      There was a case about something like this, I don't remember exactly what it was, but it had something to do with burglary. Some dude robbed a politicians house and then that politician adjusted the law to prevent this. There was a video, but I don't remember, I'm not sure it was a burglary. But basically it was a politician that only changed the law when he was personally affected.

      What’s even crazier is imminent domain stuff. Basically if the actual home owner is away from house for however long (usually years) a person can legally occupy a property and claim it as theirs and if the homeowner or bank doesn’t dispute it the property legally becomes theirs. That’s the ultimate goal of most squatters. But it rarely happens. But for the legal methods of sheriff removal of squatters usually takes 3-6 months (if not longer).

    • @ronrolfsen3977
      @ronrolfsen3977 10 หลายเดือนก่อน +3

      Tenants do and that is where the problem lies. Well, not the fact tenants have rights, but the fact that as some point the police do not know the difference between a legitimate tenant or a squatter/trespasser. That is why you need to get an eviction trough a court first as at the point it is up to a judge to validate you claim they are there illegally.
      That all in my opinion makes sense and is fine. However it should be punishable (in my country it luckily is now, but only since 2010) and the process should be done quickly as to reduce financial and emotional cost to the home owner.

      @@jonathanxavier2026 Slight corrections on your statement.
      1) The Clovis were the discoverers of NA, they were the original "native" Americans. Until the tribes that we call "native Americans" settled on the lands and completely wiped them out.
      2) There weren't 100 million "native" Americans when the colonists settled, not even close.
      3) The "native" Americans lost the war. Ask Poland what happens when you lose a war.
      As I said, the "native" Americans were just better at genocide. They wiped out an entire species of humans. The Europeans at least let them live...Until the "native" Americans gave them tobacco and have steadily killed more people than the settlers did.

    • @jonathanxavier2026
      @jonathanxavier2026 ปีที่แล้ว +5

      @tadaskay79 While I appreciate the corrections, they might be entirely a work of fiction. You're right that contemporary anthropology accepts the Clovis people as the discoverers of NA. That's about as far as the truth goes before you venture into fantasy. There is no record of subsequent migrations wiping out the Clovis.
      It appears as if you're very confused as to who the Clovis were. They are a Paeloindian group who migrated across the bearing straight who used ivory and stone to fashion weapons of a particular style known as the Clovis. They are the ancestors of Native Americans, a group you claim isn't native. There were subsequent migrations from the same region, but by and large, the Clovis are the ancestors to 80% of Native Americans. Here's a source for the fact that most native Americans are decendants of the Clovis people.
      Raff, J. A.; Bolnick, D. A. "Palaeogenomics: Genetic roots of the first Americans." Nature.
      You're absolutely right that there weren't 100 million natives in North America at any given moment. However, the genocide of the Native Americans wasn't a singular event but rather a continuous, sustained, and methodical effort to erase them. This is so well understood that there's little contention among scholars. The precise number, however, seems to be up for debate. Nevertheless, the most accurate estimates place the number of natives subject to a genocide at 100 million. The source for this number is cited here. Denevan, William M., ed. (1992). The Native population of the Americas in 1492.
      Lost a war? I find war a politically correct term designed to mask the true nature of evil that is committed. You call it a war to attempt to justify the theft of land, genocide and ethnic cleansing.
      You are hopelessly clueless about this subject, contradict established scholars on the designation of the Native Americans as the natives of the Americas, and invented some fantasy about the "tribes we now call the natives wiping out the clovis".
      I suppose this is the sort of intellectual rigour you can expect from a steven crowder or Sargon fan.

