About 8 years ago I filed for unemployability due to my MH rating. Despite the evaluation saying I fit the 50% rating - which is what I had - they just gave me 100% MH rating P&T rating and with my other SC disibilities I have SMC-S. I don't have any evidence but I think they did that because it is less paperwork for them, but it kind of sucks for me. There are established rules for protected work environments and work trials that come with unemployability. Those don't exist with a 100% MH rating.
This law firm is awesome. They have helped me so much. If you were denied by the VA, you have to start your appeal right away. It takes 5 minutes to do it online at MY VA DASHBOARD. Once the appeal has been dated on the VA site, call these guys or contact them on their site. Be patient. The appeal process takes time. These guys took my rating from 80% to 90%. They didn't stop there. Then I went to 90% unemployable. Then to 100%. I've gotten back pay in lump sums each time. Literally, thousands of dollars that I would have never seen.
Can the application be submitted via your VA.GOV account or do you have to mail in the form VA Form 21-2680 for Aid and Attendance? And How much is the stipend for a married couple with 3 children? Where can I find this information? Thank you for a very informative video. Much Appreciated!
We were denied Aid and Attendance twice for my husband as a caregiver. He was 100% service connected disabled total and permanent. The first was appealed with a denial. The 2nd application was denied recently. We never was told to file a VA FORM 21-2680?? How do w
@@lisagh4515 Aid and Attendance is slightly different. Aid and Attendance is paid directly to the Veteran you apply with the VA FORM 21-2680. In contrast, Caregiver is paid to the person providing the Care at GS-4 pay grade ($3500) with more comprehensive protocols.

Since they are lawyers they likely wouldn’t speak in a way that is an absolute affirmative. So you are correct i believe that they don’t know. They are just going for a educated guess
Mental health rating criteria is squishy because there are no objective tests for PTSD, depression, etc so it is not as exact as some other disabilities are. It is 100% subjective so vets experience a wide variance of ratings in very similar situations.

VA said my hubby was denied aid and attendance because he doesn’t need the help 24/7. Including even if he forgets to take meds or bath. 😢
You need to file
An appeal. The guidelines do NOT specify that it has to be 24/7! I am referring to A and A SMC. Not the pension program or caregiver.

Veteran is not competent financially and family with POA manage for him, there is no way he will get the smc? thank you in advance!

Incorrect, it's 2 separate programs. It's near impossible, unless you are a vegetable, to get caregivers approval
