Again: A grown adult woman decided to cyberstalk a random teen she saw on video game and swat him and she faced 0 reproductions for this.
It seems everytime there is a school shooting there was either a warning sign or something that was said that was ignored. Making threats like that shouldn't be taken lightly and probably should be investigated. Having the police swat someone seems a bit extreme though.

At 17 I was jacked. 3 years of heavy gym visits and more testosterone than a men's clinic. I grabbed my gf and we left the school for that day and the next. When we went back they told us they fired him but didn't call the police. I ripped his name tag off the door and took it outside and shattered it on the ground. I used one of the pieces to stab myself a couple of times to let them know I was furious. If I'm willing to do this to myself imagine what I'd do to him. Cut to today. I'm 33. My neighbor 4 doors away is the ex wife of the head security guy. I've had enough opportunity to chat with him and he agrees that they should have let me have him lol

He was charging me with a misdeameanor, and I was freaking the fuck out because even on the referral and the report it said it was in a joking manner, but even after my mom came and the principal vouched for my good grades and behavior, he then raised it to a felony (while knowing it was a joke) and I was put into shackles and handcuffs and went to juvie. It was all thrown out in court, but the fact that something like this can happen, and if I wasn't blessed enough to have backing from the kid I said it to's family, and some rich relatives to get me a lawyer, I could be in prison right now instead of typing this comment.

I’ve had a judge when I got arrested for a felon in possession of a firearm charge admit he didn’t know what the laws regarding the subject were and if what I did was even illegal or if they even had the to confiscate my ammunition. I only got like 6 days but still, the fact that a judge can demand people rise for his presence and then sit there and admit he didn’t know the laws regarding the case and obviously wasn’t willing to spend a few minutes looking it up was infuriating, especially since he then went off on my dad for asking him how we can better follow the law in the future so that this never happened again and yelled at him that he better learn fast or he will be charged too next time. I'm an attorney in real life (never handled federal cases except bankruptcy filings), this was very entertaining. I agree he should not have spent that much time in prison. However, you definitely have to treat this seriously and definitely exercise your right to remain silent. Do not represent yourself or take the stand except in the most extreme situations (i.e., you're Jeffrey Dahmer and your attorney is going for a hail Mary to try to humanize you before the jury or something like that).
Personally the entire concept of "Contempt of court" or allowing judges to triple people's sentences for being perceived as disrespectful towards them is such a corrupt crock of shit. Your throwing away years of someone's life because they didn't call you "sir" in a court. Especially if someone's 19 years old; their brain isn't even done cooking yet. Those judges should serve sentences themselves.

I had something similar to this happen to me when I was in High School, luckily I was a minor and I just got yelled at by the feds. I was in high school, and I was sitting at lunch with a group of guys, one of them was British. So being the antagonistic ass that I was, I asked him what he thought of the IRA (Irish Republican Army), obviously, he went off on a rant towards me about some of the shit they've done, and in an attempt to further piss him off I make a sarcastic comment about how I "thought they were heroes". The problem was, this was like 2 weeks after the Boston Bombing, and some idiot nearby who was not a part of our group's usual edgy banter didn't know what the IRA was, and instead thought I was talking about the Boston bombers. So it ended up getting reported to the police as a "bomb threat", and a day later I'm detained in the principal's office with police officers, and the feds, explaining my story. Somehow, I never ended up arrested, or charged with anything. After that, I swore I'd never make a stupid joke like that again.

Reading through the article that prosecutors found manuals on bomb making, firearm modification for conceament, booby traps, school shooting documents. Two ex girlfriends claimed he regularly talked about columbine and how he would do the same one day. One ex girlfriend testified Josh actually bought materials and made a pipe bomb to test out. On the the 20th of April 2013 Josh told his girlfriend to stay home from school, the anniversary of the columbine shooting.
This is case and point for going in to the courtroom with your shit together. Never go in with a cocky attitude, always dress correct. The way your relationship with the Judge goes has a significant impact on your chance of conviction and length of sentence. I've had a case thrown out that had multiple witnesses. The witnesses looked and spoke like idiots, I didn't. I wore a suit, I spoke well and I made the bench laugh. My brief said I did his job for him when on the stand. Fix your shit in court or court will fix you.
This is why you should always prepare to be accountable for things you say and do. Being ignorant of the consequences isn't an excuse. "I didn't know you could get in trouble for that" isn't a legal argument. Josh and Kyle learned some valuable lessons.
I find it fascinating that people get mad at "unfair" sentencing for "ridiculous" crimes, but then completely agree that society needs change. Yeah, we affect behavior long-term with rewards and punishments. You didn't go to jail for smoking weed for a year and a half Josh, you went because you broke your promise to be a better man and went back to your old ways. It is not hard to be a good member of society, if you don't like it then enjoy prison, that's the choice, no one forces you to do anything.
For a threat to become a crime, the person making the threat has to have the reasonable ability to act on it. An 8 year old across the country can make a death threat online, and that isn't a crime because the one making the threat is incapable of acting on it.
America does prisoner exchange with other countries all the time. Justifying freeing horrible people to get a US citizen back. I could see politics becoming like that in US. It would seem to be US policy to do prisoner exchanges. All it takes is one group of authority defining the judge as a criminal then holding him without bail. Then the other side demanding he’s innocent. As it swings both sides on this issue. The next step is simply making the offer. ‘We agree to drop charges on A if you drop charges on B.’ When a truly innocent person is imprisoned should no one be held accountable? Is it wrong to escape or free the wrongfully convicted? Is it wrong for wrongfully accused to refuse to participate in their own trial? If you don’t have to speak on your defense in court, why must that person even be required to appear? Is it only to be vulnerable to the threat of arrest?

