    Her “learning over time what got her burned” is exactly why an attorney is needed. She’s advocating learning by trial and error which costs money-money which could have been saved and damage to the business prevented by putting a proper document together in the first place.

      Yes lawyers cost money but they cost way less than what you might be sued for if you find yourself in court, and you don’t want to be unpleasantly surprised in court when the judge doesn’t rule in your favour because your contract is invalid because you didn’t get the right advice.

    you don't even know how freaking right you are !!! you write a simple contract and the moment you start dealing with people and start getting screwed you start making that contract little by little so good it becomes bulletproof that's where I am these days and that's how I got to you, thanks for your advice. much success in 2023

      You definitely want to cover yourself. The simpler the contract, the more complicated the lawsuit can be.

    The gist of this is. You can do your contract until you get sued. Well, this is not good advice. There are clauses lawyers will include for specific transactions that will cover the parties without even them knowing.

    How about: Interpretation clauses. Hardship clauses. How you judge best efforts, reasonable care, due diligence & trade standards. Breach/non-performance. Penalty Clauses. Limitation of Liability. Disclaimers. Confidentiality. Intellectual Property Rights. Taxes. Liquidated Damages. Exemption Clauses. Warranty. Force Majeure. Most-favored customer clauses. First-refusal clauses. Applicable law. Duty to disclose all material facts. Termination clauses.
    People don't always need a lawyer or insurances, they do help.

    Because I use to work local. And he asked me a Estimation for a house on my city, he never show up. Apparently That house is on sale for a real state.

    So basically write a contract that includes details and specific information about the business, and what is expected of u and the client in a lot of detail. Then give it to a brutally honest person to find loopholes. Do that a few times with a few people without making any business deals. U find the loopholes before loosing money.

    Seriously!! People, Google is not your friend. There is so much more to contracts than what this lady is saying which the average person wouldn’t know, like what constitutes a legally binding contract, applicable legislation, whether or not your contract is legally binding. Sure lawyers cost money but far less than what you could be paying if you end up in court being sued or what you could lose if you suing someone and it turns out your contract is invalid because you didn’t get the right legal advice

      You can draft it in Google docs, but it good to get official signatures either through physical print outs or docusign

    Well I don't run a business but I recently bought a house and I love it but the problem is a tale as old as time with a twist
    Here we go I bought a house last year because my BF and were expecting our first child (no we are not married) the house is in my name but my BF wanted the electricity in his name but here's the fun part so originally our property was bigger and had a pullbarn on that ran off my houses electricity the previous owner of my house split the property sold me the house and is renting the pullbarn to my nightmare neighbors who run a slaughterhouse out of it they agreed to help pay for the bill until they got their own electricity but it's been a year and now I feel like I have to put together a contract so they pay on time it's super annoying but your video really helped me thank you

      Contracts or “promises” made by family members aren’t usually justiciable, which means they’re not binding and a court will not enforce them unless you have a clause in your contract that specifically states that you and the other party intend to make the contract legally binding and that either party can sue in the event of a breach of contract.

    A contract is nothing more than a written handshake. It's value comes from defending it in court., simple words in a contract can trip you up. Both parties may interpret the language in different ways.
    Never hurts to have a lawyer vet what you have created. The time to defend your document is before you get sued.

      yes, a person must have mental capacity to enter a contract because the need to be able to comprehend and understand the terms and conditions of the contact and you must have the ability to fulfil you contractual obligations Being under the influence of drugs and alcohol is considered a mental impairment

      For example:
      Legalese:
      "I hereby, and for the duration of the agreement listed herein, give, deed, and transfer all title currently owned by me, Darris Hawks, in the goods named below (Pokemon cards) to the other party of the contract herein named Poke'mon Trainer Chri$$$ 303 in exchange for ten (10) United States dollars"
      Not legalese:
      "Darris Hawks agrees to give Poke'mon Trainer Chri$$$ 303 all of his Pokemon cards and Poke'mon Trainer Chri$$$ 303 will give Darris Hawks $10 USD."

    0:45 she states she is not an Attorney. That means everything she says after that is subject to dismissal. Sure, it might set you back a grand or two to have a legal professional draft up a LEGAL contract; but considering something as simple as a punctuation or spelling error will void your contract and put 100% of the burdon of proof on you, and guess who is screwed?. No thanks, Ill hire an attorney.

      I am a one man business barely making it because of Covid, and no I don't have the extra money just hanging around. That grand or two is dirt cheap when someone wants to sue you for fifty grand, possibly for everything you own.

      Professional liability Insurance companies can legally refuse to pay a claim unless you have a properly written contract. When a real life attorney not a layperson writes up a legal document it hols up in court.

      It's amazing how many people are commenting thanks for explaining and now they know how to do it themselves... when there was literally no advice given on how to do it yourself. If the collective IQ drops any lower we'll be living back in the jungle.

      Actually if a person is not named in a contract, they are not a party to the contract and therefore cannot be bound by the contract.

      @@deanajohnston2394, if people are married and they do not agree to have separate households (business), it means they have common household: common income and expenses. If they have common household, then they have common obligations resulting from common benefit based on a specific contract with a third party. The context of benefit and obligations is considered and is primary to the court. You cannot get benefit and have no obligations - that is not fair.

      nope!! If a person is not named on a contract they are not a party to the contract and therefore cannot be bound by nor can they enforce the contract even if the stand to benefit from the contract
