It makes no difference glass or plexiglass, when windows and their “frames” in high rises are new, it’s a nice tight fit. As Lamont made the point this building is 25 plus years old, all buildings “Settle” and continue to “settle” for a good 50 years. In settling, the tight fit of every part of the building slowly shifts. As it settles things are not tight and strong when the building is new. Part of this, is seasonal weather. In the cold everything shrinks, in the summer everything expands year in and year out. There is no way to keep a building like new, Mother Nature sees to it that she runs the show. She takes opportunity to cause as much havoc as possible in every corner of the world. The window / window frame no doubt was not the fit it use to be, glass or plexiglass are still subject to the earth / building settle and Mother Nature struck at it with her bitter cold, intense heat, bad weather and the sun beating on it every nice sunny day.

My daughter rented an apartment there on the 24th floor and moved out a couple of years before this happened. The building is nice and clean and has a real retro/mod vibe - though dated. They have a huge indoor pool in the basement that practically no one used, but it was kept sparkling clean. I would go over there to swim 3 times a week, but only once was there someone else in the pool. The building is built from a newly invented, (at the time) lightweight concrete material. The elevators are in the center of the building and each apartment is pie shaped so every apartment has a view. My daughter's apartment had a beautiful view of the river. I was worried about the very short balcony railing off her dining area. Scared me silly that someone might accidentally fall over. A friend of mine was an EMT and worked Mr. Hilberling's death. He quit after that.

Whilst staying at Amber’s parents he was caught using drugs and both had to leave as her parents do not approve of drugs in their house. They let them use the high rise flat until other accommodation was ready. They were only there 2 weeks before the infamous fall. Also Amber herself was hospitalised as a result of Josh’s temper. I can't imagine the fear that went through that young man's mind on his fall down 20 something stories. I know that just in one second your mind can go through a hundred thoughts. He was leaving her and had a packed bag at the front door and she went nuts. The reason I believe she meant to push him out the window is that she started running from the other side of the apartment to gather speed and then pushed him. That's why I believe it was premeditated in the blink of an eye. While serving in prison she committed suicide. Her mother is raising their son. If it was my son I would not have let her family raise my grandchild because of how they raised their daughter that is a murderer. I would have fought tooth-and-nail to get that baby boy. Everyone remember when you're young that looks are only a small portion of what you need in a mate.

I remember this case very well. I saw the story all over different stations. She was trying to hurt him that day and shouldve gotten worse.. There was no abuse on his part. The next door neighbor and several others stated they heard them often arguing where she was the aggressor and heard them that day. Josh kept going back to her because he loved her and wanted to make it work for the unborn kid. He had refused to press charges previously when she assaulted him. Her behavior was witnessed by both their families. Her mom had the nerve to justify her behavior and felt she shouldn't go to jail for his death. He had packed his bags, called his father to pick him up and was leaving that day. I believe she was pissed daring him not to leave n flipped out. She tried to say she was next to him arguing while he was messing with the tv, he was ignoring her rant n that aggravated her so she pushed him. The neighbor said it sounded like she was yelling from another room at a distance away because he could hear running charging like cattle at him right before the crash. She pushed him on purpose n had to know how dangerous and forceful that push would be to him. She told her grandma in the holding room she pushed him because she was so pissed ,his parents said I would kill him if he didnt leave n I did, her grandma had to tell her to stop talking because she was telling all the business. He had a restraining order against her, not the other way around. She commonly assaulted him, not the other way around. She wanted that extravagant apartment, so he got it for them. Her family was wealthy, which is how she made bail so quickly. She was an entitled, spoiled brat who threw tantrums or assaulted him when she didnt get her way.. Its ridiculous to say her small frame couldnt be strong enough to push him, if he was distracted, not expecting it and she charged him clearly that would make the push more powerful and fatal as it did. She came to court smiling and waving like a Texas beauty pageant contestant ,she thought her money and looks was gonna set her free. Her susie homemaker appearance was to manipulate the jury to think this lil sweet southern girl could never. I think she killed herself because she couldnt handle jail like most brats, cowards or psychopaths and surely the inmates were not nice to her. She arrogantly gambled and lost. That 5 yrs they offered was a slap in his family's face. Had she been a battered wife I wouldve been all for it but that wasnt the case, she was the abuser. I think karma came to collect, now his family has justice.......shannon b

