Oceangate, the company that created the sub and the underwater tour, could still be held liable under the law, no matter how many waivers a person signs, as we learned in law school, as follows: a. No matter what waivers or legal documents one signs, one never waives away "gross negligence". If one can show, in a Court of Law, that Oceangate was "grossly negligent", Oceangate can be found liable, under Tort Law, including for wrongful death (civil liability), and, b. The legal theory of "Strict Liability", under Tort Law, may apply as it does with airlines, all air travel and activities considered "ultrahazardous" (civil liability).

carbon fibre was a bad choice, after repeated exposure to such intense crushing forces the carbon fibre would have developed tiny micro cracks that would have become worse with each dive, eventually after the material was weakened enough it would have imploded, it's a gamble as to how many times this sub was good for, was it the 5th time down or the 10th time that will implode the sub, it was an arrogant assumption to you know better than all the other experts !!!

James just said what ALL of us are thinking but are too cowardly to say. We have all had this thought since day one. He is stating reality and science in a time where people get angry for stating reality and science. The owner of this company is not a hero in death AT ALL. For those of you who say what he said was too soon, I disagree due to the times we are living in: Reality and science don’t care about your feelings and your feelings should never impede reality and science. James isn’t the guy to lie to you so your feeling don’t get hurt because he stated it in reality and science. The world must stop denying reality and science or we will all end up like the titan.

@allytrudie864 I see what you are saying, but I think the true reality is more complicated, unfortunately. That's because there are two different types of science: Science and $cience. And in a way, this submersible accident has illustrated the difficulty for many people in distinguishing between the two. For starters, this OceanGate outfit was selling itself to its billionaire clientele as cutting edge Science using carbon-fiber that is 10X times stronger than steel, but it was really $cience cutting financial corners using unproven technology that was cheaper to fabricate in conjunction with a legal loophole that didn't require safety certification (Science) out in international waters. In addition, OceanGate was saying they were too cutting edge and that the certification outfits weren't up to speed on their Science, but the reality was OceanGate was intentionally skirting numerous costly safety issues ($cience), including even hiring 20-somethings because they won't ask questions and do what their told, rather than experienced 50-somethings who brought safety issues up previously, and one was even sued in order to prevent the loss of money, as this outfit charged a quarter mill $ per ticket... Anyway, true reality mirrors this same submersible situation, as Science and $cience in the real world are really, really hard to tell apart, as many have realized in these interesting times.

Sums it up perfectly, I would add that I don't know why the media took the public down this morbid rabbit hole based on the untested theory that they had a 96 hour window of oxygen when the diving community knew they were gone on Sunday. The submersible started descending too fast and when they lost communications they heard a loud noise. Why they spent all week trying to convince people that there was hope is beyond disturbing.

    • @LibromaniacChannel

@@southerncross5360 It's pretty wild how the media blitz around this took on a life of its own. I had not heard about the loud noise, only the loss of communication accompanied by previous accounts about how this happened frequently. Plus there were even reports of periodic banging noises every half hour, which were totally untrue/wrong... Perhaps this was all a big smoke-and-mirrors distraction from some other particular news scandal successfully lost amid all the media chaos, who knows???

Sorry but Captain Smith actually did heed the warnings and Titanic deviated further south into what were normally safe waters for the North route. What didn't seem to happen was the warnings that the ice field was unusually heavy and extended further south didn't seem to make it to the bridge or the Captain's attention.
To say that he didn't pay attention is just wrong and does a disservice to the memory of the man.

    • @The1Music2MyEars
      @The1Music2MyEars ปีที่แล้ว

He did receive multiple warnings but his operator disregarded the one from the SS California, stating they were stopped and surrounded by ice. "Shut up, I'm busy" ie thank you but we are disregarding because we have heard this report already. They thought it was a repeat warning. And while he diverted, he still maintained speed, did he not? Plus he was a captain of many years. He knew about cold water mirages and yet steamed on ahead on a moonless night.

@@The1Music2MyEars you can argue that he didn't heed the warnings enough but James Cameron is saying he ignored all warnings and did nothing. This is simply factually incorrect.

@@kalebhofer9866 You are talking with the benefit of hindsight. Multiple ships were traversing the same route and didn't stop. This is why the Carpathia was able to reach the stricken Titanic within an hour and a half. I believe exactly one ship did stop and that was one of the warnings Captain Smith didn't get.
Given that the Titanic was a mail steamer too (RMS being Royal Mail Ship) then time is a factor because it was expected that these ships would arrive to a very tight schedule.
Add to it the expectation that the design of the ship was sufficiently robust that it was impossible to cause enough damage to sink her. It sums up to Captain Smith being entirely reasonable in his decision making even as he was wrong.
The sad thing is if the lookouts hadn't noticed the iceburg at all then the chances were she would have rammed straight into it and likely only flooded two or three forward compartments - which was survivable for the ship as a whole.

  • @crystaldawn9255

Let's be honest there was many many many many more flights in between those times than there were and are submergents so if we're going to look at the amount of catastrophes and compare them, that's not a fair comparison we need to look at numbers. That being said, nothing great comes without making mistakes, literally nothing. But you don't bring passengers along for your deadly experiment and charge them
Also, the Titanic was not an experiment there had been many many more ships and they are on top of the sea

I have to admit that I was pretty dismissive of Mr. Cameron's dive to the Marianas Trench. Rich guy does rich guy things.
But he designed the sub, he did his homework, he endured the rigorous training, he made sure that sub was safe, and the fact that he went down to the deepest sea in the world and came back to tell the tale is proof of these.
So he knew very quickly that the Titan was lost when comms and transponder were lost simultaneously. His explanation elsewhere about why an untested composite hull was a terrible idea, why avoiding certification the way the CEO did was horrifically irresponsible, has given me a huge amount of respect for Mr. Cameron.
The skipper of the Titan, however, did rich guy things like the incompetent middle manager he was, and took 4 lives with him to Davey Jones' Locker, one of them a 19-year-old who otherwise would have his whole life ahead of him. History will not be kind to him, and rightfully so.

Just imagine the periodic cracking noises, echoing in the darkness down there... For a time they intensify, barely, but still enough to make your heart drop not knowing, if with the next noise two miles of ocean won't come down on your head.. dog tags..All that's left from your deep ocean tin can, are mere dog tags in the bottom of the abyss.

Adding to the delamination of the carbon fiber. The titanium shell was most likely to add consistent pressure on the carbon fiber. But did it cover all of the carbon? N if so. Could that have delamination from the fiber. By means of the flexing of the plexi glass? Thats what i suspect happened. And not simply pressure on a carbon fiber cylinder. Because if they tried to abort the descent. Carbon failure is unpredictable.

James Cameron is pioneer in the world of deep sea exploration. Deeply respected knowledgable and very conscientious of what he's doing and does the proper research and preparations needed to complete his goals. Many know him as a film director but he has been a very dedicated contributor to the the exploration of our oceans. He was also very articulate and compassionate in describing the Titan tragedy. I think in time his contribution to science will far outweigh his status as a film maker. I wouldn't be surprised if he someday won the Nobel prize for his efforts. ❤
