Parkland school shooting survivor wins ownership of shooter's name in lawsuit settlement

  • The most severely wounded survivor of the 2018 mass shooting at Parkland's Marjory Stoneman Douglas High School now owns shooter Nikolas Cruz's name, and Cruz cannot give any interviews without his permission, under a settlement reached in a lawsuit.
    Under his recent settlement with Anthony Borges, Cruz must also turn over any money he might receive as a beneficiary of a relative's life insurance policy, participate in any scientific studies of mass shooters and donate his body to science after his death.

    This is actually pretty amazing. It means no documentaries, no future TV docudramas, no interviews, nothing. He’s got the power to let him rot in silence in prison. I hope other victims begin doing this with these monsters. Control what the media can put out there. These families deserve peace, not continued trauma from story after story, interviews every five years, etc.

      I agree. Those first two years of reports were just FAR too sympathetic. They've become pop-culture icons, almost like Elvis now. So many money grubbing people write plays, publish their writings, make tee-shirts, etc. We wouldn't be in this situation, had the media not reported every rumor they heard. The Brown family has become somewhat shunned in their community, for taking every opportunity to be interviewed and make money off of the tragedy.

    Anthony is such a beautiful and strong man. He came out with the worst wounds, but fought back the hardest even after all the pain. I’ve never heard of anything like this done before and for me I’m amazed at this intelligence. He took away the killers right to speak, and to be heard, like he took away many lives and innocence. May the angels continue looking after the families effected and the killers name to never plague this earth again🙏 Not as near as many people know the names of the victims, but everybody knows the killers name. As in who would be profiting from having the incident being used in media. would it be everyone or just that person who got the rights. What if one of the victim was called in for a interview for a documentary and the person who have the rights wasn't invited demanded money just because of that interview. This would really going to be a very tricky legal case once media production and money get involved. I think all victims should have the same right as that victim so there is zero to no chance this rights get abused.
      (I am commenting this in a neutral way, and anything that would involved IP can get pretty tricky)

      I don’t believe that the victim owns the story itself, only the shooter’s likeness. I also don’t think money is even involved (unless, I suppose, the victim demands it, but that’s not how it’s presented here). Anyone wanting to refer to the shooter’s likeness in media would need the victims consent to do so

    Suing to; take ownership of someones personal name, control their speech, and compel organ donation? This seems extremely unconstitutional and a violation of human rights. If the community decides a prisoner should not be executed and instead should be held in custody, it must be done humanely and free from violations of human rights, regardless of how egregious of an action they committed.

      I think I see what you're saying, but preventing the shooter from profiting on interviews, books, movie deals, etc while in prison doesn't seem bad. When the show Dahmer came out, I didn't watch it, but I remember thinking how awful that had to be for the families of the victims. No matter how he was portrayed, the fact that he and his name was getting more publicity and even a fan following seemed kind of sick. Like making families relive the trauma all over again. And there's been several mass murderers that have directly profited from those kinds of things or relished the idea of an interview because it keeps them relevant. This doesn't mean he doesn't have a name, it means he can't profit off of his life story or the story of the acts that he did. Ever.
      Now, I do have mixed feelings about the part where the shooter had to forfeit any insurance beneficiary claims he is named on and has to dedicate his brain and organs to science after death. But I don't know if I would call even those cruel given what he did and his lack of remorse.
      Seems like it can all be summed up by forcing the shooter into eventual obscurity except as a subject for medical research. And that might not be a bad thing considering how society has been treating shooters and serial killers up until now. Most people can name 5 mass shooters or serial killers but can't name 5 victims of them.

    I have no problem with this being used against a monster like him, but I am confused about how this is possible, and I'm worried about the precedent it sets. Is this only possible because the shooter agreed to it? Or does this mean that, in the US, a good lawyer can get a judge to strip you of the right to your name without your consent? It seems like a fundamental violation of freedom of speech. Again, idgaf about this guys rights, but the whole point of rights is that you get them no matter who you are.

    He doesn’t “own” his “name”, he owns the RIGHTS to make money from the name. Doesn’t mean a school shooter movie isn’t cooking, it just means Nik gets no money and the other kid would. He can absolutely decide to use Niks name and make money off it. That’s stupid and it’s also stupid for it to have gone to one kid. Should have went to a trust to all the kids impacted.

I totally get the world we live in now, where crime documentaries are all the rage and getting an interview with a killer would mean killer ratings. I think that says more about us as people than it does about the murderers

      He can't talk publicly about his crime, write books, agree to have films about it, no interviews and so on. He can't profit from it either.
      So if there was a book about his crime, Burges would have to agree to it and the profits would be his.

      There are already laws prohibiting criminals from profiting from their crime, so that's not a completely new concept.
      Personally, I'm not sure how to feel about that. It's a bit of a slippery slope and Burges is one of many victims, but any potential profits, as I understand it, would be received only by him.
      Does it mean that if other victims want to talk publicly about their experience they can't mention the name? I hope that's not the case, one victim shouldn't make that decision for others.

    this is hilarious but the precedent this could set is a little scary. I mean imagine someone owning your name and effectively silencing you from communication. what if a corporation does this to whistleblowers? this guy is a pos for killing those kids but again, the precedence this could set is crazy.

    The name ... for preventing him interviewing, eh maybe. But the truth is, No criminal should EVER be allowed to profit from their crimes and all who do interviews, and books and get money for that, should have to give that money to their victims. I think it should have been just a part of his sentence, not giving it to one of the survivors... what about the others? The rest of the details listed in the written description are borderline slavery. You should not be able to own another person.
    Also, how will this help him move on. As a sexual abuse survivor, my life was destroyed, my future taken. The last thing I would want is to see his name or be in charge of anything to do with him. Instead, I slowly put my life back together and moved on. How will this kid ever move on if he basically owns this guy .... also, can't the killer just change his name?
    I completely understand people wanting "justice." But there IS NO JUSTICE to be found. You will never get your innocence or your loved ones back. This seems to just add salt to a festering wound.
