    Okay so look here is a possible why renew another five year contract when mabe the space that the clib has. The owner may have another potential buyer for that space and he could charge them more than what they are getting from the club. The new leaser might be able to pull in more money so the Owner is able to get more income off the new client. So why renew there x amount of dollars when they can get more.

    You’re 100% correct!! I’ve worked in the bar/night club industry for 15 years. At first..I thought it wasn’t fair to discriminate against a certain type, not color of people. Then I noticed that the so called stereotypical hip hop crowd sucks no matter how much fun it is. I love working for hip hop style night clubs but it’s too much trouble and you can’t make shit. Sorry. It’s sad but true.

    My career is in commercial development and residential management. There is an insane amount of thorough research that goes into developing commercial plats and vetting the businesses to lease the spaces. Competing and linear businesses, median household income, and DEMOGRAPHICS are the key factors that are considered throughout the process. The goal is to profit as much as possible as consistently as possible. Aside from the factors I mentioned earlier, Curb Appeal is crucial. It can make or break any business. Realistically, would you eat at a restaurant that is located adjacent to an open dumpster area, and you have to wade through trash to get from your vehicle the front door?? More than likely, no. Upon first glance, you possibly wouldn't even consider stopping because the restaurant has the perception to be filthy and unkempt--meanwhile, they could have a spotless kitchen, an amazing interior ambience, and incredible cuisine. The same idea applies when considering other aspects of cirn appeal. So generally and demographically speaking, an urban crowd would not necessarily be good curb appeal to the "intended" clientele who would typically frequent the other businesses in the plaza. So the IDEA isn't racist, however, something as simple as VERBIAGE, can absolutely make it an issue of race . The developer definitely used politically incorrect verbiage. The contract terms and Florida State law (laws differ from state to state and sometimes, from county to county) would offer more insight, but the verbiage is discriminatory. Being a woman of color I find it offensive, but it is business. Commercial businesses have a different level of freedom--a residential establishment making the same statement would lose that law suit due to Fair Housing Laws.
    So to answer your question--yes, you have the right to desire a specific type of clientele. However, you must be intelligent enough to write a contract to get you what you want legally. The correct LEGAL way for the landlord to have handled this particular situation (if it was truly an issue of clientele and not race) would have been to document complaints regarding the club; send notices via certified mail to the contract holders, and provide sufficient notice of non renewal (6 months is typical for commercial contracts). Here is where legality and intelligence meet--you are not required to provide an explanation for non renewal of contracts--only sufficient, legal notice.

      Cooper Shell Thank you for this insight. I'm grateful for law, the laws and how new policy and laws come on through and correct things when businesses fail to have an emotional IQ or rationale basis for their "preferred priorities."
      I trust if they argued the right merits because anyone can choose to nonrenew and I'm not FL barred but at the basis, this is a strict scrunity issue and looking forward to see what the circuit courts got to say.

    I agree people need to stop calling everything racism when often time it is classism or cultural differences. If myself as a black female doesn't want to be around a bunch of thugs hip hop rappers hanging around my shopping area I am sure most of their clientele doesnt either.

    Your first response was the correct response. It is racist. In 2018 it’s not politically incorrect to say “NO BLACKS ALLOWED”! So instead they used code words such as URBAN, THUGS, and INNER CITY..... I’m glad those people are suing cause it’s not right.

    When you talk about consistent with the brand, it reminds me so much about the Abercromie case where the girl had a hajib and they said her look wasn't consistent with their brand. But I almost feel like she applied to that job already knowing how Abercromie was, and probably wanted to make a case about it.

    My issue is that most retail outdoor stores close earlier than mall stores. So if the West Elm closes at 8 and the club doesn’t open until 9:30-10pm. All the retail customers and employees have gone home by the time the club opens. Separating race and clientele can be difficult but when your looking at demographics, maybe taking the club out or making them change clientele could make sense. Why not just have certain nights for certain crowds like most clubs. They could partner with other stations so they can have more of a mixed crowd...

