    First of all, I would never go back to an establishment that had asked me to leave before for any reason. And it is kind of creepy honestly. A random guy coming into a store, setting up equipment capable of taking photos/recording AFTER they had already told him to leave. Mmm!!! He was was right when he said it this could've been prevented. By him not going back. This guy.

      I have no clue why this guy went back maybe he went back because it is the only food establishment with in walking distance of where he off loads his truck. Look I have no clue and really does not matter if everyone would stop for two seconds and looks at it from his point of view what he did was not creepy maybe a little vindictive but not creepy.
      So as what was said in court these are the facts.
      1) nobody ever told him the girls felt creeped out by him taking the photo. So he has no clue those two chicken heads changed their mind after they did a sexy spring break pose for his camera.
      2) A corporate person told him to leave because he did not ask permission to take the photo first.
      3) He leaves and does not come back for a few weeks.
      4) He did not leave the camera on the counter like everyone is assuming because the other manager clearly said she just saw him put it down and that was enough for her to call 911.
      5) he is confronted by cops for simply walking in to a coffee shop weeks later and is now being harassed by the police who even the judge admits is true.
      No thinks about how little the guy was aware of what had taken place with out his knowledge maybe if he knew the girls called him creepy or that the cops had been called the last time just maybe he would not have gone back. I know that I will warn all of my buddies about this coffe shop and their gestapo tactics when GUYS DO NOT LOOK LIKE SUPER MODELS AND TAKE A PICTURE!! Who wants to bet if the guy was a model nobody would think he was creepy. Just a bunch of woman being biased on this thread you all need to check your behavior when judging someone based on their looks. Oh and guess what most serial killers look normal other wise they would not be so prolific.

    I would be uncomfortable too. Sometimes when you’re in an uncomfortable position you’ll comply just to make the situation go away faster. Guy is a total creep. Who goes to businesses to take random pictures of women? Does he do this with men? Does he take random pictures of men?

      This is a bit much.
      If there was a man working at the counter as a batista or cashier, I'm sure he would have taken the pictures. If you are too meek to say 'Actually I would prefer not to be photographed' at your place of work.... How are you going to handle an ACTUAL problem customer?
      Sounds like a bunch of idiot girls acting like victims, which then caused this man to be arrested.
      Also, you asking if it happens to men too is kinda out of left field.
      Would it have made the situation less believable if it were a male employee getting 'uncomfortable' ?
      No.
      Are people who identify as women the only possible victims in the world?
      No.
      This whole case was a bit ridiculous. If you are a manager: buck up and manage and don't act like a terrified child who doesn't know how to handle a situation.
      Don't call the police because somebody ASKED to take photos of you, and then you willingly pose for the photos like it's fkin spring break.
      Seriously, though. It just makes this guy look like a scum bag because they wanted to be like,'Oh no, some creepy guy took a picture of us that we fully allowed and posed for.'
      Woman up. Just because you were born female doesn't mean you are powerless to any random male that approaches you.

I am working as a waitress and night receptionist too and i've got way more difficult situations with drunk guests and i never called the police on anyone.

    At first I was like "Jesus, they clearly pose, so he clearly asked, chill out" , but everything he did after the first visit is so creepy and weird, especially just randomly leaving a camera on a counter and I don't even know why he would get back to the palce that he was literally asked to leave before. I'm glad he came to the show. At least people know his face and he outed himself as a creep.

      he was arrested for not showing his ID to the police when asked . doesnt matter if someone called the cops or not , the cops can ask anyone at anytime to show ID and if u argue with the cops then u will likely be arrested .

      @Mar Leonetti you are actually not required to show your ID to police IF they have no probable cause to ask you for it. I know this from personal experience and the case was IMMEDIATELY dismissed and expunged from my record by the judge. I'm in NC by the way.

      @@jazzycherokee869 well u can beat the wrap but not the ride . so even tho technically cops may not always have a right to ask for ID , not showing it when asked can still get u arrested and i for one would rather just show my ID than get arrested . nobody gets arrested for showing ID , but alot of people get arrested for not showing it .

    He was asked to leave over an issue with taking photos inside the store and then came back the following week and brought a 360° camera?! All of this was caused by him and his weird unwillingness to leave this store and their employees alone.
    And I'm normally all for people knowing their rights and advocating for them (especially with cops), but the fact that he travels for work and was so quick to point out that he knows all about Massachusetts' ID laws just hit a wrong note with me. That tells me this is not the first time this man has caused issues with his photography.

