SSSniperwolf reuploads clips, Asmongold reuploads entire high effort videos. Asmongold is a direct market copy for the original videos while SSSniperwolf is compiling and reacting. There's a difference, both are bad, but Asmongold is worse.
He’s the only creator keeping GTA singleplayer alive on TH-cam. GTA has been reduced to a roleplay monstrosity otherwise. Also his GTA Pacificist series is one of the best gaming series on all of TH-cam imo. But the way he handles his life and relationships is bizarre and hilarious

His biggest haters dredge up clips from 2+ years ago to make him look bad, and then do the one thing he literally rails on about: react to his videos. Like he literally types up a 14 page essay about how react content is theft, and people seem to think it's safe to react.... To his videos. Then they're legitimately surprised when he strikes those videos. He's definitely not a person used to being wrong or being proven wrong frequently, especially when he's convinced he's right.

If you're talking about the 1 hit KO run, you're completely wrong and misrepresenting that situation. The reason it was taken off was because there was spliced footage, and there were other questionable amounts of evidence pointing to tampering with the game itself.
The argument that the reaction video is “x minutes longer than the original” is absolute brain rot. You can’t upload the entirety of Harry Potter, pause a few times and then argue that your video is 30 minutes longer therefor it’s an entirely original piece of work. If you upload the entirety of the video, no matter how good your commentary is or how many times you pause, the owner of that footage is 100% within their rights, morally and legally, to take your shit down.

If a reaction is triple the length of the original and an expert analyst breaks down the techniques used the make the original video, even if it includes the entire original video, that is NOT going to replace the original. the idea that the owner of the original footage is 100% within their rights legally and morally in that scenario is just wrong. there are no legal precedents for that, and it's therefore not a 100% chance. and given that some people will find the analysis valuable, it's not surely immoral, either.

It causes him pain and has effected most his life for the worse. He was only diagnosed and given medication for it a while after the incident. If you watch his stream that day you can see the symptoms were really bad that day and negatively effecting him. He had stated earlier that day that he was feeling really bad. This is also almost a 5 year old clip, nothing like this has happened again. Tom was very malicious here, he doesn't give context to what happend, says he doesn't care about hte context when the context is quite important. He even shows the clip where Matt explains the context but cuts it of right before he does which means he deliberately didn't show the rest of the clip solely to fit his narative that matt is a unhinged loser.

