    Namatay ang may-1993
    Meaning illegal po pagka sangla ..
    Ask. Po atty.
    Panu kami makakuha ng bago copy ng tittle
    At panu ma cancel ang annotation..

    Hello po, di ko po napa-cancel yung annotation ng “exemption to article 567 (b) and (c) of civil code”, pero nakapagsubmit po kami petition for cancellation nung annotation ng sec 4 rule 74 at yun lang po yung na-cancel sa new title.
    Need pa po ba magsubmit kami another petition?

    good eve po Atty...clarification lang po, yung friend ko is nakabili ng lupa na may Annotation under sec 4 rule 74 of rules of court. date of Entry po was June 16, 2020..Since meron napong Deed of Absolute Sale, nabayaran na rin po ang CGT,DST and Transfer Tax, pwede na po bang yung friend ko na ang magpagawa ng Petition for Cancellation of Encumbrance under sec 4 rule 74 of rules of court? appreciate your feedback po Atty.thank you.

    Please help me. Ano po ba ang dapat kong gawin?
    Ask ko lang po ang proseso kapag walang TD ang inherited TCT.
    Yan din po ang nakalagay sa naunang TCT bago po mailipat sa pangalan ko.
    Eto po ang nakasulat sa page 2 ng TCT ko under "Memorandum of Encumbrances"
    Memorandum:
    The registered owner must within two (2) years from the date of reconstitution (Jan. 16, 1996) file a plan & technical description (TD) of such land with the Administrator LRA pursuant to Sec. 21 of Republic Act no. 26. After the expiration of the period above-mentioned, no transfer certificate of title shall be issued in pursuance of any voluntary instrument until such plan & technical description shall have been files, approved & noted as provided by law.

      @@f00700-bee Check niyo po sa ROD if na comply na yung pinapa submit na plan at technical description. If hindi pa na comply, need niyo po magpasurvey sa mga Geodetic Engineer.

    Good day po Atty. ,salamat po sa info,tanong lang po ako namatay na po yung may-ari ng lupa na naka pangalan sa kanya ang tct,meron siyang ng-iisang anak,single po siya benebenta niya ang lupa at meron deed of donation galing sa kanyang nanay po kasi buhay pa po, at meron memorandum of encumbrances stated that lialibilities under sec 4 rule 74: to creditors,heirs, and other persons unlawfully deprived of participation in the state of the deceased (pangalan po ng magulang ng ama at ina yung nkastate po sa title),as extrajudicially settled for period of two years pursuant to section 4 rule 74 of the rules of court date of instrument: july 10,2013. Safe po ito bilhin if naka state na ganyan? Maraming salamat po.

      @@mariannie9856 yes safe naman po, actually pwede mo ma request na ipacancel yung annotation since 2013 pa na register, madali lang po ipacancel sa Registry of Deeds yan, on the spot macacancel naman agad nila after paying the required fee.

    Good Day po atty. May nakalagay sa title ng lupang na binibili ko na
    :SECTION 4 and 5, RULE 74 OF THE RULES OF COURT WITH RESPECT TO 1/2 ONLY.
    Ipapalagay ko po ba sa Contract To Sell na Dapat Ipaclear muna o kahit ako na po as Buyer ang magclear?

      @@josephordenante1539 depende po sa inyo. Pag sigurista ang buyer, then yes pinalagay na dapat iclear muna ng Seller ung naka annotate before mag full payment. Pero ung Sec 4 and 5 kasi na annotation is just to notify lang ang purpose, so wala namang naghahabol, so hindi siya masyadong cause of worry for the buyers, at madali lang siyang ipa cancel sa Registry of Deeds.

      Kasi need pa nman ng maghahabol na idaan sa korte yung claim nito.

    Mahinahon po ang inyong boses at madali sundan paliwanag niyo ... kaso mayroon po akong tanong .... saan po base ang simula ng two-year period ... Sa aming title naka lagay sa page 3 na ang date of instrument (w/c is EJS) ay Jan 31, 2023 ... pero yung TCT naka lagay "entered at Caloocan City on March 16, 2023" ... Sa Jan 31 o sa March ang start ng two-year period ng aming Section 4 Rule 74 para malaman namin kung kailan mag file kami ng cancellation?

      Sa March 16, 2023, kung kailan po pina-register yung document sa registry of deeds since doon palang sya nag ooperate as notice sa public

    Salamat po sa video nyo Atty., ito po ang hinahanap ko.
    Magkano po lahat-lahat na ang magagasta sa cancellation process?
    Paano nga pala yung TCT ko, walang tech. description, to refer daw sa orig. cert. of title?
    nare-retrieve pa po ba yung OCT, kahit 3nd-4th generation na ako na owner ng TCT po?
    paano po if (my name), married to (name of wife) ang nakasulat sa TCT,
    ganun di po ba ang nakasulat sa petition na gagawin? Salamat po sa sagot.

      @@mit.guy711 more or less nasa around 1-2k po magpa cancel ng annotation sa Registry of Deeds.
      Optional lang po na ilagay yung "married to", kahit name lang po ng registered owner ang ilagay.
      Sa technical description, yung "to refer sa original title" nalang din ang ilagay, or i-copy paste lang kung ano mismo ang nakalagay sa Technical Description ng current title.

      Yung optional po na namean ko is yung sa No.1 po, kahit married lang po ilagay.
      Yung sa No. 2 po yung kung ano po yung makikita sa Title na details, yun po ang ilalagay.

