    Like your videos as always. First, a law enforcement officer has to be specifically certified to do commercial vehicle safety inspections and must carry proof at all times to present to you if requested. When a law enforcement officer stops a commercial vehicle for a safety inspection he doesn't need probable cause. In the process of doing the inspection they can only enter through the drivers door and sit in drivers seat and can go no further. If they see or smell something out of the ordinary that justifies probable cause, they can search without consent. If they don't have probable cause they can ask you for permission. You don't have to comply. If you have a co-driver in sleeper he can't disturb them without a search warrant. He can ask the other driver to, but they don't have to comply. Just say no, then ask if they are detaining you. They must say yes or no. If It's no, you can legally just drive away. You don't need there permission at this point. I know this long winded, but I hope this helps. I've been through this a dozen times or more, being a small trucking company fleet owner. Good luck

      Wrong! A Level One inspection does not allow them to search your truck! A search can only take place when you are suspected of a crime. My brother is a DOT Training Officer and he said this was an illegal search!

    Law enforcement officers have a hard job. I always talk to them with respect and they've always treated me with respect.

      phillijp , actually if you give him permission to search the truck whatever he find will be legally admissible in court and he can plant whatever he want and say found it in your truck and it will be admissible because the Search is with your consent.

      If you consent, or don’t…it won’t matter if the cop is dirty. So, if you’re law abiding with nothing to hide, just say yes. It’s easier. Trust me

    My daughter and I ran team together in 18 wheeler and picked up a sealed trailer full of picture frames in OtaMesa CA going to NJ. We're stopped in Texas on 40 and asked to inspect our load. We called out dispatcher because we knew the receiver would want to insure the deal was not broken. Was told to let them inspect if they agreed to sign a paper stating they were the one who removed the seal and noted the our seal number we would use. Also that they were responsible for any damage they did to the load. The officers hesitated but said if we refused they would conficate the trailer, but for us to write up a paper for them to sign which they did sign. So they search is on the side of the road one of the officers with a drug dog up inside the trailer walking all over the picture frames which were not in boxes just film wrapped. Took 2 hours on an expedited load. We kept our cool and prayed that the receiver would not reject the load. Delivered on time and explained to receiver who copied the papers and sent us on our way without a problem. Never heard if any of the load was damaged or not

    You guys did the right thing. I started trucking in 1971 an things weren't that stupid then although there were a few states that would aggravate you a bit. Im glad im retired although I do miss trucking after 47 yrs. The type of people being hired as "super troopers" not all of them are like that but a few are an should be reported although it might not be safe to travel in that state after you do that. Anyway you did the right thing. He could have gotten completely postal an kept you for days. Good job guy's, good luck.

    BORDER PATROL here in San Diego walked a disinterested dog around my rig....Agent then took a tennis ball from his pocket , bounced it from the body panels and THIS caused the dog to bark in excitement ! "Sir , the dog alerted on your rig! Please pull over to secondary for a search."

    During my Trucking days this experience hits the cake: I was leaving my home in Indianapolis to head for Cleveland. I was traveling north on I-71 out of Columbus going to the Weigh Station in a Straight Truck (company brand new 24ft flatbed). As I was going across, I was instructed to pull over to be Inspected,no problem. The Inspection went good until he noticed the way I had my shoes tied. My wife bought me some Air Jordan and I wore them that day just to break them in. That DOT Officer had the dumb nerve to say:"You shoe is tied in a unsafe position!" So I had to give him a Basketball 🏀 education telling him,"In case you don't notice that these are Air Jordan which I'm sure you heard of Micheal Jordan #23, Chicago Bulls! Since Indiana is a basketball 🏀 state like Ohio is to football 🏈 this is the way a lot of Indiana truckers wear their tennis shoes as long as it's safe well enough it won't inpeed the drivers safe operation of the vehicle. Now can show me in the Dot book that it a particular way to toe your shoes? I'm not wearing slippers you know." That Officer knew I got him and I know the rules. I made him feel like that fat Sergeant on the Zorro series when Zorro whips a "Z" on his fat belly! I made him feel like Sergeant Shultz on Hogan Heroes being stupid. He didn't like it but he knew the Fact that I knew the Law. He said since I cooperated he had no choice but to let me go. I zoomed out that Weigh Station like I was driving for Team Penske out of the Pit Stop! Got a good laugh all the way to Cleveland 😂😊.

