Terms and Conditions are very limited in what you can agree to. It is actually understood by the legal system that nobody reads them, it would be basically impossible to read them, even if you did read them 99.9% of the population doesn't have the legal knowledge to understand them. So they can't put anything insane in there and actually enforce it. They can really only enforce things that a reasonable person would expect to be in there.
That does make sense, because if people can put whatever in their terms and services. Literally nobody would ever trust a service/product because of some hidden agenda.
Netflix didn't really create this. They just funded and distributed it. But they did so knowing what it was about, which is still pretty wild. The writer was basically eating the hand feeding them.
Fun Fact: there's actually a hidden reference to the girl from the rating episode "Nosedive." When Joan's ex-boyfriend Mac is sitting on the toilet scrolling social media, there's a post from Lacie Pound, the main character from "Nosedive."
There's some quality episodes in this season, but man oh man it feels like they just gave up on the main concept of what Black Mirror used to be. Showcasing how technology can be dangerous in relation to dystopian futures. Still some solid television though.

God "reasonable" could be pretty subjective, though. I'd be curious about some of the cases around them.

Man I thought this was an absolutely terrible episode. Some of the worst acting I’ve ever seen as well from Salma Hayek.
Never a fan of when she feels like she's playing a parody of herself, instead of an actual person.
