welcoming us. I am worried they won’t cancel our contract. Any advice?

      As old as this video is, it still helps many people to this day learn about their legal right to cancel a timeshare contract in the recission period. Thanks for watching and glad you found it!
      If you just signed yesterday, I also suggest mailing in a rescission letter to the address and per the instructions in your contract. While Wyndham shouldn't play games like ignoring your carry in request, the legal way to rescind is to follow the instructions in the contract. Then your rights are protected. I wouldn't trust sales to handle the request properly because they don't handle rescissions and they want to save a sale. Mail a letter, usually recommend some kind of tracking for peace of mind. A single first class letter (stamp) in addition to the one sent with tracking can be good too. The small amount of money to physically send a letter to the rescission address is worth it.

We wrote a letter to the developer which had something under the lines of " this writing is proof of our intent to cancel our timeshare within the 5 day alloted cancelation period. Would I have to include the words exercise our right to recession or is what I wrote enough to get it cancelled?

      You should only need to rescind the timeshare purchase per your contract. I don't really know how the loan works, but any amount drawn against it would be wiped out when they refund the deposit under the rescission. Read through your contract thoroughly to make sure you don't miss anything.

      Unfortunately I don't. Once outside the legally permitted rescission period, you now own the timeshare. If you have a loan on the timeshare, your only option is to pay it off before you can sell or give away what you own. The best advice is to learn as much as you can about what you own and make the best use of it that you can. Not sure where you own, but most timeshare resorts are fantastic properties. One thing not to do is to pay some outfit that promises to get you out of your timeshare, these are most often scams that do nothing or just end up getting your timeshare foreclosed on if you stop paying. I can certainly provide advice on how to maximize your ownership. What property or resort system did you buy into? Thanks for watching!

      @@sheenabrooks2996 If it is fully paid off, you could consider contacting the resort management company/developer and see if they have a deedback program. If you only owe a small amount, it might make sense to pay that off and then try the deedback route vs. taking the credit hit.

      Those sales reps are good at what they do. They convince plenty of people every day. So glad you found this in time and are able to rescind. Check out my Four Rs video to see what you can do next if you are still interested in timeshare, but at pennies on the dollar for what they were trying to sell them to you for.
      As to what to do with that other stuff. I would actually send it separate from the letter. Send the letter with some trackable method and indicate that you are forwarding the other items provided under separate cover/package. Then you can ship those using standard parcel ground or the cheapest method possible. If it wasn't for the tablet you could send it all media mail for dirt cheap. They will likely take the cost of those items out of whatever deposit you paid for the timeshare. So you will want to return them to ensure a full refund.

      The only thing you are likely to see is a refund of any down payment. You won't receive status updates but you might receive a letter or correspondence when the rescission is complete.     Hello friend. Westgate deceived my mother and I into buying the time share. We financed the property not knowing it was a time share. Once we found out we had 10 days to get out but didn’t have the chance to go back to Florida to do that. We hired a company called Primo to help us get out and payed them about 5 grand but, it’s been a while and they haven’t done anything for us. Would you have any tips or info on what I could do ? I would be very grateful for any help. Thank you 🙏🏼

      Unfortunately it seems that you have now been taken advantage of twice. Not only by Westgate but again by a timeshare exit operation that charged a large upfront fee and doesn't deliver on its promise and won't deliver on any promised "money back guarantee". There is no good timeshare exit company out there that can help you get out of your timeshare. They are pretty much all scams as you have learned they aren't able to get you out of your timeshare.
      There really isn't anything I can do to help you in the situation you are in to either recover any money you have lost or get you out of the Westgate timeshare. You have several options, the first being to contact Westgate and see if they will take it back (doubtful with an outstanding loan). There is pretty much zero chance of being able to sell it or give it away since there is probably $0 resale value in the Westgate timeshare week you own.
      Your only other option is just to walk away and understand the ramifications that it could have on your credit scores when defaulting on loan and maintenance fee payments and subsequent foreclosure.       Send the letter. Send it with some trackable method. They are legally obligated to accept the letter. You can send certified, but that requires a signature and they could decline, but that would be sleazy of them. I actually suggest sending it both ways, trackable as well as regular first class with a stamp. Best to have all your bases covered here. They can't decline first class mail and they must recognize the post mark date not the date they receive it.
      Given your short timeframe to rescind, SEND IT TODAY!

