Keep seeing the word "never". So, there's been a local murder. Cops ask for you whereabouts during the time and you have a dozen witnesses that put you clearly nowhere near it. Still don't talk? If they persisted after that, then ya.
Incur the cost of a lawyer, the waste of time, making yourself look suspicious and further investigation which you never know what would be dug into, or do you get them off you by saying where you were when you know it clears you, immediately?
I think lawyers protect their profession by giving that advise but mostly they can't get specific with every scenario so they default to saying "never".

Fishing expedition. I was in my car at a park. A cop rolled up and asked about 7 or so questions. Finally he said I fit the description of a robbery. He checked in with dispatch and let me go afterwards. While he was questioning me I noticed he kept looking at my rear seats while shining a light at my eyes (seeing if my pupils dilate). So I got out and shut my door. He ordered me over to his window, gave me a ticket, and told me to leave. Never even showed him my license, registration, or proof of insurance.
Found out later he was on state sponsored overtime and had to give out a ticket an hour to stay on it.

It's important to remember that demanding your lawyer only stops the questions... It doesn't stop the interrogation. They can still do everything they want to you around you near you and say whatever they want so long as it's not a question that pertains to the investigation. Meaning they can lie to you and say that your buddies already gave up the ghost and are spilling the beans. Thinking lie and say that your parents were contacted and they said to let you rot in jail. They could even say that your mother died. All three of those have happened in real life.

Prof. James Duane wrote a book called 'You Have the Right to Remain Innocent'- highly recommend everyone reads or listens to it. It's short, to the point, but explains in GREAT detail why you should NEVER speak to the police under ANY circumstances. Even if you're the victim of a crime, do NOT give a statement without an attorney present. There are FAR more laws than you can keep track of, and the police will GLADLY bust you and prosecute you for breaking an obscure, little-known law, even if you're the one that called them and are the victim of a more recent, relevant crime.

Keep in mind law enforcement exists to enforce laws and look out for "your" Wellbeing as a whole. Hauling you before a judge may set you on a better path, and it for sure enables restitution for any victim if you are guilty.
So yeah, they do keep you safe, but that doesn't always mean you won't get something which ends up in court. If writing you a stop light ticket keeps you from getting in an accident by encouraging you to pay attention and make better choices, that IS keeping you safe. If nothing else or keeps society at large safer. The effects of this are seen, quite spectacularly, in places which saw measurable increases in crime after massive budget cuts and officers leaving.

Having retired from LE 6 years ago, I guarantee Woody is right to a point when concerning traffic interactions. Apologizing goes a long way, being polite and you don’t even have to admit to breaking the law. That only goes so far though as running red lights usually goes to far for a warning. When it come to criminal charges - NEVER speak to LE with out legal advise. You have to provide basic info like nam, dob and probably your address. That’s it.

    • @Whiskey11Gaming
      @Whiskey11Gaming ปีที่แล้ว +6

As they say, easier to talk your way into a ticket than out of one.
Keeping in mind a goal of traffic enforcement is reducing the behaviors which result in accidents, being apologetic at least acknowledges you are mature enough to know it was wrong and may not do it again in the future.
If you start off the stop acting like an asshole, I'm a lot less inclined to believe a warning will fix the behavior.
You absolutely must provide name, date of birth, address and phone number of you are being charged in any way (ticket or arrest) or being investigated for such a crime. Failure is generally an additional crime (obstructing, generally).

If you get pulled over for speeding, be cordial, provide the legally required info, license, registration, insurance. If you carry concealed, tell the officer and keep your hands on the wheel. Don’t try and talk your way out of a ticket. Take it and go to court if you don’t think it was deserved (ie. You were provably not speeding).

I was really honest getting pulled over with the wrong plates on my car by a state cop. I was 19, and my dad had put the new plates onto my old car, and I had the right plates in my back seat. I was on my way to the RMV to get the plates registered to the new car, and it was just stupid on my part. Plus I was from a small, small town, and my run in the cops was a run in with people I knew already, and breaking the law was always a matter of negotiation and understanding. The cop didn't care one bit about what I was saying, and didn't care that I had the right plates in the back seat. I even admitted I had been stupid, and it was just an honest mistake. I was like "I'll put the right plates on, my bad. Yeah, obviously I need to go the RMV first, this is the first time doing this." He didn't let me switch the plates. Instead he towed my car and gave me a ticket that was like 500 bucks on top of the getting my car out of the lot, which ended up being like 700 dollars total.