This sparked a hate campaign (when most of the people had not even read the document). DV was understandably upset by this, leading to his outrage. He wasn't saying reactors are grapists. He was saying that reactors reflect grapists in the sense that they do not ask for consent before reacting and reuploading someone's entire video. He did not say reactors were grapists. Penguinz0 has since then apologised to DV, taken down the video, and even was on his channel to do a collab and make up. Darkviper is not abusing copyright and has every right to take the video down. Chudlogic had reuploaded his entire video. Viper's stance on the subject was quite clear on the topic. Even chud in the video agrees that DV has every right to take down the video. He has taken down other videos that reupload his video's in their entirety, doesnt matter if they are negative or positive about him. If chudlogic really had something to add then he could have made a video and edited only the clips that he wanted to react to (just like the thousands of other video's criticising DV) instead of reuploading the his video. It's also funny how you say "for some reason he thought he had a right to take down the video" when at the end you agree that he did have a right to take down the video. So....ima paste mr - Bully_Maguire07/SniperReconX_ 's comment on this situation- This video focuses on Matto, and his history of Anti Reaction content, DMCAs and past dramas, such as Falling outs with friends and his coverage on H3H3 Podcast's use of his voice. To start off, not 2 minutes into the video, Tom indirectly alludes to Matt being Autistic, by explaining the definition of Autism. This is before he even explains anything about Matt and his channel. This isn't the only example of insult in this video neither, as he calls Matt a variety of things without good reason (in 99% of the examples he's shown). Things such as "sensitive", "manchild", "hypocrite", "snake", etc. All quite childlike and ironic, to be honest. Not too soon after calling Matt autistic, he talks about a post Matt made on Twitter a while ago, criticising the H3H3 podcast and Ethan Klein's use of the infamous '14 Pages' meme. In this post, Matt talks about how H3H3 have been harassing him for years with the repeated use of the meme sound bite, and refusal to stop. Tom talks about the post, criticizing Matt with name calling, and saying that "Making fun of someone isn't harassment." This is a very toxic, and false statement which on its own is quite bad, but due to his audience's large number this statement can be quite dangerous. While, yes, Tom is a content creator first and foremost, he is also a role model to people as a consequence. If these are the messages he is preaching, it can allow for a toxic community to form. There is plenty of evidence of this already in the comments of the video. Tom then goes on to talk about the many DMCA strikes Matt has put out, specifically for a particular case where a Content Creator reacted to one of his videos. He criticises Matt for the numerous takedowns, and justifies the Reaction as "It was a 40 minute reaction to a 10 minute video". That is not a valid reason as to why the DMCA was unjustified at all. He portrays Matt as this cruel, sensitive manchold who takes down any videos related to him, when this is very clearly not the case. The only cases when Matt has taken down videos is when they breach copyright, or indirectly harm him and his reputation, as is the case with a video where Matt, frustrated after losing a round of Among Us, he has an outburst towards another player. This clip has been used multiple times out of context, as an attempt to portray Matt in a negative image, including in Tom's own video, and as such Matt had contacted the original uploader, who made the video as a meme, asking for the video to be removed to which they quickly agreed. Matt has explained himself that he was going through some personal stuff at the time, and had apologized and reconciled with the Player not too long after. Conveniently, Tom excludes this information from his video, portraying Matt as an individual with a temper and a fragile ego, who would go to any lengths to keep his videos to himself. The reason this 40 minute long reaction video was taken down was because it literally included the entirety of Matt's video in it. As Tom continues his tangent of criticism, he shows a small clip from one of Matt's streams where, quoting an NPC in the game, he accidentally said the N word. Although he didn't say much about it, Tom included it for a reason. Whether it was to portray Matt as a racist, a bad person or something else, I am unaware, but am going to assume that is the case. In order to be racist, a person must hold a prejudice against a group of people due to their skin colour and race. A prejudice being assumptions. As far as I know, Matt has neither shown, nor expressed any prejudices against anyone or any group. Him saying the N word was completely accidental, a slip up whilst repeating the quote, and he corrected himself and reassured his viewers. Tom's use of this clip is quite ironic, as a few months ago he was exposed for using slurs and prejudices maliciously against another streamer(?). Tom continues to express his opinions on Matt, talking about how he "hates" Asmongold. However Matt has merely expressed his disdain for Asmon's massive use of reaction content, and as far as I know, never specifically said that he hates him (I believe this may be an attempt to anger Asmon's fans and to stir the pot, so to speak). Tom also mentions MoistCritikal, although the drama between him and Matt was quickly resolved, and Charlie saw that Matt had a point, so I don't see how this relates. In the last few minutes of the video, Tom shows a few clips of Matt explaining and justifying his actions and opinions, to which Tom responds, instead of with an argument, "Who cares?" repeatedly. This just goes to show that Tom doesn't have a valid argument against why reaction content should go, and so he resorts to name calling and dismissal, the actions of a two year old child. It also goes to show that Tom never bothered to listen to Matt's explanations in the first place. He very clearly has a vendetta against him. Maybe as a way to project his insecurities or to justify the content he makes. He also describes Matt's justifications for his anger in the Among Us clip as "guilt tripping", which isn't the case. It appears to me that Tom has no empathy, and has something against Matt. For what reason, I don't know. It is however, unjustified. Anyhow, the video is a disgusting, disrespectful piece of content, almost defamatory, and is both unnecessary and uncalled for. I'd like to hear your input on the situation, corrections, fact checking, etc. and as always I wish you all the best. :)

