    You are absolutely correct Meg - there should be much harsher penalties for drinking and driving. A man's life is ruined because she drove drunk and she does not even go to jail at all. Where is the justice.

    My 6yr old son was killed by a drunk driver. The fact that she’s just walking around, still testing positive for alcohol- several times- not taking ANY of this serious is just mind blowing to me.

      My 7 and 9 year old sons were playing in the front yard and killed by a drunk driver. he had diplomatic immunity and released to his own country in 2 days free.

    DUI should be treated as a felon PERIOD! I am sick of misdemeanor charges! When someone you are in love with is ripped away from you, because another chooses to drink and drive, we serve a life sentence!
    Mine was killed instantly leaving behind 3 children, his brother, the passenger, died a week later leaving behind 3 children and 3 months later their dad (grandpa) died of a broken heart (literally!)!
    The driver received 3 yrs served less than 1 1/2….
    I’ve seen people with 4, 5,6 DUI arrests and their high priced attorneys get them off with a slap on the wrist! The anger is real!

      That’s terrible. I agree that’s it ridiculous how many chances drunks get. I have two friends who separately hit by drunk drivers while pedestrians and suffered terrible injuries. I don’t get it why were so lenient

      I had to look up the SCAM monitor, and one of the sites said it was great for second or third DUIs. WTF???
      No injuries to anyone close me, but I’ve been stopped at a light twice and been hit by a drunk driver. The first had long weeds and saplings hanging off his bumper from running off the road. The second slurred something incomprehensible and fled the scene. ALWAYS GET THE PLATE FIRST.
      I am sorry to hear about the people far more seriously impacted. I can’t imagine what that feels like.

      They have to make alcohol illegal.. and that’s far from happening.. which is crazy.. alcohol is the only “poison” the world will allow you to ingest and tell you to “ drink responsibly” they don’t do that with anything else.. 😅

      i hear ur pain. the man who killed my brother was charged with negligent homicide and was only fined $75. that was in 1978 and i'm still mad.

      I agree that the first one should be a felony, period. This one is a felony as she is facing 10 years because of the serious injury. I don't think she'll make it through the probation and will end up serving time anyway. We had a case here (Alabama) a few years back where a woman with EIGHT previous DUIs crossed a median (drunk, and no license, of course) and killed (murdered) a 22 year old college student. So her NINTH offence was a murder charge. It took killing someone to get her off the street.

    Side note: Ankle monitors easily distinguish between drinking and environmental alcohols. Blood alcohol shows as a characteristic curve over hours, whereas alcohol on the skin evaporates within a minute.

      You are absolutely correct. There is no environmental alcohol that will set off one of these devices. Tests have been done using gallons of hand sanitizer and it still did not trigger an event.

      Unfortunately the monitors are not accurate. There have been studies that show that 90% of the time, they give any reading of alcohol. It’s only accurate if the person doesn’t use anything that contain accurate. This means, no chemicals, soap, perfume, etc.

    My honest opinion is that the first DUI should be 1 year in jail, not probated, A $10,000.00 fine, and loss of license for 1 year. Second offence should be 5 years in jail, not probated, $50,000.00 fine, And license revoked for 5 years. 3rd strike your out. Life in prison without the possibility of parole. And if someone dies from the 1st or 2nd offence, you go straight to 3rd strike status.

      Sad fact: Not only does a DUI not exist in the penal code, if you commit a crime like a homicide while drunk, it is considered an impairment enough to make you only partially competent to be punished for it. Intoxication should be considered like in the US IMO, and aggravating circumstance.

      Japan has a zero tolerance and your first offense its jail for up to 3 years and that is if you are 0.03 to 0.04 that equates to a glass of beer and it is a 5 thousand dollar fine! Im gonna guess drunk driving rates have gone down a bunch

    I was hit by a drunk driver in Texas in Aug 2020, the driver was coming home
    From Celebrating her 24th birthday at a club. I was 26 at the time and had ran a half marathon the weekend before…I was life flighted spent weeks in the hospital… had several other hospitalizations after being released. Broken right ankle, crushed left foot, compound fracture in my upper right arm, complete fracture in my lower right arm, three breaks in my back, 7 broken ribs, concussion, lung liver and kidney lacerations … lung collapsed… the plate they put into my arm snapped that dec…. Had to have a bonegraft…. All this to say the driver that hit me only got probation… I am here today by my own determination and will to overcome the horrible consequences her birthday celebration left me with…. She has since received several traffic violations for driving without insurance … speeding…. The system needs serious reform regarding drunk driving …. My life has completely changed.

      I’m so sorry. Did you hire a PI lawyer and sue her insurance? I’m a mail carrier and was mauled by a customers pitbull bc they weren’t in reasonable control of their dangerous breed dog. There were no repercussions to the owners. The justice system is so flawed. You’re very strong, idk if I could get through what you had to.

    I looked up her attorney and it appears he died July 17, 2024. Note all of the medication bottles on the shelf when he rolls away to the desk in his shorts/boxers. I bet he was terminally ill and didn't tell anyone. My father did the same thing.