I'm 50/50 on all of this. A traffic stop where I know I'm clean in all aspects and I know all I was doing was speeding, I'm friendly with the officer and I've gotten out of every traffic stop except one. On the other hand, something that is more significant where I could be facing multiple misdemeanors and/or felony, then absolutely shutting my mouth and lawyering up. One other aspect, my cousin-in-law was a Deputy for a number of years and he told me the primary reason his department did traffic stops was simply to flesh out more serious offenses because traffic citations did nothing for promotions and evaluations or perceptions of them as Deputies in his department, but pulling someone over for speeding and flipping int into a felony possession arrest absolutely would help his career, so that's why a lot of times officers are sniffing around/probing you on traffic stops. They want the big bust.

Maybe it’s just where I work but myself and most cops I know hate writing tickets unless it’s for really gross violations. Many cops are just using traffic stops to find the real criminals with warrants, drunk drivers, traffickers, etc. I hate jamming up good people and I know I’m not alone in that. Citations can be a good tool to enforce traffic safety but its not something I try to do. Crimes however, yeah. That’s our bread and butter. We want criminals off the streets so they can’t victimize anyone else. If you’re determined to have the best shot in court at getting off for the crime you committed, then this is good advice. Good rule of thumb is to not commit crimes. It’s not hard

    Cops hate court.
They schedule court dates on our days off, and they don't notify us when people pay their tickets right at the deadline (often the morning of the court date).
If we can give you a warning over a ticket, that is preferable. So a little bit of honesty, and the ghost of manners, goes a long way when you're pulled over for (what is often) a minor traffic infraction.

    • @alexandersears8538

I've gotten three tickets my entire life, 2 were absolutely bogus, 1 I was going 5 mph over the posted limit, but only because the limit had just dropped from 65 to 55 and I was slowing down to adhere. All three, I contested, all three they then rescheduled, all three the cop didn't even show up and they tossed the tickets out. But also all three, I lost TWO days of work because of, because it's never on OUR (citizens) days off. It's M-F 8-5 which is business hours for us productive members of society who actually make stuff (remember to be productive, one must first produce). So I'm glad they schedule court days on cop's days off. I have no criminal record whatsoever, and yet every single cop I've ever had an encounter with has been a full-blown rage monster. Honesty and the ghost of manners equate to jack when the guy at your window is already at a 10 for no reason.

There's a difference between not incriminating yourself, and being an asshole. You can 100% be cordial with a cop while not getting yourself in trouble. Ever since I stopped following the advice of the internet lawyers I have not gotten a ticket...dead serious. I'm not even saying I asked for mercy. I have even had an officer who was clearly annoyed, I couldn't see him in the rain, he could barely see me, the traffic light wasn't working and to make matters worse I pulled into a parking lot because I didn't want him standing on the side of a busy road. BUT I managed to treat him like a human being, we cleared stuff up and by the end I was able to at least get a fist bump out of him.
Be kind, treat them like they are humans unless they give you a reason to think they are up to something. This has gotten me out of some situations where I easily could have gotten a ticket. But if you feel like you are dealing with a corrupt cop then you need to stop talking, and explain that you either would like to receive the ticket if it's a ticketable offense, and if it's a jailable offense then be clear that you are happy to cooperate but you don't plan to talk until you have counsel.

I've also been pulled over by a cop in the same town who from the very beginning was hostile, he saw that i had been caught for possession of weed 2 days earlier and threatened to beat the shit out of me/kill me if I didn't tell him who my drug dealer was. Cop here, just felt like I'd add some counter points. When asked what the best way to avoid a ticket is, I always tell people to not do whatever the ticket was for.
Yeah ok, no shit right? The reality is when I went through the academy, I was told to make up my mind what I was going to do, ticket or warning, before I turn the lights on and only bend in certain circumstances. The reason was to avoid a lawyer trying to argue disparate enforcement based upon race or some other stupid reason.
With that in mind, for the last decade, I've generally held to that. So what are those circumstances? Genuine emergencies, drivers with little driving or criminal record, and people who are on the threshold but who are genuinely apologetic.
My state gives ticket revenue to the schools, so I see none of it thankfully. If you aren't an asshole when I stop you, I'm going to cut you breaks when I can unless it's just egregiously bad. The whole point is to avoid the behaviors which result in traffic accidents and fatalities.
On the whole "It becomes really expensive for the cops to get $130 from you"... just know it doesn't matter. The cop who stopped you doesn't care about whether it costs too much to prosecute if you contest the ticket. It costs north of $1k in wages and lab testing to prosecute a Possession of Marijuana which is a $300 ticket. Happens all the time.
Go ahead and contest the ticket if you feel it is improper. THAT IS YOUR RIGHT. Just know the odds, even without an admission, are heavily AGAINST you in traffic court. More so with body camera footage and cruiser cameras. If you want to win, you have to cross some monumental hurdles as my mere visual estimation of you speeding is enough to support a speeding ticket if I can articulate it worth a hoot. I've spent the last decade perfecting my trade, and while I'm not perfect by any stretch, I'm far more prepared to articulate my case than you or your lawyer are.
Speaking of lawyers, generally when you invoke your right to remain silent or have a lawyer, your interview ends and they have to decide if they have enough to arrest or release you. If they have enough to arrest, you are going to jail long before an attorney shows up for the interview. The next time an interview happens is if it is at the request of your attorney. This, unsurprisingly NEVER happens. In ten years, I've only had it happen once with a public defender present. The guy was such a narcissistic moron he HAD to tell the lie he was telling to himself just to make it so he could sleep. We had him on video so naturally it didn't help his situation any.

