    Hi, I think you should seriously do a video about naturalization or citizenship application for VAWA permanent resident card holders who want to apply for citizenship and how they should fill out the N400 form, this will help alot because I have a friend who got permanent resident under VAWA and now want to apply for citizenship and it will be helpful to see a video about how to fill the N400 form correctly.

    Good morning Attorney McBean , in my case , there was abuse in the marriage and we separated. Then he served me a divorce, while I was sick and incapacitated in 2016. I was unable to follow up and even though I called the Supreme court several times, they were not willing to give me any information , unless I was there in person. I was unable to do so until last year , 2020. Now I tried to file VAWA and I am told that the waiver that allowed victims of domestic abuse to file , more than two years after the divorce has been removed. So I don't know what to do. What do you advice ?

    what if you're playing child support? Will it be included in the poverty guideline? My tax attorney says no, so my household is only 2, not 4 (have two daughters). This is because they don't show up on my taxes because I don't claim them as dependents
    However, my immigration attorney said yes because I'm paying child support in that it doesn't matter if I claim them as dependents or not (which I don't).
    My child support attorney said she has no clue.
    Which one is it?
    I know a couple personally that uscis denied because of this reason. Same situation.

      Whether the children show up on your taxes or not, they are still part of the poverty guidelines if you have to pay child support for them. Those children are counted as part of your total household members for the calculation.

He is not eligible to become us citizen yet until 4 yrs. I have daca , lawful entry thru A/p, got daca at 16 and never let it expire . ?? Thanks

    if the US spouse after filing all the forms refused to go to the interview appointment and after that she disappeared and the husband didn't know where is she lives, if he get divorce for that
    reason can he file for Vawa to do self petition ?

      uscis might suspect that it was fraud to begin with if you don't know where your wife lives. That will be a huge red flag

    Due to the numerical limitations on immigrant visa issaunce prescribed by law, this petition is not eligible for further processing at this time.
    The National visa center ( NVC). Will retain the petition until an immigrant visa becomes available. The NVC will notify the petition is eligible for further processing. The principal applicant should not make any firm plan such as disposing of property, giving up jobs, or making travel arrangements at this time.

    If my ead has expired can I work with 180 extension
    I am not allowed anywhere I apply
    I was laid of also from previous job as it expired

      Yes you should be able to work with your 180 days extension.

      May I ask you. I recently tried to apply for another after I was laid off. But in process of all going on I have lost my expired ead. And is waiting on my renewal and is hopefull.
      But I have my 180 extension letter my social and my DL which is valid. But it seems I can’t without the ead I have lost
      Reason I don’t Wana request a list ead is because I am about to receive my renewed one but just Wana start work earlier to STart pay IRS back.
      I am in OH May I contact a attorney out of state.

    If you go to a green card interview and spouse words doesnt match up with you and they denied you what step could you take forwards

      Hello, if USCIS has problems with your answers, they will inform you in writing and ask that you provide an explanation for the inconsistencies.

    I petitioned my husband and he got the permanent visa. But he came and treated me like trash and wanted to leave me a day after he got here to Ohio he wanted to go live with friends in New York. So he left 8 months later but I found out he faked the marriage. But I already reported everything to uscis but as of yet I have not heard from them what can I do?

    I have a question please I’m in the us with a pending asylum, got married and my spouse filed the I-130 for me. We have filed going on 9 months. But now my spouse is getting ready for active duty. What if we are to go outside the US what would be the case for us and our son please.

      They’ll expedite yours… but have your husband contact the active duty immigration. I am an active duty Soldier and have been through similar position.

      Yes they gladly expedite cases for people in service, you can even apply for citizenship without waiting 3 yrs based on the fact that you are a spouse to someone in service, take advantage of the perks

    I was married for 26 years, 4 children out of that marriage, then I was divorced for five years, just recently became US citizen at age 47, my process took one year and interviewer was really pleasant.

    I was married to a USA citizen for 8 months.Our relationship went south,and we got divorced and was advised to withdraw the petition. What I was told is that,if you get divorced before the marriage interview,then you are definitely screwed.If you get past the interview,you can still continue the process without your spouse. I received notice after I got divorce to leave the country in 30 days. I am still here in the country and haven't heard from immigration after 9 months.They probably didn't place me in removal because we withdraw the petition.Or they still might do it,but who knows when!
