- The plaintiff says the defendant was her landlady, who she claims vindictively kicked her out and even lunged at her when she moved out after 13 years. She says the defendant won’t return her security deposit, so she’s suing. The defendant says she took the plaintiff to housing court to evict her, and she had to be forcibly removed after destroying the house.

My parents always rented their homes, until about 5 years ago when they bought their home. But growing up my parents tought us kids, to treat the place like it's yours, to respect the property, especially if it's not yours.

My mom had a section 8 tenant and each year they would come out to inspect for the slightest crack or paint peel. So I don’t know how the landlord escaped inspection. Shame NYC!

@@archer2368 Are you a landlord? I'm not being a jerk or facetious, I'm just curious, because it isn't as simple as you're stating. There's only so much a Landlord can do. I mean, she definitely should have had annual inspections to minimize potential damages but vetting tenants is extremely hard. You can call references, check public records, run credit and criminal history, but how can that tell you the tenant won't damage your property, especially after 13yrs?

Tile cracks can also be from improper installation.
Anyone who has ceramic tiles, especially large ones, knows that it doesn’t take too much to crack them. The slightest unevenness in the subfloor can cause them to crack if someone steps on the right spot.

I know that's a fact I did private duty nursing for a lady. she dropped a small teacup and it broke the. large flood tile in 2 places
Yup, we have the same in our kitchen. We dropped a plate while cleaning up and it nearly shattered the tile.
Exactly we moved into a brand new fully renovated home that was nice but it had those dumb tiles on the ground and I’m almost sure that it broke the same day we were moving furniture in and we didn’t have heavy stuff.. unfortunately they were both in the wrong in the situation..

The Plaintiff got over, that house looked a mess… She got lucky, cause there was definitely damage to that house… that she should’ve been responsible for
13 years! The house was already in shambles. She should have painted EVERY 2 YEARS via nyc law. She should have replaced the tile (floor sticker).
@@deee3950 it’s every three years in NYC. The tenant can request to have the unit not painted, because it’s often a burden on the tenant. I’m not sure how many times a tenant can request to waive that right.
She lived there for 13 years !! The landlord should have been keeping up with the property. Section 8 should have been going out to inspect the home.

13 years is a long time and for the owner to not make any repairs and expect the home to be in mint condition baffles me! After 3 years at my current apartment, my carpet had a few stains and I asked the apartment complex if I could get a complimentary carpet cleaning after renewing my lease. They sent someone with no problem! Now that's how it's done!
The problem is, if the tenant never reports the damage, and by the plaintiff responding with “I don’t know how that happened “ to every single thing, she didn’t give the landlord opportunity to fix anything. I understand wear, even linoleum looking sheisty, but you’re supposed to tell the landlord if there’s an issue.

Yes sometimes if something is broken , u can ask them to replace it and u discount the of the rent money and save receipt to give to landlord

So you're supposed to remodel while the tenants living there so basically you're supposed to have the tenant leave for 6 months so you can remodel? Okay my sister is on Section 8 actually and he's never remodeled they're only have to do repairs and that's ridiculous what you're saying that somebody has to move out for a few months so the landlord could update the place and then move back in I mean think about it that's just bizarre
Ive rented the same condo for 9 yrs. My landlord hasnt stepped foot in here for 7 years. Lol he knows I treat it like its mine. Its spotless and I notify him of any issue then fix it myself and just give him the receipts for any parts and remove it from that months rent. Im free to paint or decorate any way I want and he knows its clean and well taken care and he just has to come collect rent once a month. Win win for both of us.

Wish u were my tenant 5 years ago.I had horrible tenants twice who played the system. I now have tenants who treat their home as if it was theirs!

It appears the apartment wasn’t updated at all During The 13 years and repairs were not kept up on by the landlord.

If the tenant actually took care of the house and kept it clean, she could have requested things get fixed and if the landlord didn't, follow up with section 8! This tenant didn't mind living in filth and did whatever she wanted to that house.

Right. My current place is OLD....The entire until is OLD. From floor to ceiling. Yet the landlords have the upper hand & be trying to withhold security deposits. Normal ware & tare is resonance. They be trying to get ur money for things they never fixed & have no attention on fixing.
That’s a good point… but with that said, my apartment is old and I’ve lived here for a long time… the maintenance company has done little to nothing to help with upkeep…but none of my tiles are broken, and my doors/knobs aren’t broken.

I have to disagree with this, because people can live in a home for *30 years.* and never have it look like that. The landlord does act like she just doesn’t give a d@mn, or maybe she’s still grieving, but they tore that house up. Most of what was shown had nothing to do with wear and tear, it was damage, pure and simple.
She was on Section 8. The landlord had to keep it in decent condition. That filthy welfare bum tenant just never cleaned.
I always had the impression Section 8 did frequent inspections and was ultra fussy about the state of things? Looks like the place was worn and outdated, BUT that doesn't account for all of the damages there.
I did some work on a few section 8 units as a contractor about 10 years ago. As long as it has four walls, no roof leaks, running water, and electricity it passes inspection. Each unit I was in was utterly destroyed. Was hired to do minimal stuff to get it back in somewhat shape. Was told by the owner "That's all we put into 'em, we'll be back here in 6 months doing it again." Sad.
They used to, there is not enough funding to have people actually do it.