    A commercial vehicle does not require probable cause to stop, nor search. They can do basically what they want to check compliance. It's a commercial vehicle first, then our house.

    I’ve deadheaded between TX and Colorado several times and have never been pulled over, let alone searched. Sorry that happened.

    i ran a strait truck (international 4400 with a 32' box equipped with a mother-in-law attic) for North American Van lines for 2 years. being based in orlando Fl I always had issues with georgia and alabama d.o.t. . "we know about you florida boys" as they turned drug dogs loose in the cab/sleeper. hell, even had one ask me at the southern scale on I-75 just north of florida border when was the last time i had a beer. told him 12-13 days. he replied " I smell alcohol" as he proceeded to climb in and tear the cab apart.
    even with a florida plate i would constantly get stopped by d.o.t. on I-10 in the Panhandle area...
    in the 17-18 stops by d.o.t. i had in 2 years, i never gave them any problems, well , after i learned to keep all my papers and license in a folder on the dash by my logbook-no fishing for documents that way.
    never met a dot man/woman that wasnt nice to me after i was cleared of any contraband and passed their level 1 or 2 inspections...but until they know you are clean and in order, they can be real aggressive.
    as a payback to them, i kept a laundry bag of old socks dripped with tuna fish juice from the can. when i get stopped-open her up so they can enjoy the scent.
    now i am in the process of getting a high roof Sprinter and i will see how they are treated by the law as i hot shot expedite in a less than 10,000 pound vehicle.

    Very sensible debriefing. I'm a driver now. Fmr LEO. Probable cause is important. You invited him. You had nothing to hide.
    Personally when a dot or LEO becomes impolite you don't have to tolerate it. Sounds like you already have a sense how to de-escalate it. Good for you.
    I used to teach you'll get more bees with honey.
    Depending on state laws, you can end a visitation. At least in Canada. But if he finds anything, pandora's box will open.
    Love your vlog. I learn so much this youtube stuff as a newbie driver.
    I hope that gave something back.
    Be polite, respectful. A smile will get you anywhere. A bad attitude will only heighten an officer's determinism to dig more.
    Next time if you invite and he's not polite, end the 'visitation'.

    My wife and I were pulled over in Tennessee. We declined the search. They brought up the drug dog. Had him jumping in and out of the truck. The k9 cop said his dog had alerted. We told him that was bullshit. I asked the original cop what he thought we had. He replied " large amounts of Marijuana ". We laughed, and permitted him to only open our bags, but not remove contents. We were out of there minutes later with an apology from the original officer. The k9 cop was wicked pissed and obviously not of sound mind. Lucky for us the first cop controlled him. I wouldn`t have put it past that k9 cop to plant stuff. He really wanted us to be outlaws even though we were completely legal. This was about 20 years ago.

    I once in Kentucky had a cop ask to search after doing his inspection and i said no he then asked if he could get a chew off me because he saw me put tobacco in my mouth i said no prob.he shook my hand said thanks and handed me my papers and told me to be safe and that it was not often he found a swift driver in full compliance

    The thing is nothing to hide is not a reason to let them search.. Its rare, but its possible that something can be planted.. I wish I could say I trust officers but the bad ones have made me very dubious of any search.. Gung Ho, is dangerous, and some police consider themselves a law unto themselves. Admittedly it might be easier, but there are cultural and even racial differences that makes this very scary for some of us.

