It seems that now this section 498A is being misused to blackmail and threaten the husband and his family in most of the cases and lodging false cases under this section. Moreover divorce has become common for some married women with the help of their parents and forcing men to give divorce to extract huge money. Now a days men are the victims in most of the cases because of women’s parents.
Is it difficult to identify false cases ? Only SC can interpret correctly on spot on SLP while others in the justice system are allowed harming husband. Money extortion is made lawful.
Foe example wife is not in India for most of the time , husband is not prosecuted in other country, all the items in the custody of in-laws kept at the time of leaving the country were returned.
very vague and general allegations on in laws. Cann`t PP make a check list to decide fake and real. it is unfair to go by mere statements of wife or interested witness statements. PP can`nt identify false documents/ time bar cases. is it not the role of PP to bring truth before the court and not for harming husband. PP need to be punished in false cases. certain realities are not for discussion by any advocate on justice system. In Arnesh case what a damage was done at lower justice system .Any body was punished. Every body can`t approach for justice highest court. It is their kingdom to violate rule of law.
