  • there was no legal warrant and the police turned up because he said i was being aggressive. all i said is remove your foot from my door.
    then the police allow him access to the property of which there was 2 children under 10yr and a heavily pregnant wife who went into 2 month premature labour shortly after this.
    the first thing the bailiff done was go upstairs and scare my daughter. then proceeded to go through to any room and look into drawers and cupboards for belongings.
    i have never felt so powerless in my life. because of a tv licence.
    WE don't even watch tv. we have a tv for netflix and gaming which you don't need a licence.
    once i borrowed some cash from my mother in law and a friend the bailiff was actually an ok bloke but it was the manner in which he conducted his job. i have previously paid 3 bailiffs in the past 3 months over £3000 and i would have paid this guy if he wasn't so aggressive.
    my daughter was crying and my wife was having a panic attack. it felt like i was being robbed with the aid of the police, the bailiffs are using the police as authority to enter when in fact the warrant is not worth the paper it's written on.
    it seems like if you pay 1 bailiff then the rest will come after you.
    i have been bleed dry over the past few months and yet another is breaking into my home.

      Do not open the door! Tell them you have contacted their employer and removed their 'implied right of access. A Law abiding citizen being caused distress and alarm? The tresspass, harassment and threat of financial loss with removal of private property is more of an attempted robbery and extortion then it is lawful? Look how ridiculous the system has become! If it no longer represents the people then it's a broken system! We must now learn to represent ourselves and each other. Left unchecked, unregulated and unchallenged it will become a monster that will eat us all!

    My house was burgled and the police said they didn't have the resources to attend and investigate. Yet 3 officers can assist a bailiff because someone hasnt paid their TV licence! Says it all!!

      @@rybelknap - everyone , well , every household , has to buy a TV licence , currently about £200 per annum , and that pays for out BBC - you have PBS and a similar radio service . So , the BBC , TV and radio , is advert free . Over 75s are exempt . If you don't have one , you get a letter every 2 weeks or so - ''we're coming round '' '' detector vans (!) will be in your area soon'' , etc etc - constant f drama . they have no right of entry , nor need you speak to them . However , premises with a ground floor (you call it first floor, i believe) , they can take a photo of a tv through your window , wva - then it gets complicated . However , everything he says , about a wet signature etc on the warrant is true - his mistake here is going to court in the first place - not sure actually , this case - he should have been able to quote Section 5 , sub paragraph 3 etc / wva , at them . Hey ho . Anyway , ging out now , no offence - best wishes .

You don't have to let a bailiff into your home for any reason, they are never given warrants to enter a home, you are well within your rights to obstruct them and the police are not allowed to help the bailiffs. That's the law as it has been for some time now. Now if you did let a bailiff into your house, then that's another matter.

    I'm a 56 year old retired police officer with 29 service. I also possess a English law degree (LL.B). A bailiff acting under a CIVIL court judgment can NOT push past an occupant who refuses entry at an open door.
    THIS IS NOT PEACABLE ENTRY! THE BAILIFF HERE IS ACTING UNLAWFULLY.
    However, the warrant issue doesn't need a signed wet signature. That's getting into straw man law and is total rubbish. Providing a warrant / order exists and was issued by the court it doesn't need a wet signature at all.
    What concerns me more here is that these police officers seem to be totally ignorant of the relevant laws on bailiff entry. It is worrying that they appear to think it's their job to directly assist the bailiff and obtain identification. You don't have to say anything when arrested so you certainly don't need to say a word to anyone in these circumstances.
    This bailiff was in fact liable to arrest himself here because he committed assault and battery by pushing himself past the occupant who lawfully refused entry. He can only be invited in (PEACABLE entry).

      @@garymacro8724 With respect it's unlawful to obstruct a bailiff in the lawful execution of his duty when acting for a court. The bailiff here is treated as an officer of the court BUT - it follows that if the bailiff is acting OUTSIDE the law or by using unlawful force or entry it's certainly NOT unlawful to resist using reasonable force. The bailiff here should have been arrested by those clueless police officers for using unlawful force to gain entry.       They’ll need to show you proof of what you owe and a 'warrant' or a document called a ‘writ’ from a court. Check any documents are signed and in date and have your correct name and address.”
      So does that not mean the bailiff was within his rights?