    You guys did the right thing by letting him search. When I was driving I was hauling a load of Hazmat and got flagged at a scale and told to bring in my paperwork. I found out later the only reason they stopped me was because of the Hazmat. They came out and did a walk around checking all light and tires. I even had to break the seal so they could look inside. They were checking that the load was contained, but I knew it went all the way to the back of the trailer, so there was no place to place a strap. They put one of their seals back on and I went on my merry way. A first for me. Stay safe.

      Marvin Elder Thank you Marvin. My very first inspection was when I was hauling Hazmat too. A load of paint & the officer told me the same thing they pulled me in cause of the hazmat. We've even had officers tell us they've pulled us in for an inspection cause we are easier with our smaller truck :)

    Personally, I would have refused the search, I have before. Would it have made things "easier"? It's hard to say. I've refused searches before, some get a little salty some simply just say "okay". For me it's a matter of principle. I'm not going to let them (police) do whatever they want just because they have a tin badge and gun. You have rights. Use them or lose them.
    I understand where you're coming from tho. 😉

      Echo Foxtrot Regular inspection of the DOT vehicle is for road worthyness according to the laws/requirments. With that said, a truck search in the cabin can be refused and you can legally say "only with a court order" or simply "no" to not esclate the issue. The video you watched of that other idiot was wrong as an inspection is a requirment.

      Never consent....if they search without consent and possibly find something or plant something during an unlawful search. That could be surpressed in court. But if you consent a corrupt cop could plant evidence in your truck and that would be admissible in court. For your safety and protection never waive any of your Constitutionally protected Rights.
      Also, record with multiple cameras. Get as many cameras recording as you can for every law enforcement encounter you have. Get a live stream app on your phones and live stream to the internet so the cops can't sieze your cameras and erase any damaging footage. If you wait until something happens to you, you will have waited to long. Do it now.

    Since Colorado's leave Mary Jane law passed,even my state of Nebraska pulled me over coming out of Colorado. I know one of the state patrol guys that did stop me, and he said that he had to check vehicles for a month because of Colorado's goofy laws they passed. I am driving a Mercedes Sprinter Eterk from Roadtrek that is a 4x4 Class B van 3500 series dually single axle. I went to a antique gun auction with my FFL license and they checked the van found the guns, I showed them my FFL and the let me go home to Omaha, Nebraska.

    I got pulled over in my private vehicle, in the Charlotte area for expired tag and inspection. The officer, CMPD told me he was training and she noticed the tag. He continued, that he'd have probably not pulled me over or if he wasn't with a trainee, just given a verbal warning. Always better dealing with a single experienced officer.

    I once drove OTR for a company that told all of their drivers that we did not have to consent to a search without a warrant. It was up to the driver and it didn't matter if it was a hot load.

    Don't listen to these guys who say that it was good that you let him search. Don't say, "I have nothing to hide," unless you're ok with someone you do not know having the opportunity to tear your truck apart, taking panels off, or plant crap. Also, you don't know if the previous driver left something hidden.
    Cover your ass. Nothing to hide, everything to protect. Remember "Sorry officer, I don't consent to searches." It is not your business to make his day easier. And if you don't know your rights, you don't have any, because cops won't tell you.

    I bought a used car (convertible) years ago and months after owning the car I found drug paraphernalia hidden in the headliner. That scared the crap out of me because at that time I would have consented to a search because I had nothing to hide.

    I've only been asked once. My response was I don't give consent but I won't stop you from performing your duties. He nodded, finished his paperwork inspection and let me go. I too had nothing to worry about

    When asking if they can search your vehicle. You can ask, am I being accused of a crime? Am I being detained? Am I free to go? Put the questions on them. If your not being accused of a crime then be on your way. And in future tell the officer you are recording their interaction with you for legal purposes if the need arises. That way they will be by the book.

    You did what you thought was right at the time. Just some information for future reference. If you give verbal or written consent for a search you may withdraw that consent at any time during the search. If a K-9 is used to search your vehicle. The dog has to alert on the outside of the vehicle to give the officer probable cause to enter the vehicle. If you have your camera record this. Some handlers will cause the dog to alert on the outside to create their probable cause for entering the vehicle. The video can be viewed by an experienced handler to determine if the dog has falsely alerted for this reason. Always remember there are bad ones every where you go. You were profiled!

