    It should be allowed, victim person must have a right to collect evidence whether it is legal or illegal. We should not inform a criminal before recording an audio,video and any other evidence.

    In my opinion, the Parliament as well as the Judiciary should work together to clarify such ticklish issues by passing amendments to the applicable laws in a very crisp manner so as not to leave any loopholes for any interpretations. Such efforts would go a long way in reducing the pendency of cases in the Courts where on similar grounds, people across different Courts in different States of India have to unnecessarily spend their valuable time, money and energy!
    I would really appreciate it if you make a special video on how to make a certificate under Sec. 65-B of the Indian Evidence Act to assist people to draft one with all the essential requirements. Thank you ma'am.

    Wife is like an open book for her husband so that husband can record call,make videos and should be admitted in court also bcoz there is no privacy between husband wife. also recording may be an important evidence of the case so it should be accepted by court and may be listen by the judge in presence of only husband and wife in his chamber.

    Indian judges should understand the right to privacy is not for only wife but it is also right of privacy for husband also, if both spouses have gone to court for their internal matter, then this matter is self proven legal.

    If someone is constantly threatening you over telephone, should you request him or her to allow recording its voice and do you expect he will say, ok.
    And on the other hand if the govt. or any telecom authorities hold the right to record the conversations of their citizens or clients then why we the citizen of Bharat won't have the right to record the same for their own safety and security.
    How can it be proven if any criminal commits a crime or give random threat over phone, how can it be proven before the Honourable Court?

    As an electronic evidence, the original electronic equipment (e.g. original mobile phone where it was recorded) must be presented in working condition to be admissible in court as evidence.

    Right to privacy violation is shouldn't be considered when someone is trying to collect evidence for judiciary cases purposes. Because that is the only way to prove himself innocent.

    I personally believe Phone recordings should be legally accepted as evidence. Because nobody does call recording routinely . Call recording is carried out by someone when there is an anticipation of a specific kind of crime likely taking place or to prevent oneself from becoming a scapegoat in a particular case. Violation of privacy should be given preference only after evaluating the merit of the call recording. Maybe the evidence can prevent an innocent person from being wrongly punished. I believe that the people speak in the true sense and exactly what they mean on the phone. A call recording is always chosen by a person who is defending the case and has no other option left.

    There is a right to defend yourself . And collection evidence through any possible means for defending yourself in court should be legal. Phone taping can be illegal but if you are moving the court what you have talked is against you should be legal because court wants to know what king of talking has happened between you and the party. How can one understand what you have originally talked with someone.
    Then because of right to privacy your finger print should not become evidence . Without consent you cannot collect any suspected criminal's finger print. Five senses are private . So evidence regarding five senses are invalid.

    The same right to privacy can be misused, if someone falsely claims that blackmail is done via phone call, but he has no proof because he couldn't record due to right to privacy issue. 😅

    So if I record someone shooting other people, the honorable court will say it is under the right to privacy and you can't provide it as proof. I think it's really dumb that instead of checking that proof, the court nullified it. They could have put a penalty on him but noooo. They gave a dumb order.

    जब दो लोग मोबाइल/फ़ोन एक दूसरे से बात करते है तो प्राइवेसी नही रही, क्योंकि जो बात थी दोनो ने एक दूसरे से बातें शेयर कीं,
    जब उन दोनों में विवाद हुआ भले ही पति पत्नि हों या कोई भी हों, न्यायहित में सत्यता प्रमाणित करने के लिए उस रिकॉर्डिंग को गैर कानूनी नही मानना चाहिए
    इसे अन्य उदाहरण से भी सामने रख सकता हूं

    It means kidnapper call for ransom against kidnapped person is legal as per Indian law if recorded without permission of kidnapper. Judge give new business idea, sabka saath sabka vikas.
    I think judge eager to make this decision to be legalized his settings behind the court with criminals against their crime on call,

    Baat rhi privacy ki to privacy tabhi tak private hona chahiye jbtak ki kisi dusre ki अभिव्यक्तित्व ko ठेस na pahuche. मूल अधिकार वहीं तक सिमित होना चाहिए जहाँ तक किसी दूसरे का अधिकार का हनन ना हो! High coart ने गलत फैसला दिया! ये कौन सा न्याय है कि हमें कोई कॉल करके धमकी दे और हम call record भी ना करें!
    इस जज को कोई बोलो कि जाकर पहले अच्छे से law practice करके आओ तब Judgement देना!

    How is it a violation of privacy? Here the conversation is between two persons. One has recorded the conversation, unless it is brought to notice of a third person the privacy does not get violated. Before the conversation is produced before a court the permission has been sought. So there is no violation of privacy. Does right to privacy superceed right to justice.

    फोन रिकॉर्डिंग को कोर्ट में सबुत के तौर पर पेश किया गया होता तो एक सबुत बन कर केश को जितने पर मदद मिलती और यही होना चाहिए था लेकिन यह ग़लत हूआ है इसलिए आगे न्यायालय को ध्यान रखना चाहिए हमारी राय तो यही कहती हैं आगे न्यायालय जाने

    जज लोग पागल हो रहे हैं आजकल। जब कॉल रिकॉर्डिंग भी कंसेंट से किया जाएगा... फिर तो कोई क्राईम रिलेटेड कॉल रिकॉर्ड करवाना ही नहीं चाहेगा।
    हसबैंड वाईफ वाली बात थोड़ी अलग हो सकती है, मगर इसी थ्योरी को हर जगह लागू नहीं किया जा सकता। हर जगह की परिस्थिति अलग अलग होती है।

    My question is who will willingly allow to record the statements when you are in trouble or having court case .
    Everyone speaks their mind clearly good or bad when they feel comfortable to share their input .
    Next , everyone is scared to get tangled into court proceedings as witnesses due to long years of harassment faced . Truth tends to die fast when compared to liars .
    So only way left is to record the conversation silently.

    .
    1. She cannot check his husband's phone without his permission
    2. Cannot ask for passwords whther it is ATM or phone or locker
    3. Cannot ask wherever he goes..for a day..night..week or mnth
    So if our judiciary allow these things to hubsnd...then i think in this Chhattisgarh case..they hve taken right decision ...
    Bcoz accroding to me all these things...like passwords also comes under RIGHT TO PRIVACY

    Judgement deni hai to police station pe do na jo ye saari khichadi pakata hai police station mein aur fir court mein de dete agar police station ne hi ye apraadh na kiya ho kisi ko fansane ka to koi evidence kyun bnayega

    Judges should allow this call recording as an evidence to produce either by wife or husband as this is not right to privacy....it is absolutely fine as the argument is between the husband and wife...yes it could be illegal or right to privacy if an outsider or anu any other member records without the consent of the both..