      You are forgetting that they like to tell people the TV licence is needed even if you don't have an aerial connected to your TV. They lie and threaten people into getting a TV licence targeting any address that is not in their database of paid "customers".
      These people are so dishonest that they had an campaign of lying to people in adverts about "advance technology" that had that could detect if you was watching tv and then followed up by sending people in vans to look through peoples windows to see if they could spot a tv in use.
      That is scummy, not giving you money to people like that is completely understandable.

      by a judge not a court clerk... it has to be of wet ink and within a few hours of signing it it can be executed. no judge will sign one therefore all the ones you will be shown are not legal. do not leave any doors or windows open and dont let them in. if you see someone at your door that you dont know leave them outside... leave your vehicles parked elsewhere....

      @@bb-ballistics1706 I presume because the arrangement is too convenient for the BBC, and too inconvenient for users to opt out of of - few people who own a television for whatever reason but refuse to pay are never going to resist the temptation to flick onto public TV for even a second. Considering the BBC makes between 3-4 billion a year from fees each year, it's still a very viable system. To most people, it's probably easier to just treat it like a small yearly tax.
      An imperfect system of course, but there is no inherently good one; you either opt out and never use their services, pay a small yearly tax to watch public TV, or watch public TV for free with corporate and political ads shoved down your throat.

      When my mother's home was broken into (they smashed the kitchen window frame and glass. It took the police two days before they visited her. The neighbours secured the window for her. She was so frightened that she had my brothers fit bolts to all the doors on the ground floor, so that anyone breaking in could not leave the room , into which they had broken. She went around the house, before she went to bed to make sure all the doors leading to the hallway were bolted shut.

      We did not see the warrant, but 3 police officers did in detail and approve of it. The debtor would only be detained until the bailiff had successfully executed the warrant and removed the goods necessary to satisfy the debt. Because the debtor was not assaulting or being overly aggressive, the likelihood is he would only be detained in the police car nearby and released shortly. If the debtor hit or otherwise assaulted the bailiff, the situation would escalate and end up in more serious consequences to the debtor including going to jail.

    *I AM A POLICE OFFICER* just to let you know, if he comes back, even if he has a warrant, you dont have to let him into your house, they can only come in if you invite them in, or through an open door or window, but once there in your house, they can get to things by breaking locks, doors etc.

      Moon Pie yes. The licence fee doesn't give you cable, it gives you over a hundred channels over the air. You can get cable, which has more channels and is higher quality but that is a separate service.

      yes they got the same tv tax (NRK tv license) in norway but around 350 pounds a year. and in sweden you even have to pay it just for having internet so you dont even need to have a tv but still needs to pay it around 150 pounds a year. at least in norway ppl can block the tv from reciving tv broadcasts and then you dont need to pay the tax. but they all still show up on the door if they suspect you of owning tv without paying tax, here in norway they even go further because when ppl buy a tv its registered on a name because they demand name and adr from an ID and then those tv shops send those names in, so noone can get away unless you get someone else to buy it or used. or if you know the ppl selling it and just register wrong names.

    2.02-2:07 that dodgy bastard grabbed that warrant from the sweet lady cop (while she was still reading it) & PUSHED his way inside, knowing damn well he had to already be inside the home BEFORE the other cops showed up. The male cop later (around 5:54 & on) explains that "he's already inside the property" & can execute that warrant. They consider THAT "making peaceful entry"!?? THAT'S SOME B.S.! SMH

      I believe hes implying that anybody with a printer could just print of any old shite since nobody really knows what a warrant looks like that claims they can enter your home. A signature from someone in authority should be on every warrant that implies access to a property, and should certainly be on one that grants rights to force entry. The government need to make changes to warrants to make it clear on what power a warrant grants, and should always be signed by an authority that is liable for decision to grant it.