    Hello, i recently purchased a timeshare but after all the bad reviews about it we regreted and we are just one day after the contract signing, the contract states i have a 10 day period to rescind the contract. Will that get me out of it and if the money will go to pay the loan straitght to them. Thank you.

      If you are still within your rescission period, then you need to rescind and you will get refunded any monies paid and any loan that you signed will no longer apply.
      Be sure to send your rescission letter to the address provided in the contract and make sure the letter is signed by all people that also signed the contract. Glad to hear you found those bad reviews before it was too late. Thanks for watching.

      Sorry to say that you are well beyond any timeshare rescission period. The longest that I am aware of is 10 days and you are around day 23. I suspect your timeshare deal isn't closed yet? DId you take financing or paying in cash? Did you just pay a down payment with later due at closing?     Great video! Quick question - I purchased a time share from sapphire resorts today (formally known as Geo Holiday club). Can you please tell If it is a good one? I searched online but couldn’t find any reviews about them.

      I really don't know anything about Sapphire Resorts. That said, since you don't really know enough about it or them, I suggest you rescind. You only have one chance to do so because once the rescission period is over, you are stuck with whatever you bought.
      As for trustworthiness, a purchase from the developer is usually ver overpriced and you can probably get is for pennies on the resale market. I suspect that this system has zero resale value. For what you paid, you can probably buy a resale timeshare in a major resort chain like Marriott, Westin, Sheraton or Hilton for much less.
      Looking into them a little. It looks like they only have seven resorts. The other resorts they show on their website are shown as "Geo Options Resorts". These are often referred to as affiliates. An agreement where they can maybe get some bookings into those resorts. Affiliates are more about putting resorts into a resort book with pictures to make it look like they are much bigger than they really are. In the end, they look to only have seven of their own direct resorts. 3 in the USA, 3 in Canada and 1 in the Netherlands.

      We sent a “Request for Cancellation” letter and the incentives they provided for signing up through USPS Priority mail (as mentioned in the contract). I just received my complete refund back.

    Hi there… another person scammed by westgate. My transaction happened less than 24 hours ago and needless to say i want to cancel. I didn’t know until I got back to my room that the contact was on a zip drive. Only the deed was in the bulky envelope. If for some reason they give me the runaround about getting a physical copy of the contract can I still Risind without the contact number?

      Does the resort you are staying at have a business center? If so, take the thumb drive there and see if you can print stuff out. I am getting ready to drop an updated version of this video in the next day or so and that is one of my tips. You really need to see the contract to know where to send your rescission letter to.
      You can still rescind without the contract number and your contract may not even have a number. In your letter you should be able to provide the names of everyone that signed and the date of signing. They shouldn't have an issue matching that up with a contract. Just be sure that everyone who signed also signs the rescission letter.
      Congratulations on finding this video in time and learning about your right to cancel. You dodged a bit bullet with Westgate.

I am still within the area so I guess I will call the rep and ask for a printed copy of the contract and hopefully they will comply. I also think the zip drive is a scam because they sent me an email login for my account but it says I’m already registered and wants me to call an 800 number.

      Yeah, the USB drives are a trick to make it hard to get the documents off of it. If you are near an office supply store or something like FedEx or USP Store, they may be able to print the contents of the drive. For a fee, but much cheaper than that Westgate timeshare.

    Thanks for the information. You’re saving people thousands of dollars. I signed the contract on Monday 12/05 and since then I couldn’t sleep and went I got the airport on 12/06. I read the whole contract and the extensive paperwork they provide me with. I found the section of “purchaser’s nonwaivable Right to cancel. I’m sending the letter tomorrow morning, which is the 3rd day of 10 of my window. I hope it goes through fast. I haven’t paid anything since they told me I was qualified for 0 down payment for 6 month. Do you think I would have any problem?

