    • @kenbobcorn
      @kenbobcorn 2 ปีที่แล้ว +79

      It's very common for lawyers to request the witness or expert witness explain the terms to the jurors. Because the term liquidity could have multiple interpretations, the business manager did not use the term liquidity, even though what Johnny did have was liquidity issues (he had assets, but no cash to pay off his short term debts). Because the manager did not want to use the word, the lawyer had to have him define the definition he did not choose to use (perhaps because it sounded worse?).
      You have to have watched a lot of court proceedings to know how these things are done. For example, the police officers had to define many terms that were obvious, but it still needs to be defined for the jurors.

I understood it because I use the terms all the time, but I feel like the lawyer was trying to use these terms and then misuse interpretations of them to confuse the jury. Especially because right after the accountant defines liquidity, the lawyer "ask" about things that have to do with solvency, not liquidity. (i.e. it wasn't Ms. Heard who bought a yacht, was it?)

    The video description is slightly misleading, the accountant referred to "short-term" liabilities and assets, not total liabilities and assets. This may mean he had monthly loan payments, credit card payments, or other debts that needed to be serviced that he couldn't cover by his monthly income. Depp is an actor and probably earns his income sporadically, like a gig worker or self-employed worker. Therefore, from time to time his monthly income will be less than his monthly outgoings and he'd likely have to liquidate other assets (savings, investments, gold, etc.) to cover the gap. It doesn't mean he's selling a yacht or a house, it just means he has to tap into other non-liquid assets. It's another moot point raised by Amber's team IMO.

    • @arrowknee7356
      @arrowknee7356 2 ปีที่แล้ว +3

      With the income he has had, he will not be relying on gig income. He will have investments that will be earning him substantial amounts of money. Likely they where locked up for some period of time for whatever reason, or he genuinely was just going wild with his spending (happens to a lot of people, not just the wealthy, but also the poor etc, though the scale of course varies based on there income level, just look at the number of people struggling with credit card debt).

The number of times that Amber's lawyers seem to get tripped up or surprised is really weird. It's kinda like watching an NBA player take a granny shot from the free throw line. Very jarring to see them get flustered and hear the surprise and alarm in their voice.
      Now, clearly this is the Plaintiff's time to provide evidence, but the Plaintiff seems far more prepared and methodical. The interruptions and disdain that the defense attorneys show towards the professionals is very off putting. I would be really, really annoyed with the defense if I were in the courtroom.

      It‘s common to let witnesses define terms and it‘s mainly done for the jury because you can‘t know what kind of background they have and it‘s part of a lawyer‘s job to make sure they understand everything. How is he not able to define a word he used, that can be used to define different matters, especially pertaining to someone as famous as Johnny Depp, who is his own brand/ business. There's intricacy here and as we can see with Amber's lawyers, they don't like details and context because they're incompetent and they think this is a good way to limit information in Amber's favour. Judging by the lawyer's rude, demeaning way of speaking to witnesses, cutting them off and trying to push them towards certain answers, I am not surprised the witness asked for a definition despite being an expert.

      @@12Sharon That is what lawyers do. When it is Heard's witnesses turn, Depp's team will similarly try to discredit them.
      It's just starting to annoy me when people are discrediting the lawyers when all they are doing is their job. They are not under performing or doing a bad job.

    1:30 , he said "I don't speak all the business school terms that you speak." Then why did you volunteer to cross-examine a finance guy on financial topics? When you cross-examine an engineer or pharmacist in a patent infringement case, and you ask questions about a topic that is inherently mathematical or pharmaceutical, do you in the same breath roll your eyes and tell the witness "I don't speak engineering and medical terms the way you do?"
