Hii sir, I got married on 7 may 2018. My wife stayed with me till august 2018 at my house. Then she left my home and went to police station with her father and filed a false complaint. She said I assorted her physically and mentally for dowry, and I beated her very badly. After that I was called to police station and police officer psi waghmode started pressuring me and said accept that you harrased your wife for dowri. After that my wife said if you want divorce from me provide my rs 10 lakhs so that i will divorce you. After that i managed to convince her and said we will saty seperate at new home. So I took a new home on rent paid all deposit, one month extra rent to broker, bought all new household things which required for home. After that my wife says she doesnt want to stay with me. As she is now not intrested in me she doesnt want to have physical relationship with me, now her father is blackmailing me and asking for rs 5lacs I am totally cornered, from last 6 moths i am suffereing this torcher, I attrmpted for sucide but still my wife doesnt understand my feelinfs. I think Police should directly investigate without arrest.. Otherwise, it can be misused by both men and women If they are powerful.. or Supreme Court should have given order to appoint Judicial officers (with some powers too) in the Committee instead of the so called village head or such people like that..

The law should change. For stopping the alimony system and dowry system and the misuse of the laws, there should be a law that women aren't forced to leave jobs after marriage, which happens in most of India, and it should be under civil case, not criminal case. Women shouldn't leave the workforce (other than temporary reasons for children, changing jobs, starting her own business, etc.), secondly women have full permission to visit her natal home. Informing husbands and in-laws is enough, taking permission is not necessary. And for child support reasons after divorce, if child stays with one parent, then the other parent can give child support only, when he/she gets visitation rights !!!

This provision helps the court to get the genuine cases and solve the case .In fact, this prevents time . The staff committee and special force officer act as filter to the cases and helps the court. The privatization of police functions differently depends upon the area but majority of the cases are solved but it takes time . Therefore, these intermediary groups are very necessary and reduce the false cases .

Simply tell that there is no use of 498A because it was already weak I suffered a lot and suffering a lot but since 2014 there is no summon for me even I filled dowry after counseling but nothing has happened. All are currepted. I don't know what is going on in court. And it is also true that because of some girls real victim will suffer.

1) Morale is the answer. Because, 2) jiska koi nhi hota, uska Bhagwan hota hai. As a law student, theory of guided powers should be primarily applied with a combination nation of facts and the arguments of both the sides should be closely monitored and recorded so that finding contradiction on the mala fide party's argument can be easy.
This reform is good.Atleast both the parties can be cross examined by the commitee instead of facing each other in the court directly.If the complainant woman fails to provide evidences at this primary level, then there will be no FIR,hence less cases in the court.

First of all, very well explained. Good and unbiased video. Keep it up! These are my view: 1. Supreme Court cannot treat a normal crime and dowry related atrocity crime likewise. Grave physical injury or death is treated without interventions! What about mental injuries? Homely affairs are emotional deeds, Mentally pressurisation by husband should be added as that’s equally grave injury, though not physical on external body. Challenge would be - how to gauge mental injury? It’s possible, but may not be possible in every Indian city/state. In any case, a better judgement would have thought of it. 2. Home crimes are inside 4walls, so its logically wrong to ask women to bring specific proofs for each claim before any action is made. Court expects them to put CCTV cameras inside house? or wire tap the house? Or get a good beating before filling a complaint, to showcase the marks as proof! It would have been better to have the action still there, but with grave consequences if proven otherwise. e.g. seize passport, but then some provisions for the husband to apply and get it back and ensure action on the woman if it comes out to be a misuse. Again a very trivially thought decision by Supreme Court. 3. Finally I see it to be an easy route what Supreme Court could take, because of shortage of efficient judges and huge number of cases. They outsourced it! at least the initial crucial steps so court doesn’t get bother of majority of the cases, genuine and ingenuine. They have added a layer of policing, an Indian institution which itself is marred with patriarchy thinking. They should at least defined some rules around it, like Only a special women police officer could investigate the case and in Family welfare committee 60%+ should be women. Committee should have new members every year or two, and any member not serving more than 2 years. If not possible at district level, could be at state level but with more number of members. At any time Each case should be heard by at least 5 members, again out of which 60%+ should be women. In the end I feel this judgement by Supreme Court is very naive, quick and easy runaway from a problem which has marred our society since ages. This issue is very grave and should be handled separately as it affects the ground stone of our society - the dna 🧬 of the families. Instead, court just shrugged its shoulders asking the woman to go to police and committee and get a proof of your injuries!
The provisions which are issued by the sc are really appreciable but there should be include strong provisions for the role of police and welfare family committee so that they work honestly without privatisation

