  • @kimberlystaley1337
    @kimberlystaley1337 4 ปีที่แล้ว +1

    Hi Ginny, thank you for making this video. I'll share what happened with my claim in California. I work(ed) 3 part-time jobs out of necessity--can't find full-time work. One self-employed as personal office assistant. Two on payroll.
    #1 on payroll -- food & beverage demonstrator/brand ambassador - last day worked 2/28 due to COVID. No return date in sight.
    #2 - Self-employed no longer working due to COVID. No return date in sight.
    #3 - contractor on military base on payroll, offices closed but being paid for 24/hours a week.
    Not thinking the pandemic would last so long and not thinking I could qualify due to having #3 job still, I didn't file right away. As things with UI changed, I was able to finally get through to file on April 19 for UI hoping to get enough to make up for the #1 job back to the last day worked of 2/28. Didn't really care about the federal $600/week. I supplied all my employers, my self-employed and all wages earned. They did not figure my self-employment wages into my Weekly Benefit Amount, as it wasn't showing in the Award Letter. Only my payroll jobs were listed in the Award Letter. I was approved for $209/week and thankful for that. But not back pay to 2/28. Benefits started day I applied, 4/19. I received $418 + $1,200. Although I can't access it yet, as my transfer to my credit union didn't go through. My BofA EDD account won't let me add a new bank account until I "delete" the recurring account, but it won't let me delete it. That's besides the point of my comment. First day to certify was May 17 for the past two weeks. I gave my gross earnings and 24 hours a week for #3 job, $408.48 each week. And, of course, I fell into that loophole as so many others (in other states too, besides CA). Denied due to "Excessive Earnings."
    But I cannot do anything else, because my claim year is still open. Can't file under PUA, self-employed, nothing. My account just keeps going to the status page showing my certified weeks have zero payment due to "Excessive Earnings." Do you have any knowledge as to how I can apply under another category? I haven't received a letter yet with the denial and the Appeal Form, which is supposed to indicate to what address to send your appeal. But appealing won't work in this case. Thank you.

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว +1

      Hi! Sorry to hear that - there's no category where excessive earnings would not apply. If you earn income during a week, that income causes your UI/PUA benefit to decrease and if you reach a certain amount you are not eligible. I have a video which explains how this is calculated, but there seems to be no way to get their income cap waived.

    • @kimberlystaley1337
      @kimberlystaley1337 4 ปีที่แล้ว

      @@ginnysilver Hi, thanks for the quick response! Well, it's strange and doesn't make sense that they approved me at first with those same earnings from the employer I'm still being paid by. In fact, I worked more hours and made more in March, shown on my application. And then now, it's too much when I certify. It wasn't even worth all the hours I put into applying and getting excited to be approved, to then be cut off. EDD should have this information on the website, so that thousands of us didn't bother with it. I'm lucky they paid me for 2 weeks, some people certified and got denied before they even got their first approved payment.

Your explanations and demonstrations going through the application are so helpful. I am now ready to apply and know I can watch your follow-up video regarding questions if I need more help. ALSO, under "additional information" #7 when it says "Are you currently self-employed....or plan to be self-employed?", I read online that if you are impacted by the COVID19 pandemic, you're supposed to CLICK NO. Hi!! Thanks so much for this-YES that question states IN the question that if you are unemployed from your self employment due to covid to answer NO.... however with government forms I can't bring myself to answer untruthfully knowing the possible repercussions, and as a wedding photographer I receive a 2021 deposit last week - this is my only booking I have/will received payment for in MarIch/April/May/June so I need the PUA however, since I earned income from my business and DID do an owner's draw to my personal account, I felt checking YES and then explaining my loss of income in the box which pops up when you select yes after was the best option for ME. Should I be denied, I will reapply or contest with documentation knowing things will be backpaid to my effected date.

    Number 7 asking if you are currently self-employed is a trick question. It clearly states, if you are impacted by covid-19 pandemic, click NO. For people who are self-employed seeking PUA should mark no on that one.

