I work in property management, and the only real resolution to a homeowner like the defendant is for her to move out. These kinds of irresponsible owners do not change, learn or hold themselves accountable for anything. They are also the same owners who will complain that a tree is dropping too many leaves on the common area sidewalk.
Plaintiff had a really easy case to win here. Defendant isn't mean or anything, she just comes off kinda lackadaisical. She definitely needs to end this before she starts owing money she can't pay off anymore

@ Refusing to leave the A/C off until it was repaired was rude. Leaving the faucet in the tub running at full blast was rude. The plumber told her to leave a slight stream of water going down the drain. I had a plumber tell me that last winter when I had pipes freeze on me. The lady was rude because she didn’t do anything to insure that her neighbor wouldn’t be inconvenienced. She even admitted that it was hot and she was going to use her a/c no matter what. When she could have easily called her neighbor and said it’s hot up here and I need the air conditioner on. Put a pan under the leak. Doing that would have saved the floor and no damage would have occurred. That’s rude.

Honestly, this just seems like the defendant really doesnt care about anyone but herself. She reminds me of my ex neighbors. We lived in a house that was converted to a duplex. They had all of the upstairs and half of the basement and my apartment was the other half of the basement. They constantly did laundry without checking that the drain hose was fully seated in the pipe, resulting in the hose popping out and flooding my apartment . We told them repeatedly and it still kept happening. It got so bad that one morning i got up, and walked from my bedroom down the short hallway that came out into the living room and kitchen and there was standing water half way through my hallway, seeping into the bathroom. Aside from the bathroom and kitchen, the entire place was carpeted. My carpets were soaked. And the wall that their washing machine sat on the other side of? Yeah, thats where my cabinets, fridge and stove sat! I had water literally pouring from under them. Half of my living room was soaked. I contacted my landlord who didnt a thing. I used every single blanket and towel in my possession to soak it up as much as i could. My friend brought high velocity fans and another brought his shop vac. We did the best we could, but within days i had mold growing up the wall and along my baseboards in the basement. Who know how much mold was under the cabinets since i couldnt dry them and i obviously had to unplug and avoid using my appliances. We emded up moving out a week and a half later. I have kids, one having a compromised immune system. I couldnt have them in a mold infested apartment and my son was about to have major surgery a few weeks later (and due to complications from that, we spent two full months in the hospital from july of that year through december) so i didnt have the time, money, or energy to hold anyone responsible.

To me, she seemed fearful at first, probably of being in court, and then, maybe not slow, but not super smart. Simple, happy, easy going. Left her cleaning cloth in the tub, maybe, and didn't think, the cats were good patsies haha. The plumber/handyman screwed everyone, always leaving something to come back to.

Plantiff's insurance can go after the defendant for the amount they are paying out. Easier for the plantiff to recover a smaller amount and make the insurance company go after the defendant.
If claims can't be made on either party's end, due to one of the parties negligence, wouldn't that guilty party be basically required to leave? Essentially being evicted because certain things are mandatory and obligatory like insurance and if your insurance isn't going to cover anything, you can't live there.
