Charlie - Apparently some people receive migration letters in error! Who is likely to receive those in error? Plus, apparently some people are able to stay on legacy benefits, if DWP agree it's not in the claimants interest to make them migrate! Can you please do a video of who is likely to be able to stay on legacy benefits please & provide the link to that information, so we all can use as guidance please!?🙏

      Hi Charlie,
First I would like to say thank you for all the good you are doing on behalf of us disabled people.
I was on D. L. A for a number of years, Low Care, High Mobility, I had 2 tribunals, both because my mobility was lowered to Low. both reversed the decisions.
On the second, I was awarded High Mobility Indefinitely.
When I was being changed over to P. I. P. I filled the form in, to the best of my knowledge, the question in the Mobility section asking "Can you plan & follow a journey", I answered Yes, because I can red a map & also, I can input an address into a Sat Nav.
I lost my mobility high payment, it was put down to Standard, I also get Standard care.
I asked for my claim to be looked at again, the award stayed the same.
It wasn't until I went to see a man from Citizens Advice, that I was informed that was not what the question meant.
He informed me that, it related to, could I think I wanted to go to a place, would I be able to choose the place, then ACTUALLY be able to GO on that journey, would I feel safe going, or EVEN be able to start the journey.
I, as I said before, have been to 2 tribunals, I found them very stressful, not because of the people conducting them, but the actual event.
That was a few years ago now, is there any way I could have another review.

Hi Charlie, I lost the enhanced mobility part of my pip in September I appealed the decision and still lost it because of how I worded things. So since September I’ve been pretty much stuck at home ever since, relying on my children to ferry me around to appointments etc (when they haven’t been cancelled. It’s affected my mental health severely as my independence has gone. Having to try and walk to the shops etc has made my back pain increase significantly. I’m waiting for a new claim form as things have changed and I’m in temporary accommodation because from the point of losing my car, life has changed in many ways. I no longer have my no claims bonus because I had the motability car which has pushed insurance prices up so I couldn’t afford to have my own car if I wanted to without struggling financially. Your videos have given me good insight into how to fill my claim next time. Wish I’d known sooner, thanks Marcus

As a person who went through this process, I had to describe myself in my worst weeks and tell anyone who is disabled to do the same as, some disabilities are not a continuous thing it's you are fine for a few months but then took out of commission for a whole month which financially destabilizes you due to being unable to work and likely will lose your job. So do say you can't do something if that's you on your worst week.

Part of the reason is that I wasn't constantly at the docs every five minutes from the way the letter was written. What they ignored is how the assessor used leading questions and rushed through the assessment without giving me time to talk properly. The assessment barely lasted 20 minutes which says something.

I'm so confused by it all. I was awarded standard rate of living 2 years ago and my next assessment is coming up in a couple of weeks. The first time the assesment came back and didn't seem to at all stack up against what I'd told them. My condition is far worse than it was back then and don't know how I should be answering. I can walk 20 metres but there are times in the day where I can't stand. Does it count if I can walk but it's painful and uncomfortable and I'm constantly saying, 'dont worry I'll catch you up'. There are times in the day that when stood I can't apply pressure to my right leg meaning I can't walk at all for a period of time. During the colder months it's excruciating constantly. I'd really appreciate some help if someone is willing to give me a bit of time. In short, as a child I had a degenerative disease which caused the cartilage to form badly in my hip joints, this is now simply classed as arthritis now I'm an adult. It's caused a cam deformity in my right hip and I have impingement giving me reduced mobility and range. I often get shooting pains through my lower back, hip, groin, down my leg, in my knee and strangely all the way down into my big toe, I think I'm trapping nerves but I'm no expert. Since it's got worse I'm having further investigations and walk with a stick at 37. To make things worse, over exertion hurts as does sitting for too long. I can't win lol. Apart from the shooting pains I ache in the hip region permanently even with multiple prescribed pain killers and physio. I Appreciate any tips or advice. Thanks in advance.