    This woman has me so incensed! She’s an unapologetic, manipulative liar who’s clearly unable to follow through with the extremely lenient probation conditions because she’s, apparently, above the law. She’s a self-entitled pos who’s just going to violate her probation again and again and will never learn. Judge Boyd really dropped the ball with her and should’ve sent her to prison at the get-go. Probation doesn’t work with offenders who totally lack impulse control, empathy, and a moral compass.

    WTF, she’s poor, buying all the clothes, a plethora of free time to post on social media and we just learn now she is married. They kept that under wraps for a while. Restitution to the victims is 200 hours of community service and potentially waived for what? She repeated her daughter’s father, so the other kid has another father - meaning she is probably getting child support.

    Yet again a Defendant that had cost another citizens so much pain and suffering gets a slap on the wrist first from the DA and then from Judge Boyd...for a few years straight... ...never sees a jail cell as she glides thru Judge Boyds court with no actual consequences.

    Everyone seemed to have forgotten how her perfume and Lysol caused "false" readings on the SCRAM tether in the first months of this charade. That is impossible btw because the device is not measuring the actual alcohol it is measuring the molecules of ethanol vapor being expelled from the body. It is shocking that the court doesn't understand how the SCRAM actually works. This woman is a con artist and should be in prison because she doesn't give a $hit about anyone but herself. Absolutely despicable!

    I’m 148 days free from a fentanyl addiction. It started with opioids prescribed my doctors for multiple chronic pain conditions. I remember when they started to find fentanyl in my system, I said some of these things. Not Lysol, obviously, but things like “could I have come into contact with it at a store? I have no idea why that’s in my system. That’s terrifying!” I eventually stopped going to pain management and started using fentanyl exclusively.

    The comment you showed from the family member broke me. I cannot get over a sensation that I failed to protect the ones I love and care about.
    I know that the feeling is illogical (i.e., if I tried to disarm the guy that pointed a gun at my wife's head in front of me then she may have gotten shot). But that doesn't fix things. Until I had a breakdown in May 2023 I was working in crisis support and suicide prevention, but things happened in my role that further led me to blame myself more for failing to protect people.
    I hate myself, I self-harm as I deserve to be punished and thoughts of leaving this world often enter my mind. Since August last year I have spent a total of 88 days in a psychiatric hospital trying to get help. This included medications, TMS, ECT and EMDR. At this point none of them have helped me to find the self-forgiveness I need.
    I wish I had the strength the victim had in that moment to protect the people he cares for. I would take the pain of all those I care about if it meant they are safe.
    Sorry I know this is probably not the place to share this, but I really appreciate the way Meg handled the situation around the victim and honestly I needed to get at least part of this off my chest. I originally wrote a huge comment detailing a bunch of trauma, but I deleted it as I am worried that what I have already said may hurt others.
    I wish you all happiness, health and peace in your lives.

    It is messed up, Meg! And to answer your question about what happens if someone comes to the door when you are not wearing pants? I opened it, stark naked! It was a stinking hot day, 44degC on the outskirts of Perth Western Australia, 50 years ago. I had two babies, a 6 month old and a 17 month old and a couple of dogs. The 1 acre property was quite secluded, the house was not visible from the road with a long driveway. I didn't have air conditioning, so the kids and I stripped off and together with the dogs, in the shade of a big tree, we were having fun with the garden hose when two young American missionary Mormons knocked on the front door. The look on their faces as I stood there dripping wet, big smile on my face was priceless!

    My ex had a DUI. He went to court. He lost his license for a year and a half. He didn’t drive because he lost his car in the DUI.
    And that was it. A year and a half later. He was able to drive again.
    How can people make things so complicated?

    She should be in prison and during the day working *every day for 16 hours* per to pay his bills and make restitution!
    She ruined his life and got away with it all! I am so sick and tired of women using god to excuse their bad behavior. If she were "godly" she would not be out cavorting as a drunk in a car while who knows what is watching her children.

    Very sad he died of prostate cancer. It’s 2024 weeks all now know that cigarettes kill. Don’t ever start than it won’t be a problem. RIP Mr. Longaker you tried to be a good attorney to the bitter end. We salute your dedication. People criticize him for not stopping but at think he felt that would be giving up on his fight against his cancer if he stopped working. People should give him some grace, we hopefully will never know what he went through with pain and illness from his drug and possible radiation treatment. .

      I disagree; victims should not be incentivized to change their impact statements based on the possible sentencing ramifications. As far as I know they can testify in the civil damages case that is likely to follow.

      Apparently, Judge Boyd feels strongly about the VIS not being read until after the ruling.
      Her decision is based on the facts of the case, not the emotions of the victim/s.
      I’m not sure how I feel about this.

      i think it’s because something like that could come back on appeal and get her sentence overturned. Judge isn’t leaving any room for nonsense like that to happen.
      Judge has the full case file and medical.. She knows he’s hurt. And she has definitely factored that in, but if she hears compelling testimony from the injured party and deviates from the recommendation of the state and probation department a good attorney will eat that up and get her off scott free

    Why, oh why would this take SO MANY hearings? And HOW has she been able to go out partying, posting it on FB? Alcohol doesn't stay in your system very long so wouldn't she be able to pass UA pretty easily? Seems like Judge Boyd is being a whole lot more chill here than I've ever seen with a substance case....