Thats not what happened, Tom maliciously left out the context to make darkviaperau look way worse than he actually is. This clip is 5 years old and nothing like it has happened since. Darkviaper has a disease called hashimoto's which causes you to feel like shit and your mood to be more irritable. You can see the symptoms on his neck and face glaring up that day. He profusely apologised to the guy and was forgiven. He played with him for hours and hours after wards, and gave him a free twitch sub to his channel for years. Transformation is the single largest factor of fair use and fair use is completely and totally unrelated to how the target is affected monetarily, in fact fair use being competitive with the source copyright is specifically listed along with monetization as a non factor in whether something is fair use. So no, Viper whining and screaming about people hurting other people with their fair use financially doesn't have any baring on the conversation. What's funniest about all of this is that he keeps saying he's an expert who has hours in research but the examples he uses are basic copy paste examples that were posted on a fair use information website everyone used to cite in the 2010s when fair use was still a mystery in the online ecosystem. You may have used all the original footage, you may have inserted no commentary, but you have edited the product into something different and it now has a new intent that serves a new audience. Then we move even further forward and see Yew Neek v Schaub, if your content is discussing things and someone reacts to you discussing it serves a new market and provides a new intent, further, it even sets the precedent that simple discussion like what Schaub or Viper does isn't even a creative work, it's simply a work which gives people even more leeway on using it as they please for fair use. But none of this would ever even be entertained by Viper, because he only looks at the bare minimum and assumes the rest so that he can be right, just like the reddit mod he's always meant to be. That is entirely outside the realm of the legal world however, that's just battling systems.

One court case matt never brings up is the sargon of akkad case because it goes against his argument. Sargon took multiple clips of someone elses vids and put them in a video and uploaded it. The court found that he had transformed the original work. Chud almost quadrupled DVs clip by adding his commentary and critiquing the work. That is transformative. You can argue he had to use the whole clip in its entirety to show the full context of DVs argument. This is a very bad video that does not represent Darkviper at all. You dont/refuse to include a lot of context on the topics you are talking about. This isn't really surprising as in the video, numerous times, you say you "don't care" about the context or "dont care why Matt did what he did." Im certain you didn't include the context since a lot of the points in your video wouldn't work, given it. I can't say im surprised given your reputation.
Regarding his meltdown among us. He apologised to the person, played with him hours after the incident, and gave him a free subscription to his twitch for years. Matt has a disease called "Hashimoto's disease." It directly affects your mood for the worse. It has been with him most of his life, and he only found out about it quite a bit after that day. If you watch his stream that day, you can see the symptoms affecting him, and he had stated earlier that day that he was feeling really bad. This is also almost a 5 year old clip. Nothing like this has happened again.
The reason he had taken down the among us clip is because there is context that isn't included in the original clip that makes him just look like an asshole.
When DV first released the document, it was on his channel in community posts as a small draft intended for his audience and asking for feedback. Penguinz0 then makes a video and focuses mainly on the fact that that DV compared grape with reactors, which was not the case. This sparked a hate campaign (when most of the people had not even read the document). DV was understandably upset by this, leading to his outrage. He wasn't saying reactors are grapists. He was saying that reactors reflect grapists in the sense that they do not ask for consent before reacting and reuploading someone's entire video. He did not say reactors were grapists. Penguinz0 has since then apologised to DV, taken down the video, and even was on his channel to do a collab and make up.
Darkviper is not abusing copyright and has every right to take the video down. Chudlogic had reuploaded his entire video. Viper's stance on the subject was quite clear on the topic. Even chud in the video agrees that DV has every right to take down the video. He has taken down other videos that reupload his video's in their entirety, doesnt matter if they are negative or positive about him. If chudlogic really had something to add then he could have made a video and edited only the clips that he wanted to react to (just like the thousands of other video's criticising DV) instead of reuploading the his video. It's also funny how you say "for some reason he thought he had a right to take down the video" when at the end you agree that he did have a right to take down the video.