      Definitely NOT his first rodeo... And that is exactly what Judge Milian was picking up on when she asked him if he usually gets asked to leave when taking pictures at places.. notice how she had to ask more than once and he didn't answer right away... Dude's just an entitled creep.

      If he is really a photographer, he would have had them sign a waiver for permission to photograph them, which he did not do. Glad the lady was suing him for her employees. He had no right to take pictures in her business without her and their permission.

      @@trekgirl65 Just rubbish. I shoot tv commercials and have no trouble walking ng into any store with a camera and asking if they mind me talking pictures. If they mind, I move on. Their loss. With Google maps, their objection to having their shop marketed free is fantastic. The girls posed for him. He wasn't being sneaky. Its just buss hit. Those girls didnt mind. The Manager got snooty over nothing.

    What a creep! I took my sister trick or treating years ago and we got to this one house and the man was TAKING PICTURES of all the kids that came to his door for candy, we got up there and I asked him why he was doing that and he pulls out 2 photo albums with ONLY pictures of little kids trick or treating, I was so creeped out and I told him he couldn't take her picture. This reminded me of that.

    Him leaving the camera on the counter (and walking away, like he didn't leave a camera pointed at the female behind the counter), not having his ID with him in the store (looking up the law, saying he doesn't have to show ID), and his overall demeanor...he definitely seems like a peeping tom to me.

    The plaintiff needs to look at it from the girls angle. He a middle aged man taking pictures of young women. There are so many weirdo’s and dangerous people out there, young women these days do need to be careful and on guard. It’s sad but it is the world we live in.

      With THEIR permission. Everyone knows it's not hard for people who work there to say no. They had no hesitation calling the police so I'm pretty sure they could have said no to the picture. Why they take his order then and not just tell him to leave the second he steps foot in the door? They are full of crap.

      Watch it again seriously only this time pretend the old man is an old woman and the girls are two college age guys.
      Also look at the way the woman posed they choose to pose like that would you pose like that if you felt even a little creeped out by the person taking the picture.
      I think the manager made a big deal about it so the workers got nervous and said they only went on along to get along that way they did not get in trouble and the manager got to take her anger out on the guy instead of the workers.

      Its what we have to do to get a shot. I shoot tv commercials and have often set up a video camera on tables just to get a 2 second clip. I can tell if there is a problem and in most cases I will show the people if they mind. Some dont like it but thats ok. I just delete.
      Its not creepy at all. Most staff love being on tv.

    Ask the barista that just about got kidnapped through the drive thru window if these gals are overreacting…. I’d say she would say “hell no”! This guy probably felt that it was his “Right” to take photos & went back to “prove” how wrong the Manager was for telling him to leave.     My wife had some creep film her at a coffee shop. The coffee shop owner noticed what was happening and told her and she called the cops. The guy had the same reaction “there’s nothing wrong. I’m just taking a picture”. Creeps are everywhere and they are always “just taking a picture”. Its weird and its not ok.

      @@BandhariWickette I see that now, but the man is a truck driver, not a photographer for Google. I have never heard of someone seeing an app advertising assistance in taking street views. Also, Google street views are "street views", not specific photos of people. I may be missing something, but this still seems very odd and creepy to me.

      Yep and he left! Then they just called the cops the second time with out even giving him a chance to leave how about we all act like decent people and say hey we don’t want you to come back so please leave if he refuses or comes back again then you call the cops.
      But you keep calling the cops and when they kill some kid or old person or a mentally unstable person that is none violent because you called them well then the death is on your hands as well.

    This a weird case. I think what he is doing is innocent but I also agree that it's creepy because u can never tell what someone is plotting to do. The judgement was spot on tho. The manager did what she felt was right. He was being rude with the police and that's why he got arrested. Was not the resturants fault.

      After seeing his body language and hearing everything especially a camera device pointed at them and left this is a tactic that a potential burglars or perpetrators (we don't know his EXACT motive) use to pick their targets.     It’s a private owned business he was asked to leave. The young ladies were very pretty and I’m sure he wanted a picture for more than Google Street. Most definitely a creep and only returned because he felt entitled and look what it got him. I heard him say he was discriminated against no sir perversion has no race. The Defendant was very respectful, both of the ladies were.

