    Came across this and resonates with me. I work for a well known retail company and they use intimidation and fear on employee. Work 8/9 hours shift with 30 min break, if one needs the loo needs to ask or beg for it. They don’t train they set you up for failure… the managers are promoted by time with the company and not by adequate knowledge or academics…. They bully staff. The impose rules they don’t follow just to the the employee in hot waters and constructive dismissal. They sabotage they own shift, they don’t motivate is just pure slavery. Psicopatas!!! Employee working under fear for loosing their job although the employee never gets late or misses a day at work and those their 100% at all times. They are pure racists they don’t have manners talking to staff, it’s just a DESEASE working in that company!!! Manipulative

      Sounds awful. However if you want to move now is the time. Im hiring retail service advisors in london and paying 19k and I cant find anyone for example. My best advice, move on. Trust me, now is the time

    I have seen all of these things happen.
    If you are lucky enough to have a good manager then I'd say be as kind to them as they are to you. Be supportive and let them know they are appreciated. A good manager is worth their weight in gold.

      Thank you. It's just common decency. Managment can be tough and if you have someone who is actively trying their best to make things better and treat their staff with respect and decency then they deserve to be appreciated and have that recognised just as much as we would expect them to recognise us doing a good job. It's give and take.

    Get everything in writing if they are going to make reasonable promises with a paper trail staying these things it’s hard for them to break them hence why they prefer to talk about it and refuse to make a paper trail

    " fear motivation " : " if you want I'll put you on the furlough scheme but only for 3 weeks and since I ( the boss) come to work it's YOUR choice if you're coming in or want the furlough " ......... in my case I " decided " to carry on working knowing that just my rent is 200 pounds/week on top of everything else and 95/week are useless till I could find another job .......

      Good question. I dont know. I guess you could record it but it'd be inadmissable in court without prior written consent

    Handed 4 week notice today an was told no I have to do 12 weeks. When I replied if I do more than 4 weeks I won’t have a new job to go to. He replied I can’t let you go 😮

      If your contract says 12 weeks then you could be seen in breach of contract and liable for damages if they want to pursue.

      If youve been at the company more than 2 years itll be presumed by contract law you signed so its irrelevant if you signed or not.

    I have been doing a job for 3 years with nore responsibility and ny boss says there's no sign off for the role by finance .. I am on less money than my previous role.. I dont have the title which causes complications .. I feel any day it can be removed and ill revert back despite huge successes and brilliant feedback .. do I have any rights here .. they say my role.does not exist.. I look after recruitment and people development

      No huge rights in that circumstance. Really you have two issues if you want to change things 1-sit down with your line manager and refuse the extra responsibility unless they pay you and promote your or 2-resign. It does sound like youre being taken advantage of. I get proving yourself but after 3 years its taking the piss

    Hey Seb, I was working at KFC. My payslip shows £20 pay and rest is reduction by employer. I contacted my manager she talked to payroll department then I got half of what I owed. Now HR says you will get it with the pay of next month. I am very depressed and anxious because had to balance my money with debts. What can I do in such a situation? Can I file damages it’s 20th day being unpaid of remaining wages.

    Another great video and great continuation from the employee rights.
    I have never had carrot dangle, but my first job as a waiter. I was asked to work during the half term week as I wasn't at college I said explained I couldn't as I was going on holiday for the week. They said bring it proof or you won't have a job to come back to. Needless to say after I explained to my family, they called my boss and let them have it as she wouldn't belive me. I kept my job and got an apologie. From your other video on rights in this situation as I had been there less than 2 years, they could have fired me and I wouldn't be able to do anything correct??
    The last job I worked any task the boss gave us, if it wasn't carried out properly the boss got it in the neck not us. She told me even though your doing the job, if it goes wrong the responsibility falls to me not you as I have to be sure you carried it out properly.
    I like the one time rule idea good wat to find out. So if you end up with a bad manager who uses fear or carrot dangle should they be reported or doesn't that run the risk of making things worse??
    One thing I meant to ask, in regards to overtime if you do overtime is the pay per hour always meant to be higher than your normal wage or is it up to the employer??

      Glad you liked it. I wanted a continuation as the management/employees working relationship is one im passionate about. It should be about taking responsibility and having the pride to want to set a proper example.
      To answer your questions. The first about when you were s waiter. As youd been there less than 2 years yes they could have just fired you but...it sounds more like your boss would have realised they were in the wrong and having an angry parent turn up after wrongly accusing you of lying made them come to their senses. I suspect they just hadn't believed you about the holiday but got put straight. Plus they must have valued your contribution as why would they want you working all week in the holidays and get so upset about it otherwise?

