That's true....but that's not what wins the case. What does is the conjunctive nature of the elements of an eco car under the respective law. The fact that the minivan does not get 30mpg in a certain situation has made it fail the test of being an eco car. So, here's how to see it in this light, if I as; can you "minivan" get up to 30 miles per gallon in the city? And your answer is no. My question would be; how then is it an Eco car under the respective law? If you say a but to that...then you might look like a clown before the court or annoy the judge.
What if the second element is not satisfied, do we still need to discuss the third element? since we can already conclude that it is not a three star eco car.
