Cold morning, it was in torpor. I've ran into many small birds in this state in my life. If you pick them up your hand actually warms them up pretty quickly enough to fly.
If a bird stands there stunned like that, there's a pretty good chance it has an infection/disease/is riddled with parasites - parasites that can be transmitted by picked it up through their feet. Try to help them but don't pick them up if you can help it.

It is clearly not well. It looks like the countless birds that has flown into my window. They barely manage to stand up, and after an hour or so they start reacting and fly away.
The dog is facing straight-on to the bird down the line of its beak for most of the interaction, but birds like this one have to turn their heads side-on to look at things because of the position of their eyes, so one of the ways you can tell the bird's been stunned by something (most likely, it's concussed from a collision) by the fact it doesn't face away from Max.
