I work in property management, and the only real resolution to a homeowner like the defendant is for her to move out. These kinds of irresponsible owners do not change, learn or hold themselves accountable for anything. They are also the same owners who will complain that a tree is dropping too many leaves on the common area sidewalk.
Plaintiff had a really easy case to win here. Defendant isn't mean or anything, she just comes off kinda lackadaisical. She definitely needs to end this before she starts owing money she can't pay off anymore

The plumber told her to leave a slight stream of water going down the drain. I had a plumber tell me that last winter when I had pipes freeze on me. The lady was rude because she didn’t do anything to insure that her neighbor wouldn’t be inconvenienced. She even admitted that it was hot and she was going to use her a/c no matter what. When she could have easily called her neighbor and said it’s hot up here and I need the air conditioner on. Put a pan under the leak. Doing that would have saved the floor and no damage would have occurred. That’s rude.

The judge was correct. Damage from a water leak or flow can be very expensive. The plaintiff was very, very fair and nice. She should have sued for more. The defendant was an irresponsible jerk. She needs to free those cats to a more responsible pet owner. What a horrible neighbor.

Plantiff's insurance can go after the defendant for the amount they are paying out. Easier for the plantiff to recover a smaller amount and make the insurance company go after the defendant.
To me, she seemed fearful at first, probably of being in court, and then, maybe not slow, but not super smart. Simple, happy, easy going. Left her cleaning cloth in the tub, maybe, and didn't think, the cats were good patsies haha. The plumber/handyman screwed everyone, always leaving something to come back to.

If claims can't be made on either party's end, due to one of the parties negligence, wouldn't that guilty party be basically required to leave? Essentially being evicted because certain things are mandatory and obligatory like insurance and if your insurance isn't going to cover anything, you can't live there.