      For God’s sake. Do Republicans not know anything about the history of the country they claim to love.
      Squatters rights originated in England where land was only taxed if it was being used. Landowners allowed big tracts of their property to lay fallow to reduce their taxes. People would occasionally move onto this land & build a house & plant a garden & crops. Since the land was now being used it was taxed which meant more money in the King’s coffers so the practice was allowed & squatters given rights by the Crown. If the squatters stayed on the land for 20 years it became theirs.
      America adopted these squatters rights laws with the Homestead Act of 1862 which allowed settlers to take over unclaimed land at the start of Westward Expansion.
      Squatters rights have nothing to do with Democrats. The origins started long before Europeans “discovered” America & in 1860 The Homestead Act (which was basically the same as the laws in England) was on the REPUBLICAN platform. When it passed in 1862 REPUBLICANS controlled Congress & it was signed into law by President Lincoln.

      freedomforever6718. Stating facts is not gaslighting. Facts are that which remain the same despite how one feels about them. In other words facts are facts whether you like it or not.
      Fact: the Declaration of Independence rejected English RULE. It said America was an independent country, not an English colony & set the groundwork for forming a new government of elected officials. It did not void all the laws in place in America at the time.
      And the Homestead Act was passed in 1862, nearly 100 years after the American Revolution. It was based on the laws in England & other parts of Europe & was originally meant for homesteaders & settlers but it has remained the law & today squatters are exploiting it to move into empty houses. That happens all the time. Laws passed for one purpose are used for another.
      I feel sorry for all who are so ignorant & closed minded that they feel threatened by truth & facts. You have my pity.

      Actually it's better this way, you only hear about the cases where the law is abused, not where it works as intended. These laws are basically in place to prevent corporations from buying up tons of homes, and then not allowing anyone to live in them unless they pay exorbitant rental fees. Squatter rights actually work to help keep property costs from skyrocketing. Current state of things if landlords set the rent/sale price too high, most likely that property is unrented/unsold and becomes a tax expense and fiscal liability, until they lower the price. With squatter rights in place, someone could hypothetically be like "$3000/month for a 1 bedroom house? Pft, no, how about $0. I'm moving in." And they can't do jack about it, really. So now not only are they not renting/selling the property, it's accruing MORE wear and tear than if it were simply sitting vacant.
      Of course you get situations like this where people just move into a random privately owned house, and yeah of course it gets national attention. But these are extremely rare, compared to the literal tens of millions of homes protected by the laws.

      The fact is, they do. Removing a squatter is no different than evicting a tenant from a rental property. There is a legal process you must go through. The reason you cannot simply call the police is because they cannot sort out the situation right then and there is adverse claims are made by both parties.
      In typical squatter scenarios, the property is owned by Person A, and occupied by Person B (the squatter). Person A, while they own the property, generally does not live there (nor does anyone else other than the squatter(s)).
      So, the police are called, and the property owner (who likely doesn't have the deed on them) tells them this person is trespassing. The squatter likely denies this, but also doesn't likely have a lease (fake or otherwise) to prove it.
      So, neither party has proof of anything ... therefore the police cannot act. This does protect the squatter, in a sense ... but it also protects legitimate tenants from caustic land lords.
      So, the court proceeding starts.
      The best thing to do, as a property owner, to prevent squatters, is to not leave your property unoccupied for very long. Keep the entrances VERY secure, and check on it frequently.
      If you catch a window of opportunity like this guy did, you can force them out while they are gone. Since they aren't legal tenants, they have no legal recourse against you. However, any physical contact with them can (and likely will) result in assault charges against you. However, in some states you may not remove their stuff from the premises, change the locks, or shut off utilities. So, check your local laws first.
      I believe, while the video shows items out on the lawn, the individual here simply locked the house up (with existing locks) and told them they had a day to get their stuff out or lose it. He did not move the items out of the home himself.

Can't blame a dude for chancing their arm if they have no place to go, especially in modern times when you can't get planning permission or come close to affording a house. It certainly is more complex than just one-side wins but i defiantly would side on the owners if they were owners of the property for a number of years only. Last thing you want is banks repossessing homes and kicking people out immediately unless that's a different situation. Or they were laws passed in the era when socialism was on the rise and still considered a legitimate theory (very early 1900s).
      In the frst case actual "squatters rights" don't actually exist it is just a loophole in the legal system; The furniture is prima facia evidence that they are living there and not just tresspassing, therefore it becomes a civil land dispute to be settled by a civil court. I love how so many of our laws are in the books to protect the criminal. The police should have a right to go in there and drag those thieves out by their hair, kicking and screaming all the way to the streets. Or the homeowner should have a right to go in and take them out, anyway fit to get them off of their property. Squatters are the scourge of this earth, and if they don’t revamp these laws these major cities that are bursting with homeless people are going to have a serious situation on their hands when they start taking over entire apartment buildings.