      Alcohol stays in urine 3-5 days and in your sweat (which the SCRAM BRACELET tests) for 6-72 hours. The scram bracelet usually takes a reading every 30-60 minutes. So the defendant is hoping that her urine tests will be negative and then she can blame the positive scram reading on something else. Which, has worked several times for her so far, which is crazy.

    So she NOW admits she has an alcohol problem? So all the previous positive alcohol findings on her devices weren’t due to Lysol? (Like any of us believed that!).
    She is a compulsive liar and her apologies sound so fake. The only thing she is truly sorry for is getting caught and having her social activities curtailed.
    She should be locked up in prison for the horrible accident she caused.

    She has gotten off so many times it makes me sick. Here we are again getting off lightly our justice system is weak, bending over backwards for people who drunk even at the risk of the public. Our justice system is worse then any other country. She should be in jail for at least 93 days.

    She certainly does have a fake smile in court. I also believe she tells lies to keep out of trouble. Stupid people always make their lives worse with their continuing criminal behaviour. By hearing #3 I am positive she lies. I have never seen Judge Boyd so lenient. This woman led to a man being hospitalized for a month and who knows how he is long term.

    I always want to tell the defendants "Stand up straight! Stop Slouching! Hold your head up straight!" Sometimes the head tilt is defiant, sometimes it's simple laziness, and sometimes it's coquettishness. It's always annoying to me in a defendant standing before a judge.

    The scram devices can tell if it’s consumed alcohol or if it is environmental. So the perfume is a lie. They can tell.
    What shocks me is that judge Boyd let it go this far. Usually she is really strict, as she should be for felony offenses.

    Two plus years since the DUI…still can’t get in compliance. The second to last hearing , she was pissed that Judge Boyd caught her having a vehicle without the interlock device. She gave such a dirty look at the bench, but not at Judge Boyd directly.

    I believe our governments should find a way to assign cost to every case to include the cost of every hearing, the employees their wages, etc. That way we can see how much money we actually spend on something as Ludacris as this. Ms martinez should be required to pay all the cost associated with her case for the two years. This has been going on. She oughta have to pay back every penny that it has cost the taxpayers for this.

    You said they should’ve let him leave first instead of letting them pass and him holding the gate for her but I think she deserved to witness how gracious he was and what he looks like so his face is burning in her memories forever if she has a conscience. I also think he deserved the right to look her in the eyes and make her see him! He’s a much better man than I could have been! I hope he gets closure and everything good life has to offer and apparently his son was in the car also so he’s had to deal with what happened to him and his injuries but add being a dad on top of that and he’s better than most men and women I’ve ever met!     Mentioned it before, but there's a HUGE difference between the criminal justice system in the huge (very liberal) metro areas (Houston, Dallas, San Antonio, Austin, etc.) and the rest of the state of Texas. This is in San Antonio, so you get probation for a near fatal DUI case. If this happens somewhere else, like in Judge Stevens court, she'd be serving a long ACTUAL prison sentence. I live in Florida and had a friend of my family commit a nearly identical crime and he got about 4 years in prison.

    The only justice here will be that she won't make it through probation, and she'll end up in jail. As a Christian, I didn't appreciate her lying to the Judge early on and invoking the name of Jesus saying she didn't even drink. I realize denial is very real with both drug users and alcoholics, and I guess we can only hope she truly learns something. Meg, you sharing about what she has been posting on social media add to my feelings that she doesn't truly take any of this seriously. I pray for that poor man and his son that have suffer and will continue to suffer from this. So sad.

    As someone who works from home and often does not wear pants doing so, I developed the skill of putting on pants when the doorbell rings and also the skill of knowing when my children will be home from school and remembering to put pants on. If I care to. My children have seen me without pants many, many times, I'm pretty sure that's a normal parent-child thing. Like what do you do when your kids walk in on you changing?

    Interlock vs SCRAM. Scram gives you an immediate reading for alcohol use. Interlocks you can skirt by getting someone else to blow for you.

      You actually can't have someone else blow, it will get you violated at your monthly upload. They install a camera that takes pictures that are uploaded when you blow. At least they do in the state of Pennsylvania.

    After all those hearing dates she and probably her lawyer thought for sure she'd get probation and not go into custody. I agree 100% with the victim that she should've gotten jail time. Also, I'm not too sure the DA likes the sentence. I think she's going to violate because they've been lenient on her and she think she's gotten off easy.

    I wrote a huge rant cause I was so po'd but I deleted it because why give her any attention, even negative I'm so grateful the fiance posted, she is just as great a person as he is, they are lucky to have each other. I know people make mistakes, but the defendant is so unremorseful it made me cry. I had seen some of the hearings but hadn't seen the last goat odeo. Too bad court doesn't look at defendant's social media like employers do