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว +3

      Thank JayCarl! I selected YES for this because I am still receiving an occasional booking for 2021 wedding clients and am technically receiving MINIMAL and sporadic self employment income, so I am still technically self employed. If you click YES then another box pops up and asks if you are available/willing to LEAVE your self employed work for full time work, and if you select yes to this then it shows that you are available to accept fulltime work should the opportunity arise. This is just what I selected for myself, but if you are receiving NO self employment income at all, then this should be checked NO according to my interpretation, though I could be mistaken!

      Ginny Silver - The Business of Wedding Photography requirements to “actively seek new/similar work” is lifted during COVID. You can deny the opportunity to seen new even if available work “due to COVID-19 concerns- unless you are in the ESSENTIAL WORKFORCE business (for specific list: google) - however, if you are not REQUIRED, but only ALLOWED to word during the Pandemic -- then it is your RIGHT to chose “stay at home” or shelter-in-place, if issues. If you aren’t within direct zone of any two above “keep low profile” zones - you out of lack (maybe other options will be/ARE available- Google,, call small biz adm or your city hall ..)
      I suggest to verify each “no, you/we can’t” through several sources, before moving on to other options.... When there is a will, there is a way.

    Hi! Thank you so much for your helpful video. I applied last Tuesday opening day.
    I had W2 Employment up until June 2019. The entire year I also did freelance event photography. I'm afraid I answered questions wrong regarding Employment History. I listed my W2 Employer as well as 4 freelance event photography clients that I worked for sporadically throughout the year.- Should I have done that? When asked which employer I worked for the longest in the 18 month period, I listed one of my freelance event photography clients - Did I misread the question? When asked If I'd be returning to an employer.. I put yes thinking it meant I'd be returning to my recurring clients. I feel like such a dummy and I have a feeling I have mistakenly entered the wrong information and will not be approved. Do you think I can file a new claim? If so, How soon can I do that?

    • @ginnysilver

      Hi!! There's a few questions here which I'll answer with separate comments so standby... You are so welcome - so glad the video was helpful

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว +1

      FIRST - W2 employment and Self employment must both be claimed and full net income for both must be accurate. The EDD will put you into UI (which is totally fine) if you have $1300 or more W2 earnings in one of your 2019 quarters. They determine PUA or UI automatically.

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว

      Next - you did make an error in listing a freelance client as an employer. As a freelancer/self employed individual, you are your own employer. If you aren't issued a W2, you are not their employee. Instead, you should have listed yourself, your business name or your own name if you dont have a different DBA and your business address or your personal address if you dont have a business address. With an honest mistake, you shouldn't be penalized but it may cause a hiccup in your approval so don't be surprised if you have to refile and try again. HOWEVER, hopefully you don't have to - I believe you may be approved based on your W2 employment rather than your self employment, but thats just a guess.

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว

      You will be receiving a paper statement in the mail - one stating the awarded amount, and another which lists all of your information they have on file - both which they have pulled themselves also that which you have filed. On this statement they will have instructions for how to correct anything which is inaccurate - so follow those instructions to correct things.

    • @ginnysilver

    • @ginnysilver

      Ginny, I am on a regular ui claim. I requested my backpay and was notified to certify all the weeks. However, I submitted the request within the ten days indicated after receiving my initial award letter. Edd did not respond. I made numerous online questions, and requests. I also requested numerous times on ask edd backdate my claim. The first attempt was on June 3rd, and it wasn't the end of July that they finally processed my request. I certified for all the unpaid weeks and on the last 4 weeks it exhausted my claim balance to zero. I went into peuc , however they skipped over the four weeks that were pending, continued the payments at the current date of that time. Again no response to my request. Finally, I was able to speak to someone only the phone, which I had numerous times before. This time I was told I would not get the additional 600 that I was intially suppose to get because I didn't have a weekly payment to accompany it. However had the edd responded to my requests at a reasonable amount of time. I would have not max out my benefits. It just would have max out at a earlier date. I would have been given 2400 more if they didn't it the right way. She also told me that whoever processed my backdate, forgot to change the date I became employed, which I also reported within ten days to correct my award letter. I was told , no appeal, nothing I can do? Any suggestions Unemployment, she only backdated the date for payment. I was then told that because of the processors mistake