I lived in a townhouse split into two apartments and the apartment downstairs was Section 8. If that placed inspection I’d hate to see what failed.

From the pictures that house looks old, run down, and decrepit. So that landlord is going to have to spend money anyway to fix it up. Even if the woman and her children didn't damage the old decaying floors and walls it looks like it needs a complete gut and remodel. Especially after she had the same tenant living there for 13 years. But the woman sold the house anyway so shes trying to make money off of something she doesn't have anymore. But one thing I've come to realize is a lot of these landlords always try to find a way to not pay the deposit when the tenant moves out. No matter how long they lived there.

There are some cases where you can tell Judge Milian really hates local laws but has no choice but to abide by them.
This is one of those. The plaintiff clearly lived rough in that place and owed for the damage. But she's getting her money back on a technicality and that sucks.
Honestly shes getting her $ back off of the naivete and ignorance of the landlord. How is she renting to section 8 tenants but has the nerve to say she doesnt understand in the slightest how it all works. And then didnt know in order to keep a tenants deposit u have to send them a letter explaining why. That's baffling. I'm sure she received a landlord booklet from section 8 and educating yourself on the other things is a click away. Even as a healthcare professional I have to earn education credits..I cant just say oh I never knew about that and potentially hurt or kill someone.

The toilet, I have often seen a crack like that in a toilet and no knowledge of how. if it was a big open crack, yes I would say Tenant fault. But the doors and walls showed clearly there had been no maintenance in that house.
There is no reason for a grown woman w/a son to have such damage in her apt. I've been in my house for 18 years, w/my son no such damage., no repairs.
The defendant did not follow the law. There's a reason they exist. She didn't give a section 8 tenant a lease for the entire time she was there and she didn't send the itemized bill saying why she was keeping the security deposit. It doesn't matter what the plaintiff did, if you are a landlord you have to follow your stay or city laws regarding rentals. There's no excuse. If she could not do it herself, manage the rental properties, she should have sought legal advice and/or a property manager. She set herself up to lose.

This is a typical NYC landlord, constantly pleading poverty and hardship when it comes to maintaining their many properties-but always right on time with the late rent notices and housing court paperwork. This tenant deserved this win, and more.

Nick that's a good point. So, don't tenants have rights as well when it comes to painting walls, carpet cleaning, maintenance of the property every several years? In 13 years that seems like normal wear & tear of the home, especially with children. The flooring in the kitchen and bathrooms should be completely replaced, what was used was cheap standard flooring, that needs to be replaced overtime anyway. So, glad she got her money back. 😁

Tenants abuse the system. Especially if they live off the government. What’s it to them if they cause damage to the property, it’s not theirs and they get free money from the government by playing the system. I would never consider being a landlord because most tenants don’t take care of other people’s property. I’ve seen court shows enough to say it’s true 🤷♀️ My opinion
Actually government based tenants are monitored and visited periodically by the landlord or property management Hard to get away with abusing the system if landlords are inspecting periodically as they should

If you stay at a place for 13 years you should expect some damages. I don’t really blame the defendant at all.

Everything the judge asked the plaintiff she says "uumm, I don't know." They tore that house up but the landlord was suppose to fix up some too.

My experience is when the government pays, the recipient doesn't care. Judge Millian says "The cheap comes out expensive", I say "The government comes out the MOST expensive!"!
Tips I’m learning now as a landlord! I know every five years the home should be repainted and every six months home inspection, as well .. I think
Depends on where you live. Because its every 2 years for new paint in many places

Right! The damage looked beyond normal wear and tear. The banister was filthy, bedroom door and walls ratchet and the peeling paint with door off the hinges.. the plaintiff was guilty and got off on a technicality.

My neighbors, when I was younger, were on welfare. Fast forward close to 40 years. They’re still on welfare. They own a home and everything. 6 adults lived in that home.

A good friend of mine was renting out his folks' house Section 8 and he found out the hard way that veteran Section 8'ers know exactly how to work the system. The place gets trashed, they know exactly how long they can go without paying rent, and like in this case, they know the laws that favor them. That's why she filed the case.
That was a slum Lord who made a lot of money to not maintain her property. She didn't value a long term tenant or her property

Being a land lord in NYS, NJ, CT. MA and CA is hell. Imagine dealing with people like this Tenant? These people never pay tenant, destroy the "Rich man's" property.
She could have kept the security deposit if the landlord followed the law, written the letter within the 14 days, and be done with it. You cant just keep someones security deposit because you feel entitled too it.

Well, to be fair, they didn't go into that history.. plus section 8 paid a great portion of the rent. And yes, lol, Judge Milian is a Landlord. Landlords typically get the short end of the stick because there are so many laws which protect tenants.

