    Don’t see how any other outcome would be possible if you watched the trial. Self defense is not chasing down a man and gunning him down.

    My absolute respect to the judge

  • @Hollowsmith
    @Hollowsmith 3 ปีที่แล้ว +3

    I am an attorney in the state of Georgia, and I would like to DEBUNK a "defense" I've heard of the three men convicted of murder.
    I am hearing in some circles "My. Arbery is on tape criminally trespassing a property moments prior to the three men giving chase. Therefore, they had probable cause for an attempted citizen arrest, and probable cause to brandish weapons while chasing him because they suspected he was a criminal fleeing the scene of a crime."
    Here's reality. In the state of Georgia, "criminal trespass" requires "evidence of material property destruction, theft, or aggression". There is no evidence Mr.Arbery destroyed, damaged, or stole anything from the home under construction. In fact, the builder states he DID NOT steal or damage anything. That leaves only "aggressing the property". In Georgia, "aggressing a property" is defined as refusing to leave private property when requested by THE OWNER of the property. Mr.Arbery had never been confronted by the owner of the property at all, so he obviously had not yet been requested to stay off the property.
    Therefore, Mr.Arbery HAD NOT met the definition of criminal trespass in the state of Georgia merely by looking around a homesite under construction with nobody yet requesting him to stay off the homesite.
    So Mr. Arbery was not "evading arrest" or "fleeing the scene of a crime". Legally, all the cops would have done is retain him long enough to contact the owner of the property, at which point the property owner could have initiated a request to not enter the property. And since the property was not occupied yet, with no personal valuables and only some raw building materials laying around, it's extremely unlikely that the police would have had sufficient evidence to charge Mr. Arbery with the presumption of attempted burglary, ESPECIALLY since he's on tape taking nothing when exploring the build site.
    So what we have here is a citizen (Mr. Arbery) who had committed no crime under Georgia law, who at most was facing a warning from the police or homeowner to stay off the build site.
    And ignorance of Georgia law is not a defense. Meaning, the three defendants have no legal defense for their actions by saying "We thought exploring a build site was a crime". With no prior warning to stay off the property, it WASN'T a crime, and it is their legal responsibility as citizens of Georgia to know Georgia law.
    Therefore, what we have here is a man guilty of no crime whatsoever (Mr. Arbery) who while running down a public roadway just 2 miles from his own house, suddenly finding himself chased by three armed strangers in pickup trucks. By their own admission, they made clear verbal contact with Mr. Arbery when they requested he stop and explain himself, and Mr. Arbery declined to engage them verbally which was his right.
    Most importantly, if the three defendants were trying to maintain visual contact with a suspect they (wrongly) suspected of a crime until police arrived, they could have done so from inside their vehicles. THE CLEAR escalation of this event was when the defendant stopped his vehicle in the middle of the road, and got out of his vehicle armed with a shotgun, claiming "self-defense" from an unarmed man who had tried to flee him for 4 minutes on foot, had committed no crime, and had already tried to disengage from conflict with the men.
    At that point where Mr. Arbery is facing armed strangers stopped in the middle of the road exiting their vehicle with a shotgun after trying to flee from the armed strangers for 4 minutes, Mr. Arbery had FAR more of a "self defense" claim in going for the defendant's gun than the "self defense" claim or "citizen arrest" claim of these men chasing a criminally innocent citizen legally on a roadway trying to flee them.
    Regardless of how much Mr. Arbery's skin color did or did not motivate the defendant's aggression, the fact remains that all three men engaged in behavior that DRAMATICALLY escalated a minor police or homeowner reprimand for Mr. Arbery, into Mr. Arbery's very reasonable presumption that his life was in danger.
    Mr. Arbery deserves at most about 5% blame for what appeared to be some harmless curiosity about a build site in his neighborhood (which several other neighborhood white youth were on tape having explored as well without escalation of incident). And these defendants deserve 95% of the blame for taking a very minor issue, and egregiously escalating the sequence of events until it ended in tragedy.
    All three men played a stupid game with event-escalation. The jury decided for that escalation, they won a stupid prize called a felony murder conviction.

      Thing is you need evidence. No evidence to prove guilt or innocence you have to go not guilty. When theres enough evidence to say one way or another then you have to go the way the evidence takes you. You cant just take the word of witnesses. Youd also need dna, video, confessions, weapons, motive and so on. And the media doesnt have a say in whats real and what isnt.
