    i wish i saw this earlier. my son signed a lease in windsor and made a down payment for the first and last month. we needed to cancel and told her within 24 hours and yet she refused to refund the money. we went to ltb but they did nothing. we just got the key fee back but they still allowed her to keep the first and last month. how is this fair? i mean we cancelled within 24 hours and still nothing was done. it makes no sense to me how they can hold you accountable for something like this.

    We have a rental property ; and tenant agreement is going to end on Dec 15th,2022. Considering personal circumstances, we have decided to move in to the property ; hence we have issued N12 form three months before the end date of the leadse agreement.(September 15th,2022). They were oaky with it. Last week, Tenant came back to us for the compensation ; hence, they gave an option not to deduct for last two months. I wanted to check with my realtor and paralegal, before I confirm on this .. Today, I have responded that I am okay to pay compensation. However, we gave an option . i.e.., In case if they are okay to continue to stay as a tentant, we will cancel N12 and they can proced with their lease on month on month basis after Dec 15,2022. If not, we will be moving in to the property for our own use. Is this a bad faith? I haven't forced anything here. We just send an email comm stating the additional option. Please advise.

    Im curious how you dealt with lawn cutting / snow removal for your rental townhouse. Is seems like its always a grey area on who’s responsible for doing it …

      You put that in your lease. I give my tenants the choice. If that is my responsibility I raise the rent by 100.00 but if they want to do it they can save 100.00. Be sure to put in the rent agreement who is responsible for what.

    So you rent out the house for a couple months. Make a buck. And move back in when/before the market is flooded/your financially stable. Your fake reason: my dog wants a backyard.

    My advice as a landlord in Canada. Stay hungry but don’t rent out any property

    Hi Tom, the tenants didn't move out at the termination date what is on the N12? so did you pay them the compensation for their moving out?

    How long did it take from your hearing date did it take to get the Tribunals decision mailed to you?

      About 2 weeks.

      We won and moved in. This was in 2019.

    What you said about the tenants not wanting to move out for any other reason other than not wanting to move out is most likely completely inaccurate. They were renting your home because they probably had to rent and could not buy a home. They didn’t think you’d want to want to evict them and move back in. Tenants have rights to not leave because you serve them an n12. It is nice you gave them 90 days but still tenants have rights to go before the tribunal to make sure you are not going to get new tenants and charge much higher rent. It’s scary times we are in for renters. Hope it works out for everyone.

      Hi, we won the case and the tenant was given 60 days to leave by court order. I’ve now been living there for the past year.

      @@TomStorey I've been both a tenant and a landlord. What you described here isn't easy for anyone. I'm glad you got the result you wanted, and I hope the tenants found a place to call home.

      They continued to pay rent, they just refused to leave at the time.

    Hi Tom - I’m going through the same here in niagara. Your conclusion segment of the video was inconclusive as you’re still waiting… How long did it take for the N 12 to get completed?
    I filed seven months ago and still haven’t heard anything back for my L1 and L2.
    Would like to hear how it did end up in the actual conclusion. Hope it resolved well!

      Hi Trevor,
      Sorry you hear you are in a similar situation. My situation was resolved. After filling the L2 I got a court date about 3 months later. This was before the pandemic. After I presented my side in court, 2 weeks later the tenant received the eviction notice and had to be out within 2 months. I was still a long process, but it ended up moving in December of 2019. Make sure you read all the forms and consult with a real estate lawyer, as they are very picky if you miss one small thing. I'm guessing it's taking longer these days as they have been backed up since the pandemic started. Hope your situation gets resolved soon.

      @@TomStorey Thanks for the reply and info Tom... Things are definitely different after the pandemic and a far cry from how 'fast' your situation got resolved. Did you have any justice with getting repaid the stolen rent? Selling your debt file to the collection agency? etc? Cheers

      @@TomStorey so before all that did you give the tenants N4 form and did you simultaneously file with the LTB as well or did you wait two weeks to do that?
      i guess the next step is to file L2?

    From a tenant perspective. You have the resources to get into investment real estate in the first place. Many tenants do not have that opportunity, so will fight to stay in the home they're renting by default. Recently, my REIT apartment complex converted to condos with each unit now having a private owner, so this potential situation has become a reality to me (whether legit or bad faith). I have been here a decade, I have ZERO control over what the imposed rental increase % will be each year, so my unit is currently well below market rent, and un-renovated (not a nice investment for someone taking out a mortgage to get into the game, I admit). I now feel my days living in my apartment/condo are numbered and with my health, being evicted could kill me. I recently received an N4 for non-payment of rent, even though I paid in full and on time (bank proof sent to landlord and N4 now void - still not entirely sure what happened). So, please remember to consider how this affects the tenant as well. I now have to live in fear that I might get bullied out of my home and the N4 really caused a great deal of concern. And if someone says, 'Just move then...' Okay, where? I'm on ODSP - would anyone honestly rent to me at a rental rate that I could afford? This is why I would fight. Sometimes, it's a matter of survival and not spite.
    Tom - I'm glad your tenant continued to pay rent during the eviction process and that you seem to respect them in return, despite them not wanting to move.

      You are an exception. But you can’t blame a landlord for being able to buy a condo because he worked hard to have that opportunity. A lot of tenants are happy living off the system. Seriously a lot of my tenants get government assistance to pay rent but they still don’t pay. Then when they have to appear at the tribunal they leave before the date. I’m not a landlord by choice and I recommend that no one gets into it unless they are rich enough to hire property managers and stay out of day to day affairs.

      It's not your place when you are renting. Getting comfortable in a place you don't own is a recipe for disaster.

      No, but I did win in court and they where officially given 2 months to vacate.