@@kimberlyadorno280 Actually, Section 8 does NOT pay the security deposit. The applicant is 100% responsible for paying the security deposit. Stated to act as another guarantee to treat the property well and as their own, on top of agreeing to the same when signing the lease. Once the applicant pay, THEN Section 8 will begin paying the landlord the agreed upon monthly stipend. So this plaintiff had to pay the full security, before or at the signing of the lease with HUD and the landlord. Making her also able to sue to recover that deposit if they think it’s deserved. Unfortunately in this case the landlord didn’t follow the law so the plaintiff had a solid case, although no one could tell due to the inability to put together a full sentence. 😒 after 13 years of residency, with zero repairs in that duration, I’d expect MORE than a little wear n tear than one would typically see after a short lease. Especially if I never bothered to step foot into the property the entire 13 years to do a walk through, assess and document any damages and make tenants and section 8 aware then, create a paper trail. 🤷🏽♀️ the plaintiff surely could have cleaned the place better than what we saw but, who knows how rough it was when she moved in? There’s only so much one can do with old floors, warped laminate tiles and flat paint on plastered walls. 🤷🏽♀️

I work in Property Management, and tenants definitely take advantage of the system and the laws when renting. They also unfairly withhold rent, destroy property and move in illegal occupants.
When folks are spending a couple thousand or more to move into an apartment, the last thing they are trying to do is pay extra application fees for each adult over 18! I get that that makes them "illegal" in that dwelling, but oh well! As long as the tenant pays the rent on time and isn't causing problems, leave well enough alone! It's hard out here!
@@latijaiacollins-harris I agree it is hard out here. But you're making it harder on yourself by not having them fill out the application and do it the "right" way. Because we will report illegal occupants when and if you decide to move out and it's frowned upon by other landlords.
I have been a tenant and had real estate agents employing property managers of 20 years of age with no clue and things not been followed up on. I moved out of a place due to an infestation of cockroaches they refused to deal with. This was caused due to a broken pipe in the kitchen as it hadn't been installed correctly and the residual moisture was attracting ants and Cockroaches. I told them if they like their faeces so much I would leave it as I wasn't cleaning up after their pets. I took them to court for my deposit and won as they had no witnesses or evidence and I had 5. When they lost the property manager stormed out like a spoilt brat.
The tenant left that apartment TRASHED and nasty 🤦🏽♀️

Good grief is the landlord on Ambien? The tenant did some damage to be sure but nowhere near what the landlord wanted, especially given duration of occupancy. Seems like the landlord is at least neglectful if not negligent herself.

I think he had that reaction because the guy was saying landlords are usually at fault, so it would be crazy if he was a landlord himself saying that. Harvey is a known ally in the community, it's not always about race sis.

After living somewhere 13 years, I'd expect some of a security deposit to be kept, because you can't keep everything pristine for that long. However, that tenant didn't have to take any responsibility because the law had recently changed and the landlord had no recourse. Hard to watch, but it's the law.

It's interesting because some judges take the time into account in the opposite way. You don't get dinged for things like paint damage and carpets because after ten years they would need to be replaced anyway.
Nope. If I pay to rent an apartment and the rent continues to increase, and my Landlord sent me to court...I would be mad.

Some of it is normal wear and tear and some isn't. It's very possible that vinyl floor spot came up from wear and tear over the course of 13 years. That stuff doesn't last forever. But those door hinges being smashed isn't normal wear and tear.
They destroy the house and then they think they are not responsible.. It's ridiculous
If you are a tenant you do not own the property you are living in. I've rented before multiple times and I never trashed a place like the people on these shows. It's sad that the landlord couldn't keep the money because she didn't follow the letter of the law but that house was trashed. What is wrong with people?

Harvey constantly presses the whole ‘whose usually at fault: landlord or tenant?’ It’s clear he wants validation because he is a landlord… he ALWAYS defends the landlord.
Tip for tenants.. On the first day of looking at the place.. Take pictures and make a "snag list". (Same on moving out date..) Let the landlord sign with you and it must have a date that the broken stuff will be fixed... If the landlord does not fix it and you send a written reminder.. Get a outside contractor.. Fix and pay for it... And then deduct the amount from the rent... If it ends up in court one day.. You are covered. Any correspondence between tenants and landlords MUST BE DATED.. So keep it in a file..
And remember this.. A landlord is not your friend.. They can be friendly yes.. But they are running a business.. So keep a good relationship but don't "trust" everything you hear. 👍❤️
Who knows who does it more often? I do think some landlords abuse it but it is likely tenants abuse it far more often(far more tenants than landlords).
The defendant is creepy. Thirteen years and no inspections? Because she would have had to do timely repairs out of pocket.

Section 8 is certified annually. Im guessing she had a initial lease, and the case manager just kept using the same one. But usually a new lease is needed.

we're in a rent control area....landlords can only raise the rent a bit under 2% a year. BUT there are loopholes that landlords use all the time....they can kick out the tenant if an immediate family member wants the apt, or if the building needs major repairs. The family member often doesn't move in.....the landlord just paints the place and doubles the rent...or the building that needs major repairs is granted a huge rent increase, plants 3 trees near the parking lot, and asks for another large increase the next year. In our city the judges almost ALWAYS finds in favour of the landlord, even when they've broken the law. And the fines for breaking the law....if any are imposed are tiny.