      The next answer where your boss took all the responsibility if you did the job wrong sounds like they had the right idea, but were either frightened of their boss or were a control freak. It sounds perhaps like an attempt at reverse psychology to make you take accountability but I suspect a little OCD/perfectionist coming through.
      As for could the one time rule make things worse with a bad manager, it could if you dont stand your ground after. Im the kind of person who if a manager tried taking the piss then id say something. Youve got a perfect example to have a constructive defence of yourself having done a perfect task. But if you dont stick up for yourself then either way the manager could make your life difficult. For me though if your one of those ppl who refuses to try for a boss as you have pre-decided you dont like managers than the boss has a fair shout to have a pop at you for having a bad attitude. But if you did a good job and then the boss tries taking the piss after, youve got every right to have a pop back. Thats the logic.

      Finally as for pay per hour on overtime it differs company to company. Most companies pay time and half in the week (1.5x normal hourly rate). Or double time on Sundays. But some firms pay just normal hourly rate for overtime. However I had triple time once working on a boxing day.

    If your manager has told anyone who is late 10 min your pay will be deducted for 20 mins is that legal

      Yes. Dependent on your contract and if you're paid hourly. Breaks are an example of how they could do that. If you do less hours due to clocking in late you'd be due less break and thus less pay. In the managers defence if someone was repeatedly late working for me they'd be out of a job so they sound very fair to me.

      Hi l do agree with them docking your pay for the time you are late but doubling the amount they are docking you is not acceptable we are experiencing so many strikes on public transport now this not fair double docking people s wages for lateness when it’s not your fault .

      Whilst I sympathise just look at the maths. If you do an 8 hour shift and are 10 mins late you'd have gone from possibly 2 paid breaks to 1 as its 1 break equivalent for every 4 hours work. Thats a minimum of 20 mins. So they dont have to now pay you for it. And whilst i get the argument against lateness an employee signed a contract to be there between certain hours. If you cant meet that, thats not the employers fault. I do think there has to be some form of common sense. Give ppl the benefit of the doubt but if its a regular thing thats on the employee.

    Hi Seb,
    I am a junior employee and have been given a 6 months notice period.
    I have a training agreement for £10,000 which I will have to pay back if I leave. The training only cost £2000.
    I also have a covenant that says I can’t work in the financial services industry for 6 months after I end employment.
    It also says I won’t be paid my bonus or commission if I leave.
    I can’t even interview else where as I have to give 1 months notice to take 1 day off.
    Can anyone help?

      Great few questions and one I know the specifics on as ive faced this situation both personally and as an employee trying to get staff from companies that tell employees this.
      The best way to answer this is to clarify a few general points about employment law and employment contracts.
      Restrictive Covenants are mostly unenforcable in court because of two laws. 1-the 1998 competition act and 2-any restrictive covenant is only enforcable to the limit of what is considered 'fair and reasonable'.
      The competition act is a uk law in place that says you cannot impede someone doing their trade. IE lets say a plumber wants to leave one company and work for another, the ex employer cant then force them not to work for 6 months as its impeding their right to a living. Plus thatd be not fair and itd be unreasonable. A court would chuck this out before it even got a trial date.
      The only issue you have is the training costs. Realistically they can ask for that money back but if the clause is £10000 for a £2000 training package thats also unfair and unreasonable. All theyd really be able to chase you for is £2000 but for a junior employee in their early career? A court would laugh that out.
      As for the 6 months not working in financial that breaches the competition act so ignore that nonsense. But what you cant do is nab or work with clients that youve directly nabbed as that is enforcable for 6 months.
      Finally bonus and commission is not contractual so sadly theyll keep that but thats the same in any bonus/commission company.
      My honest advice is throw a sickie when you get an interview, go to a decent outfit who know their shit and when you work there theyll back you up and your ex employers bullshit will get binned off.

    can you as a recruiter put your hand on your heart and tried to play a recruit or a client for gain? even I have played others in the past. best to label everyone as a player will they as seen as not a player after being watched for a set amount of time. recruiters who hide from you are the worst. "oh no the person that deals with you is not in the office I'll get them to contact you when they come back" *never calls you back* why even brother?

      No. Being honest you need to play here and there. However the difference between right and wrong is if it's in their best interests. For example I had it where a client refused to see a candidate off of cv so I influenced the client to see him and after they offered the candidate. If I hadn't have played them they would have missed out. You dont need to be morally redundant though. No need for that
