- The plaintiff says he shares a property line with the defendant, who he claims no one likes. The plaintiff says he was forced to pay the entire fee to remove a tree on the property line, and he’s suing for reimbursement and fines. The defendant says the plaintiff’s tree leans on his garage, and the plaintiff intentionally cut the bark off the tree so it would die. He’s filed a countersuit for garage repair and harassment.

They gave the court case number. If you do a google search of the case number with the show's name, a list of all episodes will pop up, including their original air date.

The tree was initially " God's Work", and he couldn't do anything with it, but then he takes off the bark and kills it anyway.
He said the way it grows is an "act of God", which is a term in home insurance when there is no one to blame... like a storm.
I rarely disagree with Judge Millian, but in this case the only reason the branches fell onto the garage was because the plaintiff KILLED the tree. The defendant could have lived in the house for 5 or 10 more years without branches falling down.

His whole argument was that the tree was encroaching on his property in the first place, it's his responsibility to remove any of the tree that is encroaching onto his property from the earth to the heavens at his own expense not the neighbors. It was on his side therefore his responsibility 🤷♀️

She was wrong because every time the plaintiffs/defendents want to give her any evidence they talk with him to explain the pictures/scroll down in their mobiles. Why this time he stopped him for explaining and she didn't say to the other plaintiffs/defendents "Don't talk with him, do you see him wearing black dress?"
I can't believe plaintiff actually did what he did. It sounds like something out of a Looney Tunes cartoon. What a maroon!

The old guy was totally unprepared and had no facts. The neighbor pays for his own survey. Excellent ruling your honor. My thought was, did the defendant had a survey of the property done before he bought it? Might have helped and I would think it to be part of his due diligence before purchasing, like a home inspection or a termite inspection. But I suppose he didn't do that.

The younger guy is lying about being told that "only 2% of the root system of the tree was on his property." That is impossible, or the tree would've died long before the older guy cut the bark to kill it. This is due to a standard fact about trees. Any healthy tree, once fully established, will have a root system as big, or bigger, than what is visible above ground. The reason why the roots of trees are normally larger than the tops is so they're bottom-heavy. Trees with inferior roots could be blown over in high winds.
Now, according to testimony this was a 50 foot tall tree, so it had to have a girth up top approaching several yards easily, and since the trunk was maybe a foot away from the building, it's 100% impossible for only 2% of the root system be on his property. In fact, since the tree was so close to his building, up to 40%to 45% of the roots had to be on his property. Since no respectable professional would tell someone that only 2% of a tree's roots were under his garage, when the tree's only a foot or so away from the guy's line, because they'd look like fools, and lose credibility.

To extent you can cut back the tree , but if you damage or kill the tree because it was cutback too far it’s on you . I think defendant was tying to explain that tree damaged his foundation, which it could have being that close to a structure.Plaintiff just didn’t feel he has to pay for his own tree, but he wrong.

@@stephaniehowe0973 All tree damage isn't instantly faulted to whomever's property on which the tree resides. That generally applies to instances in which the tree falls. But if the tree was intentionally killed, then that's who's at fault. I was an office manager for State Farm a few years back and got a lot of calls from homeowner's regarding their neighbors trees. You'd be surprised how many people believe their car is covered under their homeowner's policy just because it's parked in their garage.