    It’s not “probable cause” it’s reasonable suspicion. Probable cause is to arrest you. Reasonable suspicion is the term used to search a vehicle.

    As a tour coach driver I have been searched many times. On one trip departing Reno we notified the passengers that we were going to be searched at the next rest area. We advised these young people to put whatever drugs they had in the trash cans placed around our buses. The youth were told that drugs placed in these trash cans would NOT incur any legal ramifications. At the rest area we were searched. Nearly 50% of the youth on board were arrested. For some reason they did NOT believe us when we told them we had been ordered to pull into the rest area to be searched. These youth had vandalized the Reno Hilton causing thousands of dollars in damage. Drugs are a major problem.

    You mentioned Canada customs and you're talking about searches and that made me remember my best ever encounter with the customs revenue collectors. I was returning to Canada through a port in BC after being in the States for 3 or 4 days. When you are gone that long they expect you to buy some duty free but that trip I didn't because I still had half a roll of Skoal left over that I had purchased in Canada. When I get up to customs they get their back up when I say I didn't buy anything so they wanted to search the truck. The officer that did the search wasn't much more than 5 foot tall, about 50 ish years old, and a woman. She goes through the truck and comes out with half a roll of Skoal waving it in my face saying "I thought you said you didn't buy anything". I replied I bought it in Calgary and she asked if I could prove it. Now I'm thinking it's not really up to me to prove I did, it's up to her to prove I didn't but all I did was point at the "Canada tax stamp" on all the cans. She looks at it, turns around in a huff and walks away without a word. I wait for a minute or so to see if she's coming back and since I've already got my customs stamp I got in the truck and left.

    Anytime you, particularly as a commercial vehicle driver, are stopped by leo's, always record audio and video, and do not agree to searches. And if you feel your rights are being violated, call 911 and report illegal activity. Thanks.

    It’s funny cause everything you said is the same I went through. I got stopped outside Reno when I was deadheading cause I sat so long got stopped it was a rookie officer did a complete level 1 then asked to search. I allowed cause I agree I have nothing to hide they searched everywhere even had a stethoscope and would hit the tires and listening make sure nothing was inside them. Held me up for hours. It’s only happened once in 8 years and I think what caused the initial stop was no tag on the back of the truck. That issue gets us stopped a lot cause officers think you should have a tag but depending on what state you are reregistered in determines where your tag goes either on the front or back of the vehicle. Again I agree with you it’s easier to just let it happen and be on your way. 😊

    Just an FYI..He can not detain you any longer then the initial stop to "Wait " for a K9. as soon as he said i'll just wait for a Dog you point out that the supreme court ruled on this issue and said they can't hold you..if he was a new officer he needed to be taught the rules.. but that was your call.

      That will get you into trouble. It was not a clear ruling and only sent the case back to the lower court. It would only apply absent any other suspicion. In this case the "unusual " dead-heading from Colorado would probably suffice.

    You guys need to learn the laws and polite ways to respond. Any time you let a LEO search, you risk a whole slew of problems. They can plant things. They can misidentify things. The DOT stop was completed and ended the legal reason for the stop. After that, it was a bully violation of Utah v Strieff. There was no probable cause. They did not stop you for a violation of any kind.
    Did you kiss his backside when he climbed into your truck. This is a battle you should have picked.
    You to Officer: You have given us the DOT sticker so is your DOT inspection stop complete?
    [Yes]
    Did you also stop us for a moving violation?
    [No]
    During your DOT inspection, did you see anything that gives you reasonable suspicion or probable cause to detain us further?
    [No]
    Are we being detained?
    [No}
    Then we would like to be on our way.
    [yes, you are being detained]
    What is you reasonable suspicion? (vague or non-specific suspicion is not a probable cause, reasonable suspicion relates to a specific crime)
    [You are coming from a marijuana state and we are doing increased enforcement]
    That is not reasonable suspicion.
    Turn you phone on record and record the interaction with the cop. If the officer objects, say something like “Officer, I’m not interfering. I’m asserting my First Amendment rights. You’re being documented and recorded offsite.” The courts are on your side.
    It is not the citizens job to deescalate the cop with a bur in his britches.
    Utah v Strieff, Terry v Ohio, Brown v Texas, Hiibel v 6th District, Rodriguez v United States, Carroll v United States

    When you have two cops together they will always have one acting as cover officer and one as the contact officer that is standard practice.

