First big one is that EU Responsible person is optional for eBay. Secondly you can put your own company as manufacturer if you do not have this information. You can also use generic templates for things such as user guide or warnings - for example “product has no safety warnings under normal use”.
I almost reached a point where I rather only export to countries outside Schengen to avoid problems which is totally absurd. GPSR is killing thousands of small online sellers who make a living from it and not everyone can switch to only export. At this point I am about to write some letters to the guys in EU Parliament so they maybe notice something. We should encourage everyone to do so, too. So they see how dramatic the situation for small sellers is. At this point I really have some questions who in the EU put pressure on this regulation and who is really behind those? Who is really profiting from this? Big companies maybe? I smell something I wish I could proof. Maybe time to inform some investigative journalists at this point because it somehow feels like a concerted strike against small businesses as a whole. It is a really neat way to avoid competition coming up.
I found this when a GB supplier refused to ship to Northern Ireland and they reversed their decision and supplied. They stated "courier costs" as their excuse when first refusing.
The UK Equality Act 2010 (England, Scotland, Wales & Northern Ireland) protects you against discrimination by businesses, traders and other organisations when they provide you with goods or services. It doesn't matter whether you pay for the goods or services, or if they're free - the trader or service provider still must not discriminate against you by race, religion or LOCATION within the United Kingdom.
@ the final goal is: you will own nothing and be happy. I saw over the last 5 years the complete takeover and people lost their job due to regulations, certifications and rules applied by EU and government. The job of my father was forbidden and now my business is forbidden. Forbidden means regulations and economic rules which finally spin down your income and customers are unwilling to pay.
It will be too little too late for many but Ebay must react in 2025 when they see their sales fall off a cliff as UK sellers turn off Europe and Northern Ireland post 13th December 2024. Until then I don't think they themselves know what to do or see this as a priority. Probably focusing resource on upgrading software that adds no value to sellers. They do appear to be very remote from the real need of their customers!!!! Good luck and I hope you have another income stream until they react and start to engage meaningfully to save their business probably around end of Q1.2025.
you will see many shop closures. the EU regulations are far too high and it is about destroying the used equipment market in favor of the big players owned by Blackrock.

Better to go into Revenue in person firstly it’s on O’Connell street and once you get a pps you’ll always have it. Then that’s you done, it’s all online.
Not surecwhat to say but this is totally ridiculous, how can u tprove anyhthing with a second hand sale im completely baffled. Ebay what are youhdoing i know this is completely dedicated by the law but jesus Christ work some solution around this and speak to these sellers 😢😢 where is the support he has a maasive shop f f sake what do the rest of us do?!
Only for goods, not for services. Ebay is selling a service (access to their platform) and most ebay sellers as selling goods. Welcome to the disconnect!
I cannot see how ebay would treat you as an Irish seller when you are not in that country. This was a waste of time, politicians (and often legal people) do not understand this stuff. If you process goods (say relabelling) you are not placing them on the market Under the Windsor framework you can label products as "not for EU", when for sale in N.Ireland. However your problems you have highlighted before are transitional issues with the regulation and as you say will eventually apply to the UK. Ultimately the new regulations only apply to goods "first placed on the market" before the December date. Ebay need to accomodate goods that are outside the new regulation. Used or older unsold goods that are not compliant with the new regulation do not need to comply with it. (see art 51) Where your company is does not matter to the product regulations that you have to comply with, it is the region in which they are sold that matters to what regulations they have to comply with. Additionally you need to be careful of goods that might have been sold as commercial only products and you are selling them to consumers. GSPR does not apply to commercial only sales.
that is not right. important is the time you offer it the first time in your shop. If you sell them from another shop then there is no problem. If it sits in your attic and you offered it with an existing ebay offer - no problem. but if you offer them them with a new ebay offer starting 13.12. then you have a problem. Same for used equipment. If the company is bancrupt for example then you will be the producer! big important difference, because YOU are now responsible to fulfill all EU regulations and laws (like WEEE, CE, etc.).
@@rhpuch It is right, I was quoting the regulations, I've been working in product regulatory compliance for 9 years. All CE marking regulations and GPSR depend on when they where "first placed on the market". You cannot expect manufacturers to rework already marketed products for new regulations. Items first placed on the market before the December date do not have to comply with GPSR, they have to comply with GPSD. And only if they they are sold in N.Ireland without the "not for EU label". However if you modify (like relabelling) then its counted as a new placing on the market. You could use relabelling for non-compliance stock coming from the UK. GPSR does apply to used or old stock but only to old/used stock "first" placed on the market after the Dec 2024 date. I don't know what ebay are requiring precisely, but its quite possible they are expecting the impossible. I'm just quoting the regulations. Under the regulations like LVD the manufacturer is responsible for the compliance, importers have specific responsibility under each regulations (its a list of things like getting the DoC), distributors have other responsibilities. Just because a manufacturer become bankrupt does not mean the responsibilities change, but if you are an importer and you didn't get the CE DoC for example then you will be in trouble. That said there are many requirements for importer than I am sure they are not doing and its not being policed, that's another story.
@@tonystanley5337 well repairing used equipment is not possible anymore with GPSR. Even selling devices which were silently repaired (iphone display or batteryreplacement with non-apple applied parts) makes YOU the manufacturer. You also need to check if the device is part of a product return request etc. even washing clothes you want to sell make you the manufacturer because it could be the washing powder led to issues.
Eu regulations will never make repairer the manufacturer. They fully support use of equivalent parts. They usually regulate against manufacturers to prevent them not supporting warranty by non-dealers (ie cars) or non OEM parts. Apple may well claim 3rd party repaired products are "modified" but the EU will not accept that without actual evidence that the product performs differently.
Well I haven't dealt with ebay but I did have a problem with my Sky Qbox last year. like you after days of trying to get someone on the phone I tried that online chat. Likewise more recently I've seen companies coming up on my FB page and seen people comment on not being able to get customer support being met with the same automated reply saying " sorry (name) to hear , DM us your details and we'll look into it.

lol EBAY can't do anything about GPSR itself. But it could finally assign or limit the country to their shopping regions.
Which is geographical discrimination