      I mean, even without those rights, its implied I can still do it. What's stopping me from forging a contract where YOU gave your house to ME? Last I checked, cops aren't specifically versed in contract law, or even taught the techniques and technologies used to detect fraudulent signatures. So long as you have a written document handing the house over to yourself and some scribble lines for the signature, the cops can't do anything. It's purely a civil case at that point.

    • @iMatti00
      @iMatti00 ปีที่แล้ว

      You need to stop letting your emotions cloud your mind. World history is full of people who don’t want to give rights to people because they’re whipped up in a frenzy. And then when you’re in trouble you don’t have those rights anymore. Adjusting the law to be properly calibrated is one thing, But stripping people of the rights is another and will have huge consequences.
      And I don’t really agree that criminals have too many rides. Just because certain laws are not enforced in proper punishments are not handed out does it mean people have too many rides. As humans we can use our minds or we can just be emotional and lash out. That’s what got us in the situation in the first place. When the policing system and Justin system were often too harsh, instead of correcting it the pendulum swung way to the other direction. And now it’s saying people such as yourself want to throw it back even further in the other direction. I’m always perplexed at how history repeats itself in one form or another.

The police refused to help and adviced the homeowners to get a lawyer. It normally took about a year to evict squatters and thousands of $£$£ in lawyer and court fees. Even worse, the squatters took all the personal possessions of the home owners like family photo albums, collections, clothing, baby clothes, certificates, diplomas, medical papers, etc, and threw them out of the windows into the rear garden to rot. It's completely ridiculous how we handle squatters in this nation, the split-second someone enters your home or stays there after they've been told to vacate they have committed the crime of trespass and theft because they owe you rent and a security deposit they have not provided. It's just ridiculous people have to go through these theatrics to reclaim their property

      General public may be on their side

      Who cares how they feel, we should take all of their property from them without ever asking them what they think or feel about that

    Squatter's rights might have had it's place at one time, but that time is no more. Laws need to be changed. After my mother died, her home was empty for several years. First, we needed time to grieve before going through her home and dividing things up, selling some things, trashing some things, etc. Second, the house needed to be renovated before my niece and her children could move in. Thankfully, we live in a very small county, and my sister and I live within walking distance of our mother's home. In Autumn/Winter, when the trees are bare, I can see my mother's place from my front porch.
    I would have been livid if squatters had moved in and took over the place. I grew up in that house from the time I was 9-years-old. My dad, his brother, and a friend built that house. I remember every step of it's creation. It is more than lumber and nails to me. In a sense, that house is family to me. I have no idea what I would have done to get the squatters out of that house. And I have no doubt that our neighbors, family, and friends would have helped us run those squatters off. I'm just grateful that I never had to deal with what so many others are having to deal with. My heart goes out to them. Hopefully squatter's rights will be a thing of the past.

    Years ago I helped an old high school friend with his living situation. I was currently living in a church basement apartment. He was not a very good tenant, he was only allowed one month to get things together. The only way to get him out legally was to have the church kick me out too, though they were pretending to. Always make sure you have some kind of agreement in writing before you let someone live with you, even your own family.

    Basically, if the home is empty, install a security system with cameras that notify you and the police immediately when someone breaks in and make sure the alarm system is loud as hell too. Also make sure that you tell the monitoring company to inform the police that no one is supposed to be there at all.
    Security systems are needed more than ever now.

    For those who wonder why it’s so hard to find rentals, it’s because landlords are on their own when it comes people taking over their homes. You encourages thefts, there will be no shops. You encourage squatting then there will be no properties for rent. I own property in a vacation town in which people are dying to rent during winter off season but nobody want to because home owners rather rent weekly during summer than taking a chance someone won’t leave once moved in during the winter.
