Supreme Court Drops Bombshell Ruling On Electric Vehicles

  • The Supreme Court’s recent ruling on “Chevron deference” could affect federal regulations of everything from power plant emissions to electric vehicles to transmission lines.
    This changes the mandate for the green new deal and electric vehicle mandates. This is a win for consumers to choose their own “independence machines” or vehicles. Now, courts will have more say in interpreting rules on everything from the EPA’s latest effort to curb power plant emissions to the Federal Energy Regulatory Commission's orders.
    The Supreme Court last week overruled Chevron, what that means now, is that it is Congress, it’s the elected members of Congress that have to make policy decisions that impact the American people, not the armies of bureaucrats who have no democratic accountability. Elected officials don’t always make the best decisions, but it’s better than someone saying the new rules are there and too bad for you!
    Some of the initial rollbacks include the EPA’s rules to cut carbon emissions from power plants as well as regulations to encourage electric vehicles. There are wide-reaching implications for the oil and gas industry because it will make it more difficult for federal agencies to regulate the industry based on their interpretation of ambiguous laws.
    EV regulations are facing massive changes or removal, following this ruling. These regulations could face challenges that might reach the Supreme Court as soon as this Fall. The Environmental Protection Agency (EPA)’s power plant regulations and broader climate regulations also stand on shaky ground. This shift could significantly impact the push for greener energy solutions in the United States.
    The Biden Administration’s strict tailpipe emissions standard has become vulnerable. They have had success watering down EPA tailpipe emissions rules in the past and some of their challenges are still pending and could be subject to the Supreme Court's Chevron decision.
    A 26 state coalition filed a legal challenge in the U.S. Sixth Circuit Court of Appeals against the National Highway Traffic Safety Administration (NHTSA) to block the agency’s new fuel economy requirements for passenger cars and light trucks, which the agency had finalized on June 7th.
    Could this be the end of the electric vehicle mandate? The Supreme Court ruling certainly opens the doors for the mandate to be dropped. We are not there yet, we will keep you posted as this unfolds. Subscribe and follow so you don’t miss the updates.

      When did we have a free market? I watched Bush live, telling us that we were going to have a consumer economy, and to just get used to it! This was while America was hemorrhaging it's industry and those that decided our economy are the ones profiting. Free market is and has been a fantasy.

      I don’t fully agree. I don’t think we necessarily need *less* regulation, because good/appropriate regulations protect people from getting screwed/hurt in some way by companies and corporations (for example). However, we do need *appropriate* regulations, because by the same token, bad/inappropriate regulations can be used by unfair or corrupt bureaucracies to harm people or treat certain groups unfairly compared to other groups.

      Commiefornia Democrat rulers passed the EV mandate. That mandate then became law in every state who passed laws tying their rules to CA. MD did this DUI the rulers don't have to take responsibility for the mandate. The MGA will never repeal thre tie to CA.

      Oh but, in California if the people are called upon to vote out an EV mandate, and such a vote actually happened, the proponents of the EV mandate would quickly rush to a superior state court, with a favorable judge, and block the election results on some technical grounds. That's how the party that worries about "democracy" actually shows you how much they care what the people do with their vote. That's Newsom's and Pelosi's party!

They are not only much more environmentally friendly and sustainable, they save 70 percent energy compared to an ICE car, this alone would end the discussion, despite there are lots of more reasons why EVs are great and definitely the future, while ICE cars will go the steam engine way... into the museum.

      EVs have their place, and if a person want to buy them that's great, but it's definitely not the right choice for every person, every task, or every area. I think that's the big issue people have with an EV mandate is they want a choice.

      Our house was destroyed in 2021 by a fire. We got out in time but watched as a bedroom window exploded and melted down the side of the house because of the small battery in a laptop. Never parked my hybrid in the garage again after that. Can’t even imagine what it would look like if a battery as big as an ev was burning. Not even a comparison to a regular car fire. Regular cars do not usually spontaneously catch fire parked and shut off in a garage at night either.

    If an EV suits someones use case , by all means they have the choice , EVs currently are in many cases not a good replacement for internal combustion engined vehicle , and this is fact.
    EVs by their very design as soon as you take them out of their ideal operating environment, their many handicaps come to the surface .