This video focuses on Matto, and his history of Anti Reaction content, DMCAs and past dramas, such as Falling outs with friends and his coverage on H3H3 Podcast's use of his voice.
To start off, not 2 minutes into the video, Tom indirectly alludes to Matt being Autistic, by explaining the definition of Autism. This is before he even explains anything about Matt and his channel. This isn't the only example of insult in this video neither, as he calls Matt a variety of things without good reason (in 99% of the examples he's shown). Things such as "sensitive", "manchild", "hypocrite", "snake", etc. All quite childlike and ironic, to be honest.
Not too soon after calling Matt autistic, he talks about a post Matt made on Twitter a while ago, criticising the H3H3 podcast and Ethan Klein's use of the infamous '14 Pages' meme. In this post, Matt talks about how H3H3 have been harassing him for years with the repeated use of the meme sound bite, and refusal to stop. Tom talks about the post, criticizing Matt with name calling, and saying that "Making fun of someone isn't harassment." This is a very toxic, and false statement which on its own is quite bad, but due to his audience's large number this statement can be quite dangerous. While, yes, Tom is a content creator first and foremost, he is also a role model to people as a consequence. If these are the messages he is preaching, it can allow for a toxic community to form. There is plenty of evidence of this already in the comments of the video.
Tom then goes on to talk about the many DMCA strikes Matt has put out, specifically for a particular case where a Content Creator reacted to one of his videos. He criticises Matt for the numerous takedowns, and justifies the Reaction as "It was a 40 minute reaction to a 10 minute video". That is not a valid reason as to why the DMCA was unjustified at all. He portrays Matt as this cruel, sensitive manchold who takes down any videos related to him, when this is very clearly not the case. The only cases when Matt has taken down videos is when they breach copyright, or indirectly harm him and his reputation, as is the case with a video where Matt, frustrated after losing a round of Among Us, he has an outburst towards another player. This clip has been used multiple times out of context, as an attempt to portray Matt in a negative image, including in Tom's own video, and as such Matt had contacted the original uploader, who made the video as a meme, asking for the video to be removed to which they quickly agreed. Matt has explained himself that he was going through some personal stuff at the time, and had apologized and reconciled with the Player not too long after. Conveniently, Tom excludes this information from his video, portraying Matt as an individual with a temper and a fragile ego, who would go to any lengths to keep his videos to himself. The reason this 40 minute long reaction video was taken down was because it literally included the entirety of Matt's video in it.
As Tom continues his tangent of criticism, he shows a small clip from one of Matt's streams where, quoting an NPC in the game, he accidentally said the N word. Although he didn't say much about it, Tom included it for a reason. Whether it was to portray Matt as a racist, a bad person or something else, I am unaware, but am going to assume that is the case. In order to be racist, a person must hold a prejudice against a group of people due to their skin colour and race. A prejudice being assumptions. As far as I know, Matt has neither shown, nor expressed any prejudices against anyone or any group. Him saying the N word was completely accidental, a slip up whilst repeating the quote, and he corrected himself and reassured his viewers. Tom's use of this clip is quite ironic, as a few months ago he was exposed for using slurs and prejudices maliciously against another streamer(?).
Tom continues to express his opinions on Matt, talking about how he "hates" Asmongold. However Matt has merely expressed his disdain for Asmon's massive use of reaction content, and as far as I know, never specifically said that he hates him (I believe this may be an attempt to anger Asmon's fans and to stir the pot, so to speak). Tom also mentions MoistCritikal, although the drama between him and Matt was quickly resolved, and Charlie saw that Matt had a point, so I don't see how this relates.
In the last few minutes of the video, Tom shows a few clips of Matt explaining and justifying his actions and opinions, to which Tom responds, instead of with an argument, "Who cares?" repeatedly. This just goes to show that Tom doesn't have a valid argument against why reaction content should go, and so he resorts to name calling and dismissal, the actions of a two year old child. It also goes to show that Tom never bothered to listen to Matt's explanations in the first place. He very clearly has a vendetta against him. Maybe as a way to project his insecurities or to justify the content he makes. He also describes Matt's justifications for his anger in the Among Us clip as "guilt tripping", which isn't the case. It appears to me that Tom has no empathy, and has something against Matt. For what reason, I don't know. It is however, unjustified.
Anyhow, the video is a disgusting, disrespectful piece of content, almost defamatory, and is both unnecessary and uncalled for. I'd like to hear your input on the situation, corrections, fact checking, etc. and as always I wish you all the best. :)