      You won't have any problems as long as you send your recission per the instructions in the contract and to the address provided. Timeshare developers may be sneaky trying to sell you a timeshare, but they don't mess with legal cancellation rights provided by the state. Congratulations on finding out about your right to cancel in time. Far too often, people find out too late.

      Definitely. But as you said in the video, it is all a strategy. They target people that are on vacation and asked you how many days you’re staying and everything - they know that most people don’t check emails or read contracts on vacation. Yea I’m sending the letter according how it is on the agreement, following your suggestion of the certified mail for tracking and the stamp (regular way)

    we've had our timeshare since the 90s, it was amber vacation group, but has changed hands a few times, the maintenence fee keeps going up & the upkeep on the rooms is below par! can you please tell us our best option to get rid of it! none of our kids want it.(smart kids) its been fully paid for years. we've had great vacay's here. its in pidgeon forge Tenn.

      Unfortunately, your timeshare probably has no value and would need to be given away. It may even require paying all closing costs to transfer to a new owner.       It doesn't need to be complex or fancy, it just needs to include the contract information for the timeshare you are cancelling and indicate you are cancelling the timeshare you purchased.     Hello, it’s me again just wanted to give y’all a little update. I sent my recession letter the day after I signed and it got delivered this week on Monday so it was within the ten day time window for Florida (where we signed). I called the day after it showed it was delivered to the company and asked if they received it and they said that the cancellation was in process. I called this morning to see when I would be receiving a cancellation notice via email? And they said they don’t send any emails or anything about cancelling. They pretty much said that once my credit card has been reimbursed the money used for the down payment of the timeshare that will be my proof. Is this accurate information? I feel like they should send me proof that the cancellation went through just in case anything comes back.

      I just received my full deposit refund from Westgate, Orlando exactly 2 weeks from sending my cancellation letter. You should be good if you wrote the letter correct per the contract. I wouldn't expect a cancellation letter. If they call, they may try to dissuade you.

I typed my name and spouse's name stating we are exercising our right of rescission of contract for time share purchase. I clearly stated where/when we signed the contract and I requested a full refund of my down payment. Hope this helps. If you already sent a letter I don't know if sending another one with additional verbiage will help. I'm pretty sure as long as you stated to cancel the contract you should be good.

      You certainly dodged a bullet on this one. Westgate is one of the worst timeshare companies out there. What you bought for thousands will be worth nothing once the rescission period is over.
      Good thing is that you have time. Rescission period in Florida is 10 days. First advice is to not go in person and try to rescind. Don't talk to the sales staff again or accept any calls from them. You need to valid reason to rescind. You simply have the legal right to do so under Florida law. Read your contract thoroughly and find the section relating to rescission. Did they give you a paper contract or a CD/DVD/Thumbdrive? Westgate is notorious for that because they know people don't have computers that have optical drives on them anymore.
      Your letter needs to only be very simple indicating you wish to rescind the timeshare purchase. No reason needs to be given. Be sure to include your contract number and also make sure that everyone who signed the contract also signs the rescission letter. Here are a few resources on what you can include in your letter as well as more information relating on Westgate rescissions in the event you can't find details relating to where to mail it to. My advice is to send one letter USPS Certified and another with just a standard first class postage stamp.

      Keep any contract or deed paperwork that has or could have your signature on it. If they gave you a big binder or resort directory, I would include that along with the tablet you send back. While the chance is low, they might try to deduct an inflated value from the refund to cover those items.

The priority mail got there and was received 2 days ago. Now I'm just waiting to see what happens next!

      Great. The next thing will be a refund (though it seems like you stop paid on the check. So there may be no real refund). The timeshare company is under no obligation to contact you or let you know they got the rescission letter. They are only obligated to cancel the contract. You may get a call from the salesperson as they try to save the deal and convince you to not cancel. I simply advice not accepting or taking their calls.