Cancellation of registration certificate of advocates should be made compulsory who advised women to file false 498a cases and has tried to establish false complaints.
It is an important topic to be discussed properly because by including family welfare committee and special police officer we can't say that false cases could be stopped. There is a need to amend section 498A so that the misuse of it could be stopped. Like dowry this 498A law has become a curse in the society because of it many men are living a depressed and worst life. They are afraid and surviving in a critical situation. so being a citizen I think this law 498A needs improvement so that genuine cases could be solved and can get relief from such crimes.

Just few years back I had same feeling about India like you ,hamara pyara Bharat.
Misuse won't stop until there is a strict punishment for false accuser.Any other step won't bring any impact.
The law should change. For stopping the alimony system and dowry system and the misuse of the laws, there should be a law that women aren't forced to leave jobs after marriage, which happens in most of India, and it should be under civil case, not criminal case. Women shouldn't leave the workforce (other than temporary reasons for children, changing jobs, starting her own business, etc.), secondly women have full permission to visit her natal home. Informing husbands and in-laws is enough, taking permission is not necessary. And for child support reasons after divorce, if child stays with one parent, then the other parent can give child support only, when he/she gets visitation rights !!!

This provision helps the court to get the genuine cases and solve the case .In fact, this prevents time . The staff committee and special force officer act as filter to the cases and helps the court. The privatization of police functions differently depends upon the area but majority of the cases are solved but it takes time . Therefore, these intermediary groups are very necessary and reduce the false cases .

Simply tell that there is no use of 498A because it was already weak I suffered a lot and suffering a lot but since 2014 there is no summon for me even I filled dowry after counseling but nothing has happened. All are currepted.
I don't know what is going on in court. And it is also true that because of some girls real victim will suffer.

This reform is good.Atleast both the parties can be cross examined by the commitee instead of facing each other in the court directly.If the complainant woman fails to provide evidences at this primary level, then there will be no FIR,hence less cases in the court.

First of all, very well explained. Good and unbiased video. Keep it up!
These are my view:
1. Supreme Court cannot treat a normal crime and dowry related atrocity crime likewise. Grave physical injury or death is treated without interventions! What about mental injuries? Homely affairs are emotional deeds, Mentally pressurisation by husband should be added as that’s equally grave injury, though not physical on external body. Challenge would be - how to gauge mental injury? It’s possible, but may not be possible in every Indian city/state. In any case, a better judgement would have thought of it.
2. Home crimes are inside 4walls, so its logically wrong to ask women to bring specific proofs for each claim before any action is made. Court expects them to put CCTV cameras inside house? or wire tap the house? Or get a good beating before filling a complaint, to showcase the marks as proof! It would have been better to have the action still there, but with grave consequences if proven otherwise. e.g. seize passport, but then some provisions for the husband to apply and get it back and ensure action on the woman if it comes out to be a misuse. Again a very trivially thought decision by Supreme Court.
3. Finally I see it to be an easy route what Supreme Court could take, because of shortage of efficient judges and huge number of cases. They outsourced it! at least the initial crucial steps so court doesn’t get bother of majority of the cases, genuine and ingenuine. They have added a layer of policing, an Indian institution which itself is marred with patriarchy thinking. They should at least defined some rules around it, like Only a special women police officer could investigate the case and in Family welfare committee 60%+ should be women. Committee should have new members every year or two, and any member not serving more than 2 years. If not possible at district level, could be at state level but with more number of members. At any time Each case should be heard by at least 5 members, again out of which 60%+ should be women.
In the end I feel this judgement by Supreme Court is very naive, quick and easy runaway from a problem which has marred our society since ages. This issue is very grave and should be handled separately as it affects the ground stone of our society - the dna 🧬 of the families. Instead, court just shrugged its shoulders asking the woman to go to police and committee and get a proof of your injuries!

It is an important topic to be discussed properly because by including family welfare committee and special police officer we can't say that false cases could be stopped. There is a need to amend section 498A so that the misuse of it could be stopped. Like dowry this 498A law has become a curse in the society because of it many men are living a depressed and worst life. They are afraid and surviving in a critical situation. so being a citizen I think this law 498A needs improvement so that genuine cases could be solved and can get relief from such crimes.
It is a good step taken by S.C. Because i see many People of my area faces a false case of dowry.