“Just don’t do whatever the ticket was for” LOL like nobody every gets unjustly pulled over by asshole cops.
Here’s real tips to avoid a ticket:
Learn where you can commit traffic crimes and where you can’t. Some towns have asshole cops who pull you over for 5mph over the limit. Other towns don’t even have a local stations and everything needs to be handled by state cops.
Just talk to friends and family and figure out which towns you should be careful in.
Also, mount a camera to your windshield that films the inside of your car. You’re legally allowed to film the cops on duty, and you should be recording every time you’re pulled over. They’ll be way less likely to abuse their power if they’re on camera doing it.
Always act neutral, roll down your window when they walk up, and give them license and registration right away. Don’t admit guilt, but don’t get snarky about your innocence either.
If they arrest you, don’t say ANYTHING except “I’d like to speak with my attorney” (or asking for a publicly appointed one). Don’t admit guilt to an attorney either. The goal of the attorney is to ensure that you get a fair trial, their knowledge of your guilt is irrelevant to that goal.

I was a federal police officer years ago. They taught us well about building trust and how to bring someone’s guard down in a short period of time to gain intel, probable cause and evidence. They taught us “Verbal Judo” and they taught us well.
I’d play the “no card” as a default or remain silent or use your attorney.

Do not confess to crimes (unless your goal is to get convicted). Do not hold court in the street. Courtrooms are the place to evaluate guilt.

If you get a traffic fine, always go to court, even if you know you are going to lose. For one thing, the officer may not show up and charges will be dropped. Even if they do show up, you have a small chance of winning. Even if you lose, at least they didn't just pick your pocket for the fine. You tie up their time. The cop can't be out writing more tickets. Often cops get overtime for court dates. You make them waste the courts time clogging their docket. You tie up the secretary's time making them do paper work and filing. If everyone showed up for court for traffic tickets, that is literally all the court would get done. They would have to hire more people. The whole system would grind to a halt. I just like the idea that they didn't just get to steal the money from me.

I got pulled over in downtown Phonix not even 5 min before i got lit up in an intersection by a camera so i knew i was speeding. The cop lit me up out of no where and i was slowed down and turned into a parking area by a walgreens but i had some illegal substances in my car so i was thinking about running and i smoked weed an hour or so before hand. But ended up just parking and the cop parked right behind me and then two more cars pulled up. He just came to the window and was like what are you thinking “86 in a 40???” i was just like i didn’t notice im sorry inwas very apologetic and admitted to it. Mid conversation he asked me the last time i smoked weed. i said i dont smoke weed. he asked me again when did i smoke weed, i told him bro look at me do you really think i smoke weed? he didnt make me get out of the car luckily but made me look at a finger or a pen and do the eye tests and then went back to his car, came back and said alright i can take you to jail but im not gonna do that, its even past your curfew too around 11:40 he said drive straight home and gave me a ticket where I wrote a letter to my probation officer of the dangers of speeding and it was absolved from my record. 6 months later i get in an accident that was my fault since i was speeding and lost traction since my tires were in really bad shape and didnt want to try to recorrect since there were a lot of cars around just slammed against the wall, somehow another car got hit but barely only the side of her rear bumper and the lady was perfectly fine thank god. But their was an off duty cop that stopped traffic since it was quite the accident even the tow truck said “is he alive?“ lol but the offduty was letting me have it, but luckily he was busy and had to go. The officers that came were awesome, really nice. He knew i was speeding but not how much so i just said i was going 90 i was expecting charges from reckless driving, street racing, felony speeding, all it was was unable to slow down to avoid an accident or something like that or speed was the cause of the accident. Ending statement was to drive better so i wouldn’t ruin my “nice ride” made me happy in the moment even though my car was on a slab of metal, this happened may 2022, car is still in the shop, i have since learned my lesson on driving. especially with my dad saying this line “you can tell a lot about a person based off how they drive”

Every lawyer only has to deal with clients who aren't let off with a warning, so they never see the benefit of a friendly interaction. They only see it once its in the court system, which is then better to have always been silent.
