  • For centuries, the world has sought means to make war less barbaric-and even though the record isn’t great, many believe the small gains made are better than nothing. Last week, the International Criminal Court prosecutors broke new ground by seeking warrants against Israeli and Hamas leaders for war crimes.

    First, peace will prevail when hostages are released in Gaza. Secondly, two states solution is possible when two sides are willing to accept each other's existence. Third, freedom will come when internal democracy is established in Gaza and West Bank with free speech and dissent. Fourthly, nationhood requires working with discipline and diligence and cooperation with neighbours. Fifthly, ICC should have known that Israel can't be seen to give up on its hostages. Sixth, if Ireland, Spain and Norway wanted to be helpful for peace they should have persuaded hamas for release of hostages and then recognized Palestine.

    Peace, first thing first. Peace will prevail only when hostages are released and freedom when internal democracy is established in Gaza and West bank. Nationhood requires working with discipline and diligence and cooperation with neighbors and not violence and intimidation. Palestinian state will be established when they accept Israel too. Simple.

    Law concerns itself with law - not ethics. That's the positivist view. Natural law, on the other hand, maintains that some rights and protections exist "naturally" and can't be overruled by legislators. After WWII the core rights from Natural Law were incorporated into the legislation of most countries and into the UN charter. Should we fear the ICC, the internatinal law or ourselves?
    I'm also from a citizen of a former European colony, btw. IMHO, as far as international law holds the principles of the UN charter, I have no reason to fear the ICC. My country has done things that would be considered war crimes and has attacked its own population in ways that go against the UN charter principles. We are taught about those things in school and there's no sugar coating.

    Western countries often assert that their soldiers do not need to be subjected to the International Criminal Court (ICC) because their domestic judicial systems are robust enough to conduct trials independently, without the need for international oversight. However, there have been instances where these countries have not followed through with such investigations, as seen with France’s actions in its former colonies and Syria, the UK’s military actions in Iraq, Afghanistan, Syria, and the activities of British mercenary groups in Africa and Yemen, and the USA’s military actions in Iraq, Syria, Afghanistan, and Yemen. Investigations are initiated but not always concluded, which can result in soldiers not facing any consequences.

    Sir,
    Relevance of I.C.C. will always be questionable as long as the hegemony of some powers exists. Please also note that it is not limited to just I.C.C. but other institutions credibility are also at stake like UNSC etc.
    Impartiality never existed in the world politics, therefore, I don't have any hope and, therefore, relevance of these institutions will diminish day by day.
