As law student my Question is :- Suppose husband do adultery or cruelty and wife left home permanently. Court don't give conjugal restitution as wife prove reason of seperation. Wife don't want to give divorce and don't want to live with husband also . Can husband ask for divorce based on any section of HMA ? As husband can't marry another women to led happy life in long run or he have to live like vidur for whole life without having children.

-Wife has no reason of departing
-Wife wants divorce
-Husband doesn't want divorce
-Husband is eligible for divorce as wife is not joining company from one year from the date of sector 9 decree.
- can wife get divorce on the ground that, husband has got section 9 decree and she didn't joint her family? .....
Question is .....
If any one spouse gets section 9 decree and the other spouce doesn't joint the company till one year , in this case both parties get right / decree for divorce? Or only the party who had filed section 9 decree becomes eligible for divorce?