    Hey Dineva, long time viewer first time commenter. This is an important conversation. I’m in Castleberry Hill in Atlanta and we deal with this all the time. My issue is that the racism doesn’t even factor in here. The developers are inflicting damage on their lessees by not offering them a renewal. When you lease a commercial space they have very long leases because of the amount of time it takes to do a build out. So the tenants/business owners have invested so much time in decorating, building out and then promoting their space in association with this lease. The lease comes with the option to renew so no, the developers shouldn’t be able to revoke that option unless the tenant/lessees have breached some aspect of their written contract. The main thing for me is, the developers had no issue taking their “hip-hop” money for 5 years now maybe they want to go in a new direction… there should be a compromise. Maybe they charge more for their lease, maybe they say what you said and only have certain days where they can promote certain types of parties. The business owner/lessees should have the option to try and reconcile with their business model because of their 5 year investment. Under no circumstance should a business operating within the confines of the law be forced out because white people are “turned off” by their clientele. That should never be accepted or tolerated because it inflicts damage on the tenant.

    I appreciate this video. Coming to you with a background in Property Management, I firstly say that this violates in he light of Fair Housing. At the end of the day, if you can afford it, you should be able to get it. This should be indiscriminately due to racial or cultural background.
    The bigger issue here is that like with Gentrification, a lot of us are mad because we don’t own anything. We like to release and we like to rent. We never or enough down to call a place our own and call our own shots. We are all living in borrowed time instead of owned Time. Once we graduate from renter to owner, we’ll see less and less of these types of moves.

    I agree with you on all points in seeing both sides of the situation. As a residential landlord, often times, the same concerns (or similar) an occur when leasing to renters. Every situation is different because Fair Housing Laws dictate fair leasing to all, until there is a problem.

    1. If they didn’t want a black establishment there, they wouldn’t have leased to them. If it was a race issue.
    2. The same way that older black people don’t really mix with young black people, older white people don’t mix with younger white kids.
    3. This is the main reason why there are no clubs, hip hop situations in the suburbs because the business owners don’t want to run off the suburban, disposable coins off.
    I don’t feel like it was race based... it’s just coin based. 🤷🏽‍♀️

    Yes it is and it is against the law! It’s called “ Fair Housing Laws”. I’ve been in Property Management as a Leasing Manager now for 7 years. It IS against the law and HUD housing has been “shopping “ commercial , residential and retail spaces for this very issue. What you are describing is a “Class A” area where I work in . We have to be very careful with how we ask questions to our prospects and future residents.

    Mmmm this is hard because I’m both! I am black and a business owner. I rented my retail space to a young lady who was doing a pop a shop. She was nice and professional when we meet. However her guests was beyond ghetto and unprofessional! The property where I lease from security guards had to get involved. It was a nightmare 🤦🏽‍♀️!! I’m in an upscale, predominantly white area. It’s a new $66 million redevelopment that my city is excited about. I myself decided to be very very very selective of who I rent my space to going forward. I do not want to be the black business that brings down their property down.

    This is a complex subject. Let me tell y'all my experience. I opened my real estate office 3 years ago. I rent in a 7 unit establishment with barbar shops and hair salons. Make no mistake it I love my people I reqlly do. But I can rarely go to my own office and work on their peeks days of the week (Thursday, Friday, and Saturday) or have clients meet me at my office because of the level of foolishness... drinking, loud music, cursing, a fight or 2, even smoking weed. On Mondays I go to my office knowing I will have to pick up trash before any clients come. It's so frustrating because like I said I love my people. And I know that the issue is their clients no the business owners. It is kind of a catch 22. I don't want to call the police on people or stop them from making money but they don't care about my ability to earn income. I now have a contract on a small commercial space in a different area but the type of businesses there now will make it difficult to get what the area is worth.

    I get it. I grew up in Miami and I was side-eying them at first until you expounded further. The caliber of folk that frequent those parties like to get drunk and fight which escalates to shooting and no one wants that kind of drama in their establishment that caters to the mature. There was a shooting a few weeks ago in Aventura which is a nice area too and ain't nobody got time for that either. People want to be able to go nice places and not have to worry about the loud and ignorant which unfortunately describes many Black folks and millennials that frequent those parties that don't know how to act in public I personally wouldn't renew their lease period because I wouldn't ask them to choose especially if they weren't willing to take full responsibility if something went down at one of their parties.

