Where there are equal equities , the law shall prevail

Equity will provide no specific remedies where the parties are equal, or where neither has been wronged. Thesignificance of this maxim is that applicants to the chancellors often did so because of the formal pleading of the lawcourts, and the lac+ of flexibility they offered to litigants. Law courts and legislature, as lawma+ers, through the limitsof the substantive law they had created, thus inculcated a certain status quo that affected private conduct, and privateordering of disputes. Equity, in theory, had the power to alter that status quo, ignoring the limits of legal relief, or legaldefenses. %ut courts of equity were hesitant to do so. This maxim reflects the hesitancy to upset the legal status quo./f in such a case, the law created no cause of action, equity would provide no reliefA if the law did provide relief, andthen the applicant would be obligated to bring a legal, rather than equitable action. This maxim overlaps with thepreviously mentioned Kequity follows the law.

Under legal mortgage there is a legal binding and provisions for both lender and borrower , the lender Can even take away the property if the loan amount is not paid
While in equitable mortgage there is no legal binding , everything is done on the basis of mutual understanding and verbal commitment so it is never safe
