State Struggles to Prove it's Case when Victim Refuses to Cooperate

- A jail house beatdown, 4 against 1. The victim agreed to testing against his attackers who are now multiple states away in different facilities, all still incarcerated. At the preliminary hearing, he seems to have had a change of heart and refuses to talk, making it difficult for the State to prove their case.

What a waste of lives
I’d be interested to know what everyone involved was locked up for.
I have a strong feeling the "victim " was in for some sort of child crime and these fine gentleman were just adjudicating justice 😂

Attorney Favre - he was an assigned public defender to many cases in Judge Webster’s court a while back. All his clients showed up to say they couldn’t get hold of him for some time and his staff couldn’t provide information about what was going on. It seemed he left the PD pool around that time. Every time I see him, I hope he’s okay.

He’s not talking because of one of two things: either he’s the Roger’s transferred from Florida to Butler because he cooperated with the prosecution in FL and gave info on all the gang and dr*g activity in the jail/prison, or he’s the Roger’s transferred that was a chomo. I did research, I believe it’s the first reason, the other guy had reddish hair.
And it looks like the State of Kansas settled a suit with this Rogers for OCs not protecting him knowing he was in danger. If it’s the same guy.

If he opens his mouth during this trial he will only be injured worse. Why force someone to cause themselves more harm?
I get it, but they have to try and ask. The victim clearly has extremely valuable testimony, enough that they stabbed him into silence. They need that testimony in actual words because of hearsay if it doesn't come out of his mouth.

I have GOT to get some work done, but...
27:16 I zoomed in on the defendant and watched his behavior while the victim testified (not). He was definitely trying to communicate with someone of to his right with slight, almost imperceptible movements. Slight grin, nodding confirmation.
30:10 After victim stated he "couldn't see anything in the video", the defendant looks to the right, grins, closes his eyes a tad, and nods. There is definitely some kind of nonverbal communication going on there.
If that's the best video they have, I think they are going to struggle unless they have other evidence. The officer claiming that he could identify the defendant on that video and could see him striking the victim was enough for probable cause, but I'm not sure it will get them much further... I don't know why the officer than ran in to stop the attack (very bravely, I might add - that was at great personal risk) didn't testify. If they testify at the trial, that will probably fill in the gaps.

@@MegsCrimeWatch Sorry. I’m speaking on the concept, not the video. I’ve had a lot of kids tell me this phrase and I always told them that by keeping quiet they are allowing bad people to prosper.

Indeed. The correctional facility needs to do a better job of protecting the victim so he feels able to testify. I can't blame him for not wanting to testify given what has already happened to him.

Can I just politely make an unasked for piece of advise ? After the first case finished you went to a blank screen with like sub sign which is great but it also indicates video is over. I almost clicked off but waited only because of the time stamp. Had I not noticed that I’d have been gone think that was it. Someone who is new to the channel may not know and think the same thing. Just saying. Hate to see you lose views or have videos that are t fully seen. Back to minding my own business. I’m sorry. . I can’t help it. Im a mon and a grandma 😉
