    Why is the state (Mr. Sibanda) asking if the defence team is going to bring Mr. Mjiyakho to come and testify? Why didn't the state include him in their witness list as he was pressnting accused no.2 when a confession was made before magistrate court Mrs. Cronje?

      And to add to that, the state on it it's case told the court they aren't aiming to Mr djiyako and judge also concluded that , that the onus rest on the state to do not call any witnesses .... now state closed its case now and sibanda try to play smart against defence by asking whether the defence will call djiyako? Maybe Mr djiyako will not come the state knows that.... coz they the state fails in this trial dismally

    Why did they keep on insisting Ntanzi had a heart problem. My takr is that they knew that the electric device they used on him could have damaged his heart . And also that if Ntanzi were to fie during torture they will state that he died because of that. If Ntanzi had not signed, he would have been tortured to death. They were covering their backs

    Somebody said ntanzii was in standard 10 he don't know english, even with me i passed standard 11 to promote to 12, i didn't know English , until i got work, nou i learned it bcz ilm working with english people! Don't laughing with others, we never be the same.😢

    These lawyers are a disgrace to the Black Lawyers Association. They're so unprofessional and unethical. How can you question the appearance of a fellow lawyer for the accused? In the beginning they were saying he had never represented the accused, now there's proof in the form of a charge sheet that he had indeed appeared for the accused, but they still go on as if they're fishing in a cup of water.

Do herebye nominate Mabunda Attorneys, constitute & appoint... and professional assistants.... than you write your address and date. There is no space for a next of kin as they are not the ones who will be represented at court. They can't even give him instruction, only you as the undersigned can do that.

    The state reason for asking if Advocate Mjiyakho will be called in as witness is
    " If he's not to be called, by mentioning his name and the participation in the case will be tantamount to HEAR SAY evidence and the court will dismissed Ntanzi's version"
    The state should get a fair chance to ask him "Mjiyakho" about his role as some aspects have been placed on record about him.

    Gininda offered 3m. Mjiakho told ntanzi he has a 3m deal with the police. Ntanzi said he never signed a deal
    Gininda says he did, if he did when was it presented in court. It must be presented in court and the judge will decide to accept it or not. Then sentence the accused without trial. So ntanzi signed a plea deal then pleaded not guilty. Still waiting for this to be unpacked

    That observation by the judge "that the witness (Accused No2,) understands English" will count against him because on several occasions he said he doesn't understand English...and the body language of the judge was telling....9/2/2024

      The judge was utterly wrong in his observation. It was the interpreter's mistake. It's even worse that the judge claims to understand all languages, but the interpreter is making a lot of errors. It also does not help that Ramosepele does not speak Zulu. I listened three times. He said ngiyezwa njengoba ungitshela, and the interpreter said I hear as it is read to me. The judge then said how do you hear cause it was read in English.

      Look at this scenario if Ntanzi terminated the services of 1st Attorney the 2nd Attorney should have present and that would have made it clear that 1st Attorney services where no longer required. If that was not the case, then he should have informed the court the Mijiakho no longer represented him and that he has a new attorney.

      Just to add to that I watch a court case the other day when I child sex offender fired his Attorney in open court and told the Judge that he will defend himself. The Attorney immediately packed his bookcase and left. Simply as that!!

    Mjiakho would not be helpful to both the prosecution and the defence in this case. None of them will call him in as a preferred withness. If forced to, both parties would try to get him declared as a hostile witness and then cross examin him.

    Mr Mjiyakho was introduced by the state in this court. Why Mr Mjiyakho was not made as a witness in court as from the beginning? Why now is Mr Ratsipile mentioned his name than Mr Tsibande want to call Mjikho. There is a lot of irregularities in this case. We as the citizen we waiting for truth. This battle is not going to end here. Judge Ratha got stigma over his head already for failing to conduct this case according.

      They closed their case without calling him. Which now leaves it with the version of the accused regarding the discussions with him unchallenged. The court will have no option but to accept that he did not have instructions and he wasn’t acting in the best interest of his client(s)

    Nthanzi and his defense team should have paid special attention on how to navigate the Magistrate's confession. The magistrate and woman interpreter are also being implicated as complicit by Nthanzi's responses. There is a recording of the confession that the magistrate could use to clear her name. She does not need the courts permission to publicly broadcast the recording as she was party to the discussion. Especially since the headlines will be accusing her of complicity.

      I agree with you. If he could proof that one of the people that took his statement illegally it will have an impact on his case but to say that everyone that interacted with him was lying. He now placed himself in a very difficult situation. The Dentist have signed a hypocritical oath and Mrs Cronje is a Magistrate. I would assume that both these individuals won't want their reputation as well as their careers be jeopardized. Plus, there was a court interpreter with Mrs Cronje as a witness for the State. He had ample time to make Mrs Cronje aware of the abuse and he didn't. If his hands where raw and scared with fresh wounds no Justice of the Piece will take your statement as you could be hold criminally liable for gross neglect of their duties as a court officer of law.