      What about the massive subsidies given to fossil fuel companies. Fossil fuel companies last year received 20 billion dollars explicit subsidy and an implicit subsidy of 660 billion dollars. In US 50,000 sq miles of agricultural land is used to grow corn to make ethanol to be blended with gasoline only, not diesel. Huge subsidies are given to grow this corn, and subsidies to refineries to extract ethanol out of corn. What a total waste of tax payers money. This useless subsidy is given yearly for multiple decades. If you remove these subsides given to fossil fuels, I am ok to remove subsidies given to EVs. Because of these subsidies gasoline price is kept artificially low, otherwise gasoline would cost 6 dollars a gallon.

      @@johng4093 in US, nuclear and renewables provide 40% of electricity, coal 16% and rest natural gas. Not much coming from petrol or diesel. Stop the subsidy on fossil fuel, then you will know the real cost of gasoline and diesel. This will help people to move to renewables. If cost of electricity from natural gas goes up, people will move to renewables. Almost 80-90% of new power plants are coming from renewables as they are much cheaper. Fossil fuel subsidies are enormous and they are being give out every year for the last 60 years, and they must be stopped. Few years from now EVs will be cheaper than equivalent ICE cars,maven without rebates.

    I'm not against electric vehicles, but there's no way they should be mandated. Currently, the battery limitations and power grid capacity are problems that will need to be solved before EVs are viable.

For perspective, I can buy 7.5KW of solar panels, for $1250, for the racking wire, and inverter we can round it up to $2500. It's hilariously cheap, and 7.5kw hours is hilariously overkill for most homes. However, you need batteries to make solar actually useful, and when we add decent battery capacity into the equation, suddenly the price jumps to $7500-$10k in just materials alone

They are fabulous small trucks, reliable, low maintenance, and almost no repairs needed. Before the 1979 Toyota, I bought a new 1980 Mustang and had NOTHING but trouble with it - so glad I traded it in on that Toyota!

    No electric car will ever sully my driveway. They're not only bad for the environment, they're downright dangerous; a faulty battery can go up in unquenchable flames very quickly. They're also unsuited to the average driver, since the only thing that lives up to their ads is their insanely high acceleration, but they don't go far and they always need charging. Which isn't at all easy or convenient, as the unlucky buyers of EVs have found to their sorrow. Besides, the electric grid struggles just to provide power to businesses & homes, there's nothing left over to charge EVs!

      They have their place. They’re REALLY fast, silent and offer the convenience of skipping the gas station. I just drove the Ford f150 ev. 0-60 in 3. Not good for the full country set, or oil field rough work. But for contractors in town it’s not the worst choice.more cargo space that a comparable truck.

      I won’t say that I never will, I just know I will not until it makes far more sense. When I can get 5-700 miles on a charge and charge in less than a few hours I will gladly buy. Right now for my lifestyle an EV makes NO sense, I would get stranded far too often.

      @Jayce-147 there are still some V8 powered cars left Cadillac Blackwing super sedans Mercedes Benz S Class & SL roadster/cabriolet Lexus LC and LS etc. though the base engine in a Lexus LS is 3.5 L or 215 Cubic in V6 sure when I was younger you could get a V6 in a Chevrolet Impala or Mercury Grand Marquis though most people opted for the V8 engine options that were available from a 5 L 305 to 6.9 L 425 the most common V8 was a 5.7 L or 350 cubic in depending on which trim level you got and what options you chose such as Sun Roof bench seat/bucket seats in the front tinted windows etc.

      @@asajayunknown6290 Yes! Simplicity and reliability. Most automakers are being forced into turbo charging engines to meet the emissions mandates. Turbos are notably less reliable with a shorter engine life. I've owned turbos and I like them... but don't force them on people. Same for EV's.

    I get more than 34.5 miles per gallon with all my vehicles. 36+ mpg in my car and both my motorcycles get well over 45 mpg. I will NOT buy an electric vehicle built with today's technology. The range, charging times and battery longevity all need major improvement.

      @Cttechexpress The sure as hell do. They have limited range. I love watching electric car owners waiting in line at Target to get enough juice to make it home. Gas cars don't combust in your garage and burn your house down. Driving across the country is no problem in a gas-powered car. When the batteries go bad on an electric car it becomes virtually worthless because the battery packs are unaffordable. The batteries are known for failing to start a car when it's freezing. They put a strain on the power grid because the grid can't handle it. California is now asking owners to stagger their charging schedule, lol. How can you be so ignorant?