In loving memory of Amber and Josh Hilberling Part 1 of 3
I am responding to a TV documentary shown on C4 ‘woman who kill’ shown a few weeks back in the UK. One of the examples included the Amber Hilberling case in which she described her story and included various comments from Mr Dave Walker of the Tulsa Police in the US. From listening to this case I was struck by her account and the unusual manner and circumstances that this case came about; specifically how the Tulsa Police handled it. What was so disturbing to me is how such a seemingly harmless environment could end in such a horrific tragedy. The police were quick to rule out any possibility of unintentional killing immediately once a secret recording in the police investigation room was taken with Amber and her Nan. This resulted in Amber receiving a draconian and Inhuman incarceration sentence of 25 yrs, without giving an opportunity to raise a defence for manslaughter the most plausible cause based on the evidence. This compares to a recent case in the UK where a man who had history of abusing his wife (and previous woman) repeatedly assaulting her and eventually killing her and disposing of her body. He received 20 years with possibility of applying parole after serving 10 years on murder 1 charge. In Amber’s case her conviction on murder 2 was based on a single momentary ‘push’ lasting no more than a few seconds of her life, with a history of relatively low level of domestic abuse between both parties. I was deeply saddened to learn at the end of the program that Amber had killed herself (allegedly) leaving her orphaned son to have to grow up with the thought his mum had murdered his dad? How could this happen in a modern civilised country who values justice for its citizens as a corner stone of its existence. I felt that I owed it to Amber and her son Levi to investigate further and come by the full tape of the secret recording comparing with Mr Walker’s live comments in the program.
Following on we know the decision to go for a murder investigation and not homicide (manslaughter) investigation was taken before the infamous secret recording was listened to by the homicide detective Dave Walker in charge of the case. On camera he made it clear that once he heard Amber state she killed him he dismissed any thought in his mind it could have been an accident (unintentional as defined by manslaughter). From this moment Amber’s fate was sealed and ultimately led to her death be it by suicide or murder which itself is in serious question.
From my own observation of the flat, two things struck me. Firstly how innocuous and safe the crime scene appeared. As a 65 year old would I have been aware of the hidden danger, Josh and Amber likewise all three of us have no prior experience of living 25 floors up. There is history
of both parties involved in domestic abuse, and pushing each other would not be uncommon. Secondly the tv is set away from the window as taken from Amber’s account. Could she have really expected to believe he would have travelled and ended up going through the window. Would any 19yr old (man or woman) be expected to know the window would be that unsafe, her focus was on Josh messing with the tv not the window. This leads to another problem, in the recording she mentions pushing Josh against the wall, from her position what was she seeing. When investigating such things as plane crashes for example the investigators are trained not to have any preconceptions and there role is simply to find the truth first and make findings afterwords. Note the difference here with police investigator where there role is more opposite and they start from a position of assessing culpability not from a position of neutrality (ruling in innocence). This is a common misconception from people who have never had dealings with the police. An Air Crash investigator would start by resetting the stage so to speak, so for example what was the pilot seeing. With regard to Amber the window was half obscured by the blinds, the left side remained drawn part way and the right side torn away as a result of the fall. Josh himself is a large frame and would have occupied the remaining centre space, towering over the small frame of Amber. Also the light would have been affected, Looking at the room with the window fully exposed the room still appeared dark to me. Was a re-construction of the crime scene carried out. I think not, because in Mr Walker’s mindset he was satisfied this was a murder investigation not a homicide investigation. In his head he had a murder and a murderer all he now needed is evidence to join the dots. This raises serious concerns on the way this recorded material was treated. Mr Walker mentioned this was about as close to the truth as you can get “that is the most truthful I seen in that room”. I agree but you can’t play devils advocate here and pick what truth you are accepting and disregard what truth doesn’t fit your murder narrative. As a recording the whole picture has to be read and interpreted truthful, Mr Walker must avoid playing God with the truth. When a person is in a state of shock and trauma they are likely focused on the consequence and not how the consequence came about. She was saying this when she repeated “I see him falling and hitting the pavement over and over in my mind I can’t stop it”. Take example a car crash caused by Amber driving a car with Josh the passenger, a heated argument ensues and as a result she looses control and Josh ends up dead. Her immediate reactions is to blame herself “Oh my God I killed him”. This is not a confession of murder but part of processing the information. Mr Walker’s response should not be, ‘I heard she was arguing with him whilst driving so I realised then we had a murder investigation’. Your getting the truth but not all the truth. Remember this happened little more than hour ago when she was holding Josh in her arms, a person she clearly loves, the father of her unborn, and where she had no motive to want him dead.

There is something more to this story because it takes a lot to break a window in a high-rise and she supposedly slung him into the window where he fell thru, It just doesn't add up, why don't people LEAVE if they are abused?

And I guess that the husband “tripped” on Amber’s hands and miraculously fell out of the window!?

This is one story where everyone lost. I truly don’t believe she intended to kill him but when u put your hands on another person, the unexpected can happen and then there r consequences ...I saw the interview w/her mother b4 she died and her son is in very good hands.
    May they both RIP
Such a sad outcome all round.

I believe that in this story the real victim is the child who lost both parents. These two individuals were inmutare, irresponsable and selfish especially this woman knowingly she was pregnant and her unborn child should have been PRIORITY NUMBER ONE, not her husband, not herself but the child she was carrying who didn’t ask to be born. I feel sorry for the child not having both parents and became an orphan due to her drug problem and the constant arguing as the late husband said. In my opinion, this couple shouldn’t have never gotten married never mind the woman letting herself become pregnant! As I said , they both didn’t have the maturity to deal with everyday life issues. Perhaps the child is better off being raised by someone else who really cares for him and want the best for this orphan. Tragic and sad.

I sold building products to contractors for years and I don’t know why that wasn’t tempered glass in that building. That window was inches from the floor, what if their newborn fell through the window? Plate glass at that height is negligent, I wonder if the owner was fined?

For a building so tall to Not have double glazed windows that’s despicable on the buildings body corporate, his family should have sued the building owners regardless under public liability

The video would have been correct if you visited the grave of the murdered husband... She killed her husband.. She murdered him.. I am sick of woman getting preferential treatment because they are pretty... Just because someone looks good on the outside does not overcome the fact that they are toxic within.. Your feelings are not reliable. they deceive you..

amber never seemed remorseful for what she did. Listening to her mother try to paint her as a victim is disgusting. The mother is the reason why Amber was so disillusioned. Karma always comes on time.

That girl lied threw her teeth. Josh never hit her once. She had been violent towards him for months...he asked for a divorce and it pissed her off...she shoved him out of the window on purpose. He was in the military and hadn't been home very long...there was some speculation that she had an affair with another man and the baby wasn't his. But she didn't want to lose his income because she wasn't working. Just because he was over 6 foot didn't mean he was attacking her. He never had hit her before. It was anything but an accident.