      Congratulations on finding about your right to rescind before it was too late! The letter doesn't need much detail. Just state you are cancelling your contract. No need to provide a reason why. It should be dated and include the contract number from the contract you signed. Sometimes including a copy of the first and signature page of your contract is a good idea.       I am not surprised. Generally there is no need to follow up and they are under no obligation to provide any status updates. As long as you sent your recission timely and correctly, then you are covered. Just watch for the refund to arrive.

      @@xSpreezyCorpsex Yes, when you cancel everything is reverted to how it was before you signed. The only thing that may remain is if they had you sign up for a credit card during the transaction. That credit card account is a separate application and would remain open.

      There is no need to activate your account. Send the letter and in the letter indicate you will be returning the tablet under a separate package. Send the tablet back using the cheapest ground shipping method possible. You want to return anything of monetary value that they sent you. So if they also gave you some big book showcasing all the resorts, return that with the tablet also. They have been known to retain the value of anything of value from any refund provided.

      I hope you got your rescission letter sent. The copies of paperwork that you have are for your records. Many people include a copy of the first and signature page of the contract, but that isn't really necessary.

    I found your video on time. I sent the letter two days before the rescission window expire, but the company is telling me that the letter was postmarked two day after the rescission window and they would not honor it. Is that even a thing?

      I have never seen this situation before. What day did you mail it? Did you go in person to the post office or just drop it in a box somewhere?

      @@DestinationTimeshare i went in person, and I mailed it on the 10th. The post person assured me that when you drop it in person, it is postmark that very moment.

      The last day for recission was the 12, but the escrow company is telling me that the letter was postmarked on the 14 some 4 days after I dropped it.

      @@covenskyroudsenpierre7634 You should have asked for a Certificate of Mailing. That is something that proves you mailed it when you did. They probably should have suggested that.
      Did you just mail with a First Class stamp? Or did you mail certified?

      @@DestinationTimeshare I have something like that. What I don’t understand is that I dropped the letter in person at the store and witnessed the agent applying the postmark on the 10th

    If I’m in Nevada and I just signed can I go to the post office in Nevada and mail it saying I want to cancel, or do I need to wait until I go back to my home state to mail it.

      No need to wait. You can send it from any post office. Nevada has a very short recission period. The sooner you send it the better!

    I just signed the Sheraton Flex program in Sheraton Orlando, i am regretting because of the MF of $1000 for life i am feeling uncomfortable after signing the contract. What should i do, how do I RESCIND? Please help!

      How long ago did you sign the contract? If you are still within the 10 day rescission period, then you for sure want to rescind. Don't delay!

      To add, if you are still in the rescission period, read through the contract. It will provide instructions on how to rescind and where to send your rescission letter to. Your letter needs to be very simple stating you are rescinding. Be sure it is signed by all parties that signed the contract and also provide any identifying information from the contract (such as contract number).       @@DestinationTimeshare just yesterday! i will definitely write a letter when I back to nyc. Thanks for the video and I found the 10 days cancellation policy in my contract. Crossing my finger i hope it will works smoothly. MF due forever, plus the monthly is really a commitment in the unknown future of my trips..

      @@cathylie9636 As long as you follow the instructions and mail as indicated in the contract, everything will be fine. Vistana will honor the rescission. I suggest sending your letter in a trackable method via the US Postal Service to the address in the contract. DO NOT hand deliver it to the sales office in Orlando.
      Congratulations on finding this video in time to rescind. If you are interested in owning with Sheraton. There are far cheaper ways to get into the system than a five-figure purchase with interest. We paid less than $2000 for what we own that gives us 81,000 points to use. And the annual fees are cheaper too.

      @@DestinationTimeshare i am still at the resort and will check out today as well, I will definitely mail the letter with in 10 days my last chance. Do I have to send back all the kindle stuff? and will the salesman aware of it, he got my personal contact… and give me some idea where to get the good value of the timeshare with out paying 5 figures. Felt stupid being brainwashed goshh.

      You need to read the contract. If the contract indicates fax is acceptable, then you can fax. Though in most cases USPS mail service will always be accepted. Though for purchases outside the USA, it may be different. Read the contract and follow those instructions exactly as they indicate. That is the only legally protected way to rescind.