    Put yourself in his place try to see it as if a older woman took a photo of two college aged guys working there and then tell the manager some creepy old woman took their picture which they said yes to but now they changed their minds and they feel creeped out by it now tell me how you feel about it.

    Judge Milian's husband admitted that being the son of 2 police officers he heard all his life the motto, "You can beat the Rap, but you can't beat the Ride." Sounds like his parents thought it was perfectly fine to arrest people even though any charges would likely not hold up in court. Those are usually situations of arrest for "contempt of cop", not for violations of the law. It is ironic that this couple being both former justices find this humorous (unless of course it ever happens to them or a family member).

    I would not have been comfortable with him taking a pic either. I might have given him the benefit of the doubt if it was only once and he never came back in again. Might have even gave him a pass if he just came in to eat without the camera.
    But placing that camera there, nah. He was up to no good.
    As for those saying they're being too sensitive, lucky you. You've obviously not dealt with pervs or stalkers.
    Rule is, better to err on the side of caution.
    I would have liked to have heard from the baristas. He left enough of an impression to identify him later. Seeing hundreds of people's faces in a week, they all blur together. People that evoke strong emotions are the ones you remember.

    I agree that it is really bizarre that they are taking photos inside with employees when it is supposed to be used for Google Street view. I am surprised the Judge Millan didn't bring that up, as to why he didn't take the photo outside. That guy seemed pretty shady and he will learn to obey the Police orders.

    I’ve worked 15 years at Starbucks. For all 15 years we are told”Absolutely no pictures taken of baristas or the store. You can take pictures of your drink or who you are with but no pictures of store. It’s corporate policy

    Taking photos of people without their permission is creepy so I don't blame these women at all for reporting the defendant. This guy sounds like one of those "auditors" who provoke people and law enforcement just to get a reaction out of them. Don't get me wrong, police need to be checked but some of these people really are wasting people's time. Why would you go back to a place that told you to leave? That is not normal behavior. If this was me and it really innocent photo taking like he says, I would have been put off by their, what seems like, sensitive behavior. I would not go back there for a meal. Women get blamed if they don't report sexual harassment and they get blamed when they do...

Like maybe the longer he was in the shop, his demeanor was being observed and the waitresses started to get bad/creepy vibes from him. This has happened to me when I used to work in retail. I would meet a customer who at first contact would seem "normal" but the longer we interact I realize they were "off" or "creepy."

    Why does Google maps need a photo of the inside of a business? I think him intending on taking multiple photos on different days is creepy. The girls and manager have no guarantee that he'd delete the photo if they called and asked him. For all they know, he was using the picture for nefarious reasons.

    I’m actually at odds with all the other comments, it seems.
    I think it’s probably innocent that he goes back to the coffee shop even though he had an awkward interaction with the manager. I used to work guerrilla marketing and had plenty of interactions like this. He asked for permission before the photo was taken and no one told him not photograph. No one told him not to come back.
    Asking him not to return seems like a prerequisite for all this nonsense. Police didn’t respond to disorderly conduct, they responded to a non-issue and created an issue.
    If you don’t want someone in your business, someone has to let that person know.
    I would sue the police department because they should have just told him to leave, not punish him for exercising his right not to furnish an ID.

    While the defendant does give me creep vibes by his demeanor, my issue is with the girls giving him permission to take the photo and then, according to the manager, turning around and saying they felt uncomfortable. If they didn't want their picture taken and were so uncomfortable (which I'm not so sure about considering they didn't look uncomfortable in the photo and even posted together) , they should have said no. If he had still taken their photo anyways it would be an entirely different story. Plus the manager claims that's why she asked him to leave but when she confronted him, her issue was that he hadn't called in advance and personal asked her about it. And that girl from the photo was being a little extra saying when he walked in the other bartender "started shaking". Definitely feel like the manager coached the girls and was really the only one who had a problem with it. All this could have been avoided had she simply told him to leave AND not come back. Then again, why he came back in the first place after what happened I don't understand 😔

    It's totally clear the judge had her mind made up. The owner should have been very clear with him if she didn't want him back in her establishment. The defendants response at the end says it all... "We were just following procedure". That's the defense a person uses when they are caught doing too much with their authority.

    I am unaware of a Google street view app that prompts you to take pictures of baristas. I have been a Google guide for years and have millions of hits on photos of exteriors and of food but I don't take pictures of employees. maybe there's a different app he's talking about?