    Great video! I also got approved on 4/29. However. In the notes section (right side of where the award is noted on EDD) they indicate that I must be available for work AND I must look for full time work. I’m classified as self-employed. When you go through the certification process they indicate same as above. Furthermore, it is a requirement that you keep a record of your search for work and provide an option of entering your details regarding your work search efforts on-line, per EDD. Not sure if I’m correct , but I intend on providing in person contacts with potential business, which is difficult in my circumstances, but doable. I understand for some that may not be possible. If not in person you can call, email, fax or mail for new business, pet EDD. Again, not sure if I’m right, but unless I learn something otherwise that’s what I will do. Deadline to certify is 5/23/20. So I’m going to wait and think about this more before I “pull the trigger”. Good luck to everyone!!!

      Ginny Silver - The Business of Wedding Photography I agree. But, as you know when you certify it states something different. Lorre Levy, spokeswoman
      for EDD, stated that you don’t have to certify
      for applicable periods noted on EDD website. More specifically, if you say that you didn’t look for work by choosing No they will correct on back end of the certification process. I understand they probably didn’t have enough time to fully incorporate all the necessary changes for self employed individuals. I did same thing you did and included clients and potential clients as part of effort to generate income, which may not be necessary, but better to be careful when there is conflicting information. Thank you so much for doing these 2 videos. Knowing that my thought process was same as someone else gives me more comfort I did this correctly. For example, I also said yes to question 7 when I was applying as I still have some income. I know yours was a retainer vs immediate income. But same idea. You also included something in the search for work situation, which I did as well. Thanks again.

    Hi Ginny, my 18 year old daughter made about $2000 last summer doing gig work. She was paid in cash. So for 2019 we have no solid proof she worked other than our word. This year, Jan. Feb. and part of March, she was paid by venmo so we do have proof that she made $795. Would she be eligible if we just said she only worked this year. Congratulations! I'm glad you got approved

    • @ginnysilver

      Hi Karen! Unemployment and PUA benefits are intended for those doing business legally and paying taxes as opposed to under the table work, so I wouldn't think that she would be eligible without a 2019 Schedule C from taxes or 1099's, so sorry about that.

      @@karenkramer3760 Completely understand! If she was issued venmo payments larger than $600 from one individual/business, she should have received a 1099 form which could also be used as income proof without needing to complete taxes

    • @karenkramer3760
      @karenkramer3760 4 ปีที่แล้ว

      In other words, the 1099 would be for 2020 work. Last year when she was 17 years old with no bank account, she only accepted cash for different odd jobs. I don't even think we would have to include 2019 for her unemployment because the amount was so small.

It was longer, but finally a rep called me back. I asked why after waiting 3 months for any payments, I was still pending. Then he says I'm under review. This is the 3rd time I have talked to an EDD rep in a month & a half and told everything was okay, I just needed to wait 7-10 business days, etc. I was asked all kinds of questions by this guy & finally asked to speak to a supervisor. Then, the icing on the cake, he hung up on me! Can you believe it? Of course you can! So ridiculous!

    ANYONE: How do you calculate "earnings" as a self employed person for a week you are certifying if
    A) you receive payment(s) on a certifying week for work performed on an earlier week(arrears payment), before the claim period.
    And/Or:
    B) You as a gig worker have high overhead and therefore a lot of business deductions. Am I to deduct expenses from my pay received for that week, for the qualifying week if I had some limited work. Example: I received $500 in payments on a week I have to certify for BUT my expenses were $375. Do I report $125? Remember, this is self employment we are talking about.