    My problem is, we don't like to hold ourselves, or each other, accountable. Let's not act like the majority of hiphop is filled with Chance the Rapper types. It's not. As a young black person, I would not frequent a place where there are Young Thug, Black Chyna, Lil Pump types walking around. I just wouldn't. I'd shop elsewhere. So much of HipHop is about glorified criminal and disrespectful behavior. You can't be mad that people take these rappers at their word, and see them(and the crowds they draw) in that light.
    Similarly, no matter how much white southerners want to suggest that the confederate flag isn't racist, if I see it, I'm going elsewhere. I'm not about to eat dinner at a restaurant with a bunch of Confederate flag loving bikers. I'm just not. They could be the nicest people in town, but I'm not about to stick around and find out.

    I live in California Los Angeles to be exact and I'm not too far from Hollywood. Old Navy & the Gucci store is on the same block ! Rich people love a good deal too ! But that's comparing apples and oranges..... it's time to stop making excuses for why they don't want black people in certain areas.

    This is the perfect reason why more black folks need to own their own spaces like Kandi and Todd. I have a coworker, her husband owns two gas stations and own both properties. However he rents out one of the gas station and runs the other one with 4-5 employees.

    Well Funky I can understand the situation because my ex employer didn't want a certain clientele at his establishment & he basically chased them away by raising prices. So they went somewhere else. The clientele was not African-American.

    If the management's lawyers cite that Houston and Nader "later entered into contracts with 99 Jamz and local promoters to do live broadcasts from the club", they will be liable for breach of contract. Management responded: "Fate could remain open only if they stopped using the radio station and hip-hop promoters to advertise the club." The five-year lease-option contract is voidable, since new elements (the radio station and promoters) were not part of the original agreement and, it appears, were never discussed in advance. Management, is not suing them for the breach, they simply want Hader and Houston to comply with the terms of the contract they signed, if they expect to renew.
    Management says: "Black people scare the customers of Gulfstream's other businesses," company managers allegedly told the two, adding they did not want "urban hiphopsters" there. Although poorly worded if complaints are being made to management, they have to resolve the issue. Giving them the option to stay if they just comply with their contract terms is reasonable. Filing a discrimination lawsuit: 1) knowing they violated the contract by hiring promoters without management's knowledge and 2) in light of the goodwill gesture to stay if they drop the promoters, Nader and Houston appear, in fact, to be undesirable tenants, based on their characters.

    This is interesting because plenty of Black folks go to Gulfstream, but I can understand both perspectives. This is a little different, but I will use my preference for reggae clubs to explain my thoughts. I do love hiphop clubs, but if I have a choice between going to a reggae club and going to a hiphop club, I usually choose the reggae club because I know that everybody there is there to have a good time and I feel like it is the best of both worlds because the reggae clubs still play hiphop. I have never had a dude curse me out at a reggae club and I have never had girls beef with me in a reggae club. I be more on guard when I'm in hiphop spots, that's just the truth. I still dance and have fun at the hiphop clubs, but I'm more likely to keep my eye on things and leave before the club closes. I will even go to the reggae spots solo, but I won't go to hiphop clubs solo and that's me speaking as a Black woman is who has been exposed to all demographics so I can't be too mad at the landlords. We all do have our biases and I have seen more bullshit go down at hiphop clubs than I have at other types of clubs. On the other hand, because Gulfstream is a nicer setup than the hiphop clubs I would go to I wouldn't really think people would cause that much trouble there.

      Correct me if I'm wrong but Gulfstream *is* an upscale club that catered to Black professionals. At least it was when I went. It's not even for the young and dumb. It had that "grown and sexy" vibe.

      I haven't been to Gulfstream in years and when I have gone it wasn't to go to a club. I went to restaurants there. I can't say what they cater to, but I know from social media that Blacks go out there. From what I understand it has grown tremendously since I have been there and has a lot more to do now.

    Hey +Funky Dineva!! At the very least, I would say the business is discriminating against a particular "group of people". Everybody does not jam to Mozart or Beethovan. I have to listen to dancehall reggae myself so I know they would flash the DO NOT ENTER sign at me. LOL!🤣🤣

    It is racist because the landlord is carrying the same principles and tactics used when past realtors were exposed for redling. To discriminate because of the fear of devaluing the community. Language is a form of weaponry, once you understand the codes, you get the message.

