40 Feet Span Without Column: Beam Deflection Fails, Contractor Fault or Architect Fault

Visited a site in Noida, Uttar Pradesh where a RCC beam is getting deflected due to less depth provided.
Contractor & Architect is blaming each other but the client is suffering in the argument.
Try to do double check on drawings before start of execution.