Transformation is the single largest factor of fair use and fair use is completely and totally unrelated to how the target is affected monetarily, in fact fair use being competitive with the source copyright is specifically listed along with monetization as a non factor in whether something is fair use.
So no, Viper whining and screaming about people hurting other people with their fair use financially doesn't have any baring on the conversation.
What's funniest about all of this is that he keeps saying he's an expert who has hours in research but the examples he uses are basic copy paste examples that were posted on a fair use information website everyone used to cite in the 2010s when fair use was still a mystery in the online ecosystem. We've evolved, we've had new precedents, Ethan Klein isn't the only guy who got sued anymore, we have people who've posted edits of copyright, we have people who've watched things live, we have several cases that all explain what transformation is and what it isn't. No commentating or even doing a funny edit of someone isn't the equivalent to putting a hat on a dog or, for the example he's using to make that comparison, coloring a picture of dogs blue with photoshop. Commentary transforms the original work because your purpose and intent is different from the original.
It's improper to take a picture and edit it slightly as a new picture, because it's purpose is the same, it's still a picture to be enjoyed. it's proper to take a picture and edit it in such a way that people see it as a critique or a new perspective, because now it's no longer a picture to be enjoyed, it's a new thing that serves a different audience. Likewise, as we've seen with Sargon of Akkad's case taking a video someone made and editing it into something that serves a different opposing audience is proper transformation. You may have used all the original footage, you may have inserted no commentary, but you have edited the product into something different and it now has a new intent that serves a new audience. Then we move even further forward and see Yew Neek v Schaub, if your content is discussing things and someone reacts to you discussing it serves a new market and provides a new intent, further, it even sets the precedent that simple discussion like what Schaub or Viper does isn't even a creative work, it's simply a work which gives people even more leeway on using it as they please for fair use.
But none of this would ever even be entertained by Viper, because he only looks at the bare minimum and assumes the rest so that he can be right, just like the reddit mod he's always meant to be.

It would go fine, it's been done several times before and if the intent has been changed you're within your right. A video on TH-cam or a stream is just as valid of a copyright as any movie is.
You might have trouble keeping it on TH-cam because TH-cam is it's own company and they make their own decisions and have a worry free DMCA system that's easy to abuse. That is entirely outside the realm of the legal world however, that's just battling systems.

He’s definitely annoying and wrong, but just repeating, “WHO CARES???” Isn’t an argument. I get that you really mean, “how is this important in the grand scheme of things?”, but that’s not the only metric for how we base judgement on things and copyright laws have a HUGE impact the world in general and specifically content creators
The fact of the matter is chud didnt infringe on DVs copyright. It was not a market replacement for DVs video. One court case matt never brings up is the sargon of akkad case because it goes against his argument. Sargon took multiple clips of someone elses vids and put them in a video and uploaded it. The court found that he had transformed the original work.
Chud almost quadrupled DVs clip by adding his commentary and critiquing the work. That is transformative. You can argue he had to use the whole clip in its entirety to show the full context of DVs argument.

It's a totally different video. It's a different length, what appears in the vid is different and the argument made in the video is now different. ... Ppl watched Chud to get his opinion on DVs video, they didn't go there to watch DVs. If they wanted to watch it they would have gone to DVs channel.