I'm an attorney in real life (never handled federal cases except bankruptcy filings), this was very entertaining. I agree he should not have spent that much time in prison. However, you definitely have to treat this seriously and definitely exercise your right to remain silent. Do not represent yourself or take the stand except in the most extreme situations (i.e., you're Jeffrey Dahmer and your attorney is going for a hail Mary to try to humanize you before the jury or something like that).
Personally the entire concept of "Contempt of court" or allowing judges to triple people's sentences for being perceived as disrespectful towards them is such a corrupt crock of shit. Your throwing away years of someone's life because they didn't call you "sir" in a court. Especially if someone's 19 years old; their brain isn't even done cooking yet. Those judges should serve sentences themselves.

I had something similar to this happen to me when I was in High School, luckily I was a minor and I just got yelled at by the feds. I was in high school, and I was sitting at lunch with a group of guys, one of them was British. So being the antagonistic ass that I was, I asked him what he thought of the IRA (Irish Republican Army), obviously, he went off on a rant towards me about some of the shit they've done, and in an attempt to further piss him off I make a sarcastic comment about how I "thought they were heroes". The problem was, this was like 2 weeks after the Boston Bombing, and some idiot nearby who was not a part of our group's usual edgy banter didn't know what the IRA was, and instead thought I was talking about the Boston bombers. So it ended up getting reported to the police as a "bomb threat", and a day later I'm detained in the principal's office with police officers, and the feds, explaining my story. Somehow, I never ended up arrested, or charged with anything. After that, I swore I'd never make a stupid joke like that again.

Reading through the article that prosecutors found manuals on bomb making, firearm modification for conceament, booby traps, school shooting documents. Two ex girlfriends claimed he regularly talked about columbine and how he would do the same one day. One ex girlfriend testified Josh actually bought materials and made a pipe bomb to test out. On the the 20th of April 2013 Josh told his girlfriend to stay home from school, the anniversary of the columbine shooting.
Wow after reading through the case details there’s definitely alot of stuff Josh left out.

I've had a case thrown out that had multiple witnesses.
The witnesses looked and spoke like idiots, I didn't. I wore a suit, I spoke well and I made the bench laugh. My brief said I did his job for him when on the stand.
Fix your shit in court or court will fix you.
This is why you should always prepare to be accountable for things you say and do. Being ignorant of the consequences isn't an excuse. "I didn't know you could get in trouble for that" isn't a legal argument. Josh and Kyle learned some valuable lessons.

I find it fascinating that people get mad at "unfair" sentencing for "ridiculous" crimes, but then completely agree that society needs change. Yeah, we affect behavior long-term with rewards and punishments. You didn't go to jail for smoking weed for a year and a half Josh, you went because you broke your promise to be a better man and went back to your old ways. It is not hard to be a good member of society, if you don't like it then enjoy prison, that's the choice, no one forces you to do anything.

For a threat to become a crime, the person making the threat has to have the reasonable ability to act on it. An 8 year old across the country can make a death threat online, and that isn't a crime because the one making the threat is incapable of acting on it.

America does prisoner exchange with other countries all the time. Justifying freeing horrible people to get a US citizen back. I could see politics becoming like that in US. It would seem to be US policy to do prisoner exchanges. All it takes is one group of authority defining the judge as a criminal then holding him without bail. Then the other side demanding he’s innocent. As it swings both sides on this issue. The next step is simply making the offer. ‘We agree to drop charges on A if you drop charges on B.’ When a truly innocent person is imprisoned should no one be held accountable? Is it wrong to escape or free the wrongfully convicted? Is it wrong for wrongfully accused to refuse to participate in their own trial? If you don’t have to speak on your defense in court, why must that person even be required to appear? Is it only to be vulnerable to the threat of arrest?
The guys sentence is a great reason to not use any social media and always use a VPN. Jokes and dark humor shouldn't get you sent to a damn prison.
VPN doesn't mean it is impossible to track you down. It's not for avoiding law enforcement.