Anyone who actually owns one could tell you these things, along with how they're vastly cheaper to operate, practically maintenance free, tons of storage space and features impossible with an ICE car, recording all around the car at all times, fully autonomous driving capability, the safest vehicles in the world... the list of reasons they're better go on and on.

    Our representatives have been using this doctrine to avoid accountability for bad outcomes the public doesn’t like. “That was that agency - not me. Re-elect me & I’ll fix it!” Both parties play this game. Also, our Reps know big government know-it-alls run these agencies.

    When I was looking at the Chevron decision my first thought was the members of Congress (both House and Senate) must be terrified that they might have to do some real work exercising due diligence in looking deeper into these items to fill in details they previously let the President's staff take care of. Where will they find time to campaign and raise money for the next election cycle?

    Hertz did an outstanding job of making sure I'm never convinced to buy an EV... At least, not without massive improvements to battery technology, energy production, and fast charging capacity. They gave us a non Tesla EV as a rental, which wasn't charged when we got it, was incompatible with fast charging stations, and spent 30 hours on other charging stations during the 5 days we had the car. Also, a 220 mile range is a joke as a rental! I'll stick with my wholly owned Prius V!

    Well, that's one way for rulemakers and legislators to get out of the corner they have painted themselves into. Yes, I think EV mandates are government overreach AND also morally questionable (strip mining in third-world countries etc) plus not fit for the stated purpose of "saving the planet".

    Free markets set the rules.
    Congress doesn't make policy - they make LAW.
    If EV's are going to be the lion share of the market - it should be because they out-perform petrol vehicles and people want them.

      There is no free market when conglomerates control industries. In Europe, you can have 40 companies in mobile or internet to choose from. What do we have here? Five or six.
      We’ve been here before and each time there are conglomerates, our economy goes down the sewer. Reference the Great Depression started when Hoover, a free marketer was president and took away controls on banks and corporations.
      Europe learned its lesson a hundred years ago when fascism destroyed the world. They now heavily regulate banks, corporations, have strong unions, universal health care, free education to stay competitive, and a strong sense of the common welfare of their people. Why do you think the right wingers got voted out in England and France. Brexit is one good example, a history of right wing fascism is another.

    I love EVs. I own a Tesla myself, but I don’t think they should be forced onto people. We should have the freedom to buy what we want.

      Why do so many people speak of EVs being _mandated?_ The agencies were only phasing in limits on pollution levels that control the kind of vehicles that can NOT be sold. If automakers can make practical compressed-air powered vehicles, or wind-up-rubberband vehicles that stay below the prescribed limits, great!
      If you want to say, "but since everyone _knows_ that electric vehicles are the only practical way to meet the required emission limits, the regulations are indeed mandates", my answer would be, "about time you acknowledged that." Stop belaboring the indignation over government interference, and address the question of whether or not failing to curb the pollution will incur massive costs.

      @@Michael-jx9bh What I _know_ is that while petroleum-fueled ICE is far, far into the "diminishing returns" end of its development as far as emissions go, electrical generation is rapidly becoming cleaner. And even if EVs _didn't_ pollute less overall, why wouldn't a mere relocation of the pollution away from the bulk population still be a good thing?

      @@bobbybishop5662 in a scale of a car or two, yes. Thousands of cars & trucks the cost gets passed on to consumers if a corporation and tax payers if a government fleet. Service providers like myself spend time chasing tpms and emissions fault codes and that is resources not spent on maintaining meaningful repairs not dead watch batteries.

    The vote of the people manifests through having better choices. If an EV is a better product for someone's needs then I'm sure they'll buy it. Right now the majority of EVs are lifestyle vehicles costing far more in their production carbon footprint, and actual cost to buy.

    The various agencies have been filled with ideologs who are unable to think through what their regulations would actually do. We've had mandates to close power plants across the nation, stop energy production and build unreliable and unsustainable 'alternative' energy systems. The alternative systems have a large list of detrimental impacts that come with them but those are ignored. They block hydro and nuclear power facilities so meeting existing power demands becomes tenuous never mind meeting future demands. Then they demand switching to electric vehicles without the infrastructure to support their use. Then they want houses to switch to all electric systems too....and which bag of magic fairy dust will they use to accommodate that increased demand in electricity!?

    It is normal for a government to mandate things regarding many things… but the cost, the practicality and the impact on people needed to be considered carefully. They shouldn’t shove it down our throats. They aren’t even considering the folks that live in rural areas, in the interior of the country.