      If na nawaive na po sa inyo yung property, duly notarized naman and duly signed ng proper signatories, then legally kayo na po ang may-ari kahit hindi pa naproprocess yung pagtransfer ng registration.
      So out of tolerance nalang po ninyo yung pagpapatira sa kanila doon. Wala na pong right ang mga kapatid mo doon sa property since na waive na nila in favor sa inyo. Since kayo na po ang owner, kayo lang po ang may right kung ano man ang gusto mong gawin sa property, so pwede mong patirahin or paalisin anytime ang kapatid mo, pwede mo itong ibenta or idonate, kumbaga may free disposable ka na dito.

    Good day Atty, may bibilhin akong lupa pero may incumberance pa sa likod na nasanla sa isang tao noong 1973 pa at nasanla din sa banko mga 1993, pero mother title is cancelled na po lahat, may assurance ba ako kung bibilhin ko iyun? meron na po title ang lupa mga 4 hectares galig sa 50 hectares na mother title.

      If may annotation po na nakasangla, hingi po kayo dapat ng cancellation papers sa seller as proof na fully paid na ang mga loan na naka annotate. If walang maipakita, then depende na po sa inyo as buyer if willing kayong mag take risk bilhin ung property kahit may encumbrance itong nakasanla kahit several decades pa. Kasi if may encumbrance na nakasanla at walang cancellation, may chance na may maghabol sa lupa.

      depende na po yan sa Registry of Deeds kasi need pa i assess yung lot history ng lupa so di ko po masasagot with definite answer. Much better inquire po muna kayo sa ROD para malaman po natin yung response or advice nila regarding sa concern ninyo.

      buhay pa po ang may-ari or yung registered owner na nagpa annotate? May donation po ba? Baka kasi isa ito sa mga conditions imposed ng donor which is allowed by law naman

May bibilihin po kasi akong lupa, may naka annotate po sa TCT niya sa harap na : subject to the provisions of sec. 4 & 5, Rule 74 of the rules of court in the philippines. matagal na po sa kanya ung title dec 2006 pa po na isued , so paso na po ung sec 4 & 5 rule 74 na annotation.. safe na po ba bilihin yun at ipa transfer sa name ko?, or need parin ipa cancel bago ipa transfer sa name ko?

      @@yzhgaming8648 mas maganda po i-pacancel muna especially if sigurista si Buyer, usually within the day macacancel naman po agad nila yan doon sa Registry of Deeds. Madali lang sya i-process.
      Pero ss long as kilala mo po ung Seller at sa tingin mo lahat ng legal heirs ay nakapirma naman at cgurado po kayong walang maghahabol na relative, then yes, safe naman po bilhin kahit may ganyang annotation.

      Depende po sa kontrata ninyo. Pero generally pwede naman po ninyo ma cancel. Then nakadepende na sa kontrata ninyo regarding sa penalty or cancellation fee at sa refund.

    Magandang araw po attorney tanong ko lng po ano po dapat gawin kasi po yung nabili po akong lupa extrajudicial po ang prob ko may encumbrance po sa likod nakasanla po kasi dati ang lupa matagal nang panahon ang kaso po sarado na ang banko at nung nag email ako pdic wla po kasigoraduhan kung mkakakuha po ako ng releasing of mortgage certificate pwde po kaya e petition for cancellation nalang sa registry of deeds pina process po kasi nmen DAR hiningian kme cancellation ng mortgage dipo nmen mapasa dahil hinintay pa nmen yung sa pdic lagi lng sagot nila for verification pa daw po.

      dapat po personal po kayong mag file at process doon sa PDIC. Wala po ibang way na ma cancel ang annotation kundi dadaaan at dadaan po talaga sa PDIC.

    or kailangan pa hintayin yung 2years bago ma transfer sa buyer yung title?

      yes po pero ma cacarry over po yung annotation if ever ipatransfer ung titulo sa buyer ng hindi pa naglalapse yung 2 year period. Buy at your own risk sa part ng buyer. Hindi na siya considered as buyer in good faith if ever may maghabol na ibang tao sa property.

    Atty. san po ba magstart mag count for 2 years? Sa Date of Entry po ba or Date of Instrument kapag may naka annotate na section 4 rule 74?
    Aug 2022 po kasi ang Date of Entry pero ang Date of Instrument naman po ay Oct 2021 nakapagapagawa na po kasi kami sa abogado pero nung pinasa na po namin sa ROD ayaw naman pong tanggapin, di pa daw po lapsed ang 2 yrs ano po kaya ang tama? thanks po

      From the time of registration po which is the date of entry. Reason po ng court is third persons are only deemed to have been constructively notified of the extrajudicial settlement by reason of its registration and annotation in the certificate of title over the subject lot as ruled in the case of PEZA vs. Hon. Fernandez (GR: 138971)

      after 2 years pa po pwede ipacancel yung annotation from the time it was annotated.

    Pag tapos na yung 2 yrs di na po ba makakapreklamo ang mga encumbrances?

      Yung mga nag take part lang po sa extrajudicial proceedings at may knowledge sa death ng decedent ang hindi pwedeng magreklamo after mag lapse ang 2 years.
      But the rule does not apply to third persons not parties thereto or sa mga walang knowledge sa extrajudicial settlement. They can still assert their claims over the subject property in the court of proper jurisdiction.