    I am an ex-cop and Owner Operator. ALWAYS ALWAYS ALWAYS ALWAYS ALWAYS ALWAYS refuse their request to search your truck. You have NOTHING to gain from it. It doesn't matter how nice he is and what excuses he comes up with, you have nothing to gain from it. There is no "good job" sticker or note he can put on your file, and there is no bonus for him wasting your time. If they are asking permission then say no. If you can record it, record it. If you know its been 15 minutes then ask him if you are being detained and he has to say yes or no. If its no, then its time to hit the road. If you give them enough slack they will destroy your delivery time and possibly even put you in a bind, something you can not get him or his department to pay for later. Simply refuse. Not to mention he could have planted anything he wanted in your truck. The idea that cops are never going to screw you over is disproved on a daily bases. He doesn't even have to know what he is looking at, he can just "think" its bad and he is legally allowed to screw your world over. This advice is coming from ex-law enforcement.... ALWAYS SAY NO!!! NEVER let them out of your sight. Never give them unlimited access. Always record every single thing you can and if they ask why you are recording tell them the same crap they tell the public constantly, "If you have nothing to hide you wouldn't mind being recorded."

    you guys did the exact right thing you should have done, People don't realize when you are hauling on public roads for commerce your rights are out the window, technically its not a private vehicle, you have some rights but not as much as you would in your car. besides you guys are as pure as the driven snow. Years ago horse hauler's were getting busted putting bails of pot in with the other hay bails. I have never been searched.

    I was searched in new Mexico, accusing me of doing drugs.., i had to sign a waiver, for his drug dog to get in my truck and search , very rude officer, very mean..
    But found nothing

      No you don't. Federal law supersedes state and local laws, and the federal law is based on the Constitution . While driving is a privilege your rights are not. Don't believe me, check with the local office ACLU. who are pretty up to date on that sort of stuff.

    You guys did good. I would post his name and call or asked for his Supervisor. I respect the police department. I am a former military Veteran. Plus I have a lawyer on retainer. I have only had one cop ask to see my ELD unit. I had no problem with that. Good work.

    I’m not letting any cop search my truck. It’s my personal home when I’m on the road. My dogs will be in it. They are huge and it could cause a potential problem with any harmed officer. I will never consent to a search of my personal cab of the truck. If they insist then they will get a warrant.

    He had no legal right to search your truck. No probable cause or reasonable suspicion, exercise your Fourth Amendment rights. Do not comply with illegal demands and or requests and refuse to answer same questions. Request a Spvr and file a complaint against the ofcr(s).

    They can not search it if you say no unless they go and get a search warrant just a fyi. Also you can let them search only in place you say they can if you do allow them to search it

    I was stopped at Night in a small town buy a Sheriff Deputy and a highway patrol. He used a made-up reason to stop me. He seemed more interested in what was in the truck and less of my license and log book. Like you I thought I had nothing to hide. I am doing a d o t inspection a personal pat down and a K-9 search of vehicle. Numerous of related and unrelated questions. After hour and 30 minutes their search turned up nothing. This was clearly abuse of power. I asked my supervisor to never send me to this dedicated stop again.

    The Search dance goes like this: "May we search your vehicle?" If you say yes, they search. If you say no, they get a drug dog. Then the k-9 officer says the sniffer dog has "alerted" to some drugs or something. Then, the officer has probable cause to search. The end result is simple. If they want to search you vehicle, thats what they are going to do. You may as well capitulate...