      From an objective business aspect, it is still a hard decision. If the community doesn't appreciate or approve of this specific club, this is probably going to be a lose-lose situation. I'm assuming that this specific club is profitable(consistent income), hence why the landlord accepted them in the first place. The fact that this club was able to maintain it for 5 years and wants to stay at that location is a sign of growth. However, can potentially lose the other businesses. There probably needs to be a sit down among all the tenants if that hasn't happened already.

    And another way of looking at it from a business perspective the insurance premiums for certain venues can be higher because of your type of clientele.As a business owner you have a right to make that type of decisions.It is what it is and we may have to except that.

      I just read the article. Unless there are reports of crime committed by the people that patron the club (which the article doesn't mention) I am convinced this is DEFINITELY race motivated. Very upsetting

    My initial reaction is to call B.S. I consider myself part of the “boring” crowd. I shop and eat brunch during the day, most of those clubs are closed and look deserted. If I’m shopping during Crate&Barrel hours i can assure you I’m dead asleep during club hours. Would the two crowds ever really bump into each other? I’m going to read up on it and call you later Dineva.

    I’d have to get more information on the past actions of the establishment before I decide that they’re racist for one situation. I am definitely leaning more towards the possibility that they just don’t want black patrons or black culture to dominate the place. I agree that they probably just settled for them until they could get the white clientele they actually gave a shit about in the first place.
    Also, not to be that black person who points out how “we do __ to each other”, but when dark-skinned people are dismissed by black people for their arguments about colorism in clubs and black/hip-hop spaces, the first thing people mention is the “brand” of a club (basically implying that dark skin represents low class, etc.). In these cases, people claim that a club has a right to be as exclusive as they want to be. I’m not saying this out of insensitivity to the black people in this situation. What I’m saying is that people are on the side of the business when they want to be. We dismiss discrimination when it works in our favor and as long as it doesn’t affect us individually. I’m not sure if I’m making a good connection or not. Just my opinion from what I notice.
    The establishment is probably racist. But that’s just one -ist that this particular establishment practices to suit their bottom line. Every establishment practices some other form of shady marketing and vetting in order to operate a certain way. There are exclusive spaces and inclusive spaces. Everybody wants a space to themselves. That comes with somebody always being or feeling rejected. I’m not sure if that’s a moral way to feel about the situation. It’s just reality.

    I'm not from Florida, but here in Philadelphia Pa the owner of the property has every right to say what will be allowed in their property as they are LEGALLY LIABLE for the damages that will be done to the building as well what is happening around the building that can affect the other businesses surrounding it. I do not believe they are being racist at all. When they first signed the lease five years ago the owner of the building knew the space would be used for a club, so maybe within those five years there have been complaints or incidents that had made the property owner feel as though that specific crowd can not be in their building any longer... it can also be insurance issues or other forces such as the casino who have gone to the property owner and have said this can't happen anymore. So most likely isn't racist based off of the facts I've heard in the video it sounds as if it's just a business decision

    "Not wanting a certain clientele" is the best and safest way to discriminate against black business owners who have a vested interest in servicing hip hoppers, urban professionals, also known as black people.
    We can waste time talking about how these commercial landlords have a point in being selective. But again, it's a waste of time.
    Last year, while in LA, my friend who is a licensed massage therapist was turned down for commercial space because of the "clientele". Even though her customer base was the same customer base as the asian business owner who was approve to rent out the space. She was marketing to the same clientele. Commercial landlords hide behind the "clientele" clause as a way of discriminating. That's facts. Don't go off of this 1 article. I'm sure there's a collection of stories from black business owners. There's a larger problem at play here.

    We not being honest. Diddy almost ended up in jail behind the hip hop crowd with that city college incident. That crowd is intense. Nobody is kicking out New Edition parties.

    Fair Housing was a group of laws first in acted in 1968. It protects against racial discrimination and offers protection for other minority groups (sexual orientation, race creed, country of origin)

      Keina Davis fair housing does not include commercial property. There are different laws that go with having commercial property

    It is not racist, but it is illegal. Stipulations must be spelled out in the written contract rather than an oral promise. If they want a certain type of atmosphere then put it in the contract. They'll have to rewrite their contracts for everyone upon renewal.

    Another possibility is that perhaps the owners were approached by another club owner or
    store or spa owner to rent the space.To make it less desirable to the club that is already in the space,the new lease may have been modified,and or tweaked so the better move may be to move and not renew lease.
