You can't get banned for this. Developer mode costs $30 and if you try enabling this without owning a dev account you can't use the developer features. Otherwise, emulators are perfectly okay to use during dev mode. It also doesn't have a high chance of ruining your xbox unless you are a complete idiot.

It's for developers... to develop games it wasn't intended for anything other than that so if your using it for emulation thats your own risk