    That is interesting. Those trucks are not known for any kind of gas mileage, even if empty. What was your dead-head fuel bill anyway? My guess is it was at least $1500, and are they paying you for dead heading?

    Co driver should have been in the sleeper behind closed curtains, the officers are not allowed to disturb the sleeping driver and the sleeper is an extension of your home... am I right or wrong??

      Tall Trucker I was up front when he pulled us over cause I was still on my 2 hrs of off duty. If I would have been in the sleeper I don't believe they could have made me get out to search though.

      It's your home. Get a warrant. Inspect the mechanics of the truck, and trailer. Ask to see my logs, but get a warrant to search my home.

    If you had said no he could not have held you to bring in a drug dog as he would have been in violation of a SCOTUS ruling. The main reason would be he could have planted something.

    in New Jersey if it's a commercial vehicle you can't say no they're subject to inspection and search they have signs posted when you enter the state welcome to the People's Republic of New Jersey

    The "we have nothing to hide" thought can put you in a very dangerous position where you voluntarily agree to give up your rights; rights that were developed because of historical overreach by the authorities. It is NEVER, EVER a good idea to agree to a search be that work or personal vehicle. Glad it worked out for you both this time.

    Great video followup. Great channel. Subscribed. --- If it were me, I'd probably let them search, but not before activating at least two GoPros inside the cab to protect myself. If they refuse to have the search video'd... Houston, we have a problem. They should roll with K-9 units as a matter of procedure. Hounds can sniff the exterior and signal if drugs are inside. No signal, no search necessary. --- I'm all for law enforcement, but they are not immune to corruption. When they do find drugs in a vehicle (any vehicle)... don't they confiscate the conveyance? I'm thinking they do. A nice tractor, like yours, would bring a pretty penny at auction for them. --- Always CYA

    DOT did a inside search both times in Mississippi on Hwy 72 ... I do have a .45 behind the driver seat with the clip loaded not chambered that he never could find.. lol But you have to tell them you have one before the search. He said he was looking for bags of money or drugs, well knowing I have neither I said sure go ahead but if you find bags of money Id be really happy

      You have the right to bear arms , just let them know you have one.. It was a Springfield 1911 the officer had been wanting one but couldn't find it in the search,, lol Prostar in the pocket behind the seat, I showed it to him after the inspection.

    Hi there from down under Australia yes we have the same problems here with police and weigh bridge officers all think trucker or truckie's as we are called here all think we are drug runners and addict's and outlaws and you have to prove you trying to do the right thing that your a worker trying to do an honest job in a corrupt system you never win and it never change your public enemy number 1.

    My Quistion is, did you by chance ask the DOT officer.if you could search his vehicle. And if you did how did he respond??? It is always good to treat people the way you want to be treated and cops no exception

    Seems there are a lot of professional truck drivers who watch this channel , I would say there must be 1000 years of experience out there. Not crossing international boarders of course, Since almost every state requires cars and trucks to be inspected annually , what law says you must submit to another inspection ? I am 100% sure there are none, and this is just a case of police making up laws, A job "we the people" elected lawmakers to do. PLEASE any local state or federal laws would be helpful, I am not trying to prove myself right, I would truly like to know..

    The same week you were in Colorado so were we! Fort Collins for the fat tire Festival! That's when I reached out to y'all by the way thanks for all the information being that I lived in new mexico for 7 year I do know that Colorado passed a law that you cannot buy weed or smoke it with an out of state license so there was no probable cause but glad you did the right thing knock on wood since I've been on the rd with my babe he has never had a dot inspection fingers crossed that we never do because I know they can be miserable hope to see you soon on the rd he just applied for landstar and hope to be signed on soon just look for the purple star car expediter!

    I have a problem with this. They should have some reason . The trailer is ok, If they smelled something . They still need a judge to say yes. Giving up your rights is not good. Say little and ask why. 🇺🇸🇱🇷