    Hi Ginny, Thank you for putting up this helpful information. I am so glad you are from California, as I am. I was very interested to see that you had no trouble entering Photographer as your work type. I am an independent contractor musician who has been entertaining senior citizens in nursing homes, senior centers, and hospitals for the last 5 years. My work came to a screeching halt on March 15th when I saw the sign posted to the site where I had gone to play advising me in so few words that I was not allowed to enter. So, I entered Musician on my application and that nasty little blue reject sign appeared. I hit the Help button. It said Work Type Examples: Salesperson, Electrician, Truck Driver. That's it. It did not list Photographer or anything like that. I got so frustrated. I could not go further with my application. So, in desperation, I entered Salesperson, even though that is not what I do for work. Salesperson rejected as well. I did not see where you did anything different from what I did on the previous page. You listed yourself as your employer, I believe. You are self-employed, so you are your own supervisor etc. I just wish I knew why you had no trouble entering Photographer as Work Type.

I previously filed (improperly, as I'm self-employed) prior to 4/28, then refiled as self-employed on 4/28 when the new forms were live. I didn't hear A THING, kept checking all the time - and yes, I had received a confirmation number on 4/28. I read the confirmation paperwork this morning, and it said I would receive info in the mail within 10 days. I didn't. I tried calling, and couldn't get through. So...this morning, I refiled and I was SHOCKED TO SAY THE LEAST when I went back in and checked and was instantly approved for benefits. No idea what happened with my first claim. I filed at exactly 5:30 a.m on 4/28 when the site was live -- had tried a few minutes prior to that and it didn't go through - and maybe my claim did not go through at all, even though I received confirmation?

    Thank you for your presentation,Ginny. I may have missed it but I did not hear you mention the 'alterate" method of computation of claims. This can be used if the claimant could not qualify under the standard method. Using the alternate method income from this year 2020 may be considered. EDD states that the alternate method will 'automatically" be considered if the claimant does not qualify on the standard method.. That is not necessarily true. They did not check my claim using the alternate method (which would have. qualified me for benefits
    I had to resort to USPS to send an appeal to which I never received an actual response. However about 3 weeks after I mailed EDD I received a paper certification form which I immediately completed & returned. 10 working days have passed , I have heard nothing. I have not been able to utilize UIO because my account has been locked since it's inception.
    I will stop there. My take on this is Ca EDD is totally overrun while attempting operate with an outdated system and a large number of new hires & transferred employees who do not know what they are doing. Completely understandable given the circumstances.
    Thanks for listening.

Answered questions 1-6a “no”, questions 7&8, didn’t mark box. Can’t understand why issued payment for 2weeks, when answered all questions “no” for all weeks. Ah - if you answered all Q's no, you may be disqualified - watch me certify here: th-cam.com/video/E8Tr1oKo_Uo/w-d-xo.html . The first two weeks are often issues asap before collecting a certification to push claims through. If you show a balance as a negative, this could mean they are going to ask you to pay back those two weeks. I would attempt to correct your certifications - you will need to call in and let them know you made an error on your certification.

On the last page of the "additional information" section, where it says :"select the option that best describes how you were impacted by the COVID-19 public health emergency". - you chose the option "Your place of employment is closed as a direct result of the COVID-19 public health emergency". However, I felt that I should instead choose the option "You are an independent contractor with reportable income (ex. IRS Form 1099) and you are forced to stop working because COVID-19 has severely limited your ability to continue performing your customary work activities". Would this be the wrong choice? Video is great but I wanted to clarify net income for self employed business owner. A friend was told by someone at EDD to report the gross income for calculating awards. So this is the gross receipts less cost of goods sold. There is nothing that says net income, just net profit or loss. That number is much different because it includes all expenses also. So do you think the person at EDD was correct or is it the net profit number? It makes a big difference in the weekly amount awarded and he doesn't want to get overpaid. I also received a letter which has no income for the 2019 year and would like to give them my figures but not sure which to report. I hope this makes sense, we don't want to be overpaid.

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว +1

      This is incorrect - the application stated on that question very specifically - "If self employed list your 2019 net income" you can view this right around 24:30

    • @ginnysilver
      @ginnysilver  4 ปีที่แล้ว +1

      gross income and net income for a self employed individual can be VERY different - the EDD always asks (as shown in the clear language in their application and now in their certifications) for the net income. Do not use gross, or you may be subject to fines/penalties, and required to pay overpayments.
