The man is a literal genetic freak who because of several mutations has a massive advantage over /every/ other swimmer, but no one has ever said he shouldn't be able to compete. 'Fairness' in sports is arbitrary at best
Because the women's division is the handicapped league for people who didn't have the advantage of a male puberty. They don't need a rule to keep women out of men's sports. None of them would make it. The men's division is the absolute league.

It’s not an equivalence and it’s not a categorical comparison, it’s pointing out the fact of life that physically humans vary in a way that fairness in sports will always be /at best/ arbitrary. 99% of people don’t have the physicality to compete at a profession level in one sport or another just inherently but pretending like it’s discriminatory to point out different people have different physiology and that doesn’t just correspond to sex is the actual snowflake take. I hope you realize that virtually every professional athlete you see is a ‘fringe case’ because mediocre genes just aren’t good enough for top level competition.
