until courts stop granting maintenance to wives left and right without any liability on her, without any time limit, men have to come up with new ideas to avoid maintenance.
Did you know that CrPC 125 law only granted maintenance upto Rs 500 ? SC removed this capping and made a mockery of law. Even if married for 1 day, even if wife has occasional illicit affair, even if she is causing domestic violence, still wife will get maintenance. That is how biased our laws are

Sir thanks a lot, all points are logical and make complete sense, one different perspective is if we say in the court that we are paying maintenance to parents then wife may counter if parents getting maintenance then I as wife she is equally eligible for maintenance and should get paid accordingly. Since there is no standard rule of formula to calculate maintenance (apart from 1/3 or general rule) court may allow the maintenance to wife also accordingly even if it increases from 33% ( may go upto 50% in total both to parents and wife) . I still believe that this strategy is still a win win to husband because any which way it is evident that have 2 liabilities and hence wife will definitely get lesser amount if another maintenance to parents is claimed.

Si I am really very impressed with your guidance which be very useful and help ful . I am retired from IAF consisting of my wife , two daughters married one and a son .My son is working but a matrimonial case is in proceeding . Court ordered very heavy amount without considering other liabilities of my son . Pls guide me that shall me and my wife file a case for maintenance from my son . If the husband has become unemployable, not of his own making, and the wife is employed, the husband can get maintenance by reason of Art 15(1) which has to be harmonised with Art 29(1). It confers a right to conserve culture. If the community culture does not contemplate a divorce, the custom can be considered over-ridden by legislation because Art 13(3) includes custom having the force of law as law for the purposes of Part III Fundamental Rights which are all taken from the Universal Declaration of Human Rights ,1948 to make a departure from blighting societal practices of the past centuries.

After 9 months of decree of divorce i got remarried i have girl child from second marriage. Even after getting visitation rights from court to see my son born from first marriage ex-wife threatening with false allegations that she filed appeal after divorce 8 months she wants to come back just for sake of revenge. I legally got married after 9 months of decree of divorce. She completed mtech in computer science. What should I do?

Sir in interim maintenanc case, what are the prime face evidence such as she is not my wife, her divorce was not done or marriage by fraud, which husband can request to court to discuss before ordering it. Please advise & it wil be great help if you can create a video on this
if your wife was married earlier and got re-married with you without divorce from earlier husband and hide this information from you then, its a VOID Marriage.. if you can proove that she was married earlier before getting married to you then you do not have any liability to maintain herself as your marriage is void marriage. However if you have kids then you may probably have to maintain then and court will allow maintenance for kids. You should file a case against her to declare the marriage as void marriage under HMA specific sections for void/voidable marriage and under CRPC 420 as well.