Firstly you are NOT alone....we are here. Based on what you have said above you are 'enhanced'
Have you watched the guides on PIP Claims and Tribunal submission packs? I give examples in every section that will help you. This Sunday I have a really good guide coming out on how they do the points. I really recommend you watch that.
I explain in the guides what they mean by mobility.....its NOT about you could do it if your life depended on it. Its about being able to walk WITHOUT it increasing your pain and making you exhausted afterwards.
Please watch the guides as they will help loads. Also, the points system will be in the Guide that comes out on Sunday. Use that.....it will clear all the crap and keep you focused on the key areas you need to communicate.
After you watch the guides let me know if you have any more questions

@@kingsking2816that's not true, mental health problems can have a huge impact on people's appetite and cause them to stop eating or forget to eat, needing someone to remind you to eat counts as points. With washing and bathing, it's not just about needing someone to physically help you, it is also about needing to be reminded or encouraged to wash, as many people with mental illnesses can go long periods without washing due to lack of motivation etc.

If you are waiting for the Tribunal I would not re-apply as you are already in the system and it will cause confusion.
Unfortunately, it will not matter if the Doctor says you are disabled. Its about how your daily living and mobility is impacted (and how you communicate this).
If you watch the PIP Claim guide or the Tribunal Submission Guide, that will go show you how they award the points. This is key to winning

I care 24/7 for my diaabled partner since January 2020 and my partner receives PIP since January 2020. We are both in Universal Credit. I never claimed for Carer'w Allowance due to not knowing about this Benefit. I recently found out and applied.

@Inttsum2 hi Yeah they asked me about my condition and how it effects me. You are best telling them your worst days so they understand how bad it can be. If you say you can do things even some times it can go against you so along as its honest just say what you can't do on your worst days and what changes you have had to make to accommodate your condition and what will happen if you are put in a position that will overload you. Sorry I can't word it better hope this helps. To try ease your worry I will say I was soo worried and I ended up getting a lovely woman on the phone who understood and everything was fine in the end I didn't need to worry, just take notes and take your time to mention everything. Im sure it will go well, best of luck to you.

It took 9 months to settle it and I got the full amount. Over the years it stayed that way till an assessment I had. Just because I was 2 points under I went down to the lower rate. I am due a review next month (Feb) and called for info on what to do. They said they will send me a Form which Ive to send back signed that there is no changes and they will process, it only asks if there is a change and only to sign if there is no change. If there is a change they have sent me a 40 page booklet called 'Change of Circumstances'. It has subjects liike PIP Preparing Food etc with one half page blank saying 'How has this changed' and the other half page blank asking On average how are you affected by this change'. This is repeated on every page under each heading so this is the new style 'Review'. They sent me this form ahead of time and it is also online. I would greatly appreciate how this new Form is to be completed and your advice. Thank you.

If you're already on an enhanced pip rate then leave it. Otherwise, you could risk losing it. However, if you are on standard pip rate and think this new change in your life about the metal plate in your hands can help you get the enhanced rate then you should seek proper advice from people who understand pip before you try to make changes in your claim. If this new change in your life about your hands doesn't increase your chances of getting enhanced pip then you'll just be putting yourself through unnecessary grief! And even the possibility of losing what you already get! All the best 👍💯🌟

Look pip is a care based system. If you can go it you don't need care to do it. I used to work for them I've seen the descriptors. You will have time at the end of the mandatory reconsideration to put your side forward.. take your worst day don't lie because that could get you into even more trouble later than the line. You don't have to be catatonic to claim personal independence payment they have to affect you about 50% of the time. This itself is bad for advice.

Are you not promoting fraudulent claims for PIP ? What your saying is everyone including all the immigrants who make false claims should follow your lead and get benefits that they are actually not entitled to. If they can't cook they can't cook if they can they can. E.g my sister has fibromyalgia but she hasn't starved to death yet she sleeps then cooks after and doesn't get PIP. I don't get pip for severe generalised anxiety disorder and MDD the question they ask are not correct for mental health so why would I be entitled to PIP ? Pip has always Been tailored to physical health as a priority over mental health. Can you lift a box 📦 above your head then your mental health is cured magic 🎩 ✨️ . I think people posting on public platforms creates a financial problem that the country can't afford. I'm not sure why people can't live off just lcwra I have to and manage it.
