    For a landlord with no dog in the fight, he went out of his way to ruin his own reputation to smear the plaintiffs. He could have simply sued her for rent and repairs and happily went on his way.

      Yeah ever since the Zoom boom, I've seen way too many cases where people are asking to be let out of like, substance abuse aspects of their court requirements because there was literally no reason for them to be doing it in the first place. They're banking on these poor people not having a good enough lawyer to protect them from unnecessary court requirements that these people then have to pay for when they never should've been required in the first place. God bless America.

      It was proven. What he did with her personal life with info. that case workers would NOT have told him but the EX did tell was PROOF enough. You see how when the Judge asked for the caseworker name he didn't have a name or he knows the caseworker would have been sued and fired. Good example of Putting Your Foot In Your Mouth and getting kicked with that same foot in your behind, LOL.

      They pick each other and make kids yet act like they're scum of the earth (which I'm sure some are) but maybe realize that before laying down and making these innocent babies that don't deserve to be in the middle of your bad judgement and drama! If you cannot be cordial and co-parent then have a third party be a mediator that knows how to adult properly!

      There is a difference between a case worker talking about a case he/she has in generalities and saying Mrs. Smith is attending drug counseling for bla bla bla. Just the fact that the drug counselling thing was mentioned is super suspect as that would violate HIPPA. I was a counselor at a drug treatment program and if someone's own mother called the center to ask about a student we could not even confirm that the daughter was at out treatment center without written consent from the student.

    The defendant is definitely in cahoots with the boyfriend. It sounds like she's not perfect but they definitely are trying to make her life miserable. Why not sue the boyfriend as well for rent & damages if you're such a good guy smh

    we all know that in any instance DCF will either over react or under react. it's totally possible that because the ex was saying she was on drugs they ordered her to a drug program. maybe because of what a mess this seems to be.

    I believe her... most parents are asked by dcfs to take drug tests (whether its not a drug related case or not)..when another parents accuses the other of a drug/anger etc then the judge will either believe it or not.

    I hate it when women try to use their gender to justify incompetence! 🙄 It’s a lot like playing the role of a “dumb blonde”, and thinking it’s cute, and as a woman, I find it insulting. There are very few practical tasks that the average man can do that I am either unable to do, or that I’m not intelligent enough to research, and teach myself to do; and that’s not because I desire to “compete” with men, nor does it make me masculine 😂. It’s because I like knowing how to solve issues that may come up during day-to-day living, such as fixing things around my home. But I also enjoy building furniture as a hobby. 🤷🏽‍♀️

      100% spot on! I have had to learn to do quite a bit. I enjoy knowing that I don't have to rely on my hubby to have time to do projects. I can complete them, take something off his honey do list and we both reap the benefit. Team effort in our house all the way. 🥰

      So as a woman the thing that has your attention about this case is that this woman was not proactive in addressing household construction repairs rather than the fact that a man that she was in a relationship with and was the father of her child/children threw her a beating in front of that very child so who’s a ditzy blonde here?

    She keeps saying she had other bills and priorities, but personally rent is my biggest priority. Keeping a roof over my child’s head and making sure they are safe is always #1. She def isn’t as innocent as she is making herself out to be. And the “I’m a female, I can’t do that” comment! So glad judge called her out on that.

    Just FYI, DCF/DSS/DHS are about reunification for families. If there are allegations against one or both parents they have to, by law, act in the best interests of the child(ren). They make recommendations, a parent can refuse but it will be noted as "refused" and brought up in family court. The fact that she complied only makes her case for primary custody better as she is actively showing the adjectives are false.

      Kelly M not true I had my daughter taken yet never told me why nor did they put in court documents the actual reason just allegations. I had done everything they did and never even got overnights so not all of them are about reunification.

    How does the court even entertain the idea of giving a wife beater custody of a minor child??? Outrageous. Btw: I don’t believe this plaintiff is a drug addict. She is too well informed & is able to look at the Judge directly & explain herself clearly. She just needs to make better choices in partners.

      In many states, joint custody is presumptive i.e. Baseline. In order to defeat that, you have to make a showing of some factor that weighs against joint custody...like domestic violence.
      That said, some states are like the wild west and judges decide how they want.

      Yes I fought my ex husband who was actually convicted of domestic violence for 10 years for custody of my children
      In the state of Indiana domestic violence is seen as separate than family court and cannot be and not be assumed that that the perpetrator of the violence cannot also be not also be a good parent... Which I think is absolutely ridiculous I have a clean record or no prior convictions charges in charges positive drug test... nothing. My kids suffered 10 years of hell with this man

      @@lorielhassani that must have been a while ago because in Indiana, a conviction for domestic violence automatically triggers a presumption that the abuser can't have anything but supervised visitation for at least 1 year after the conviction.

      @@Mewse1203 it was 2012 when he was convicted. I had already been fighting for custody from him. The incidents happened between 2010 and beginning 2012. I still have s protective order and now that he was charged with domestic abuse for his new ex wife and tried to kill his younger daughter with her...I FINALLY got full custody

      .....and Harvey - yikes! I just saw a plaintiff who was an influencer. She thought she was all that and she made a vid about her hair while wearing a pink bikini. She was average with an annoying personality and she lost the case. Douglas was rolling his eyes the whole time. Then Harvey closes with - Pink bikini looking hot on the plaintiff!....I was like 🤮🤢🤮 - at the plaintiff's trashy video and then Harvey being a creepy old man who got a rise out of it.....

    For those who are wondering the judge found the Facebook posts to be defamatory because the defendant couldn’t prove most of the things he posted. It was true that she owed him rent but he had nothing to support the claims he made about her daughter, her alleged drug problems etc. If you can’t prove that what you said was true, it’s considered defamation.

      @@jessicamcgaughey8551 She did have proof. The police and the criminal court already dealt with that issue. He confessed to the police that he caused some of the damage to the apartment and he took a plea in the criminal case. The judge is allowed to take those things as facts because it’s not her place to question a matter that has already been adjudicated in another court.

      @@jessicamcgaughey8551 that’s not the way the law works. The ex took responsibility for the damage in the criminal proceedings so he’s responsible for it in the civil proceedings. The judge can’t reopen an issue that’s already been handled in another court.

    First of all, people should not put their tenants on their Facebook friend list. Matter if fact, people that have a problem with one another should not be friends on facebook. Lastly, I would never talk about a person negatively about a person on facebook or in person. It is not worth it. A person you have bad experiences with is deleted from your life period. You find peace and happiness moving forward without the anger talking back and forth. This man should have just sued for his rent and damages period. He should have been smart to know she would have trolling trying to find a way to try to get out of paying her back rent. These dead beat rent payors are pros at stuff of finding ways to try to sue you instead of paying their rent. Don't fall prey to deadbeat rent payors.

    Whatever way this had ended, the plaintiff would win, had she had to pay him back all back rent, it's the show that would pay it and if she got awarded damages for defamation, then she would be coming out with something. THAT'S the reason she took it to People's court, because she couldn't financially lose, even if she lost the case...

    If a casual part of your vocabulary is, “We were involved in a domestic”, there are serious issues in your life. The judge had her explain because there are a lot of people that wouldn’t even know what that means. Most people don’t automatically think of a violent act when they hear the word “domestic.”

    I feel like she sued him in hopes to win and if he wins on the rent, then she wouldn’t have to pay the rent she owes. I feel like she was trying to sue him first so she’s more likely to win ‘cause he’d look bad and maybe that would help her win. That seems ridiculous, but likely. Though I could be wrong about this.

For the reason of not having to pay him back by suing him for defamation. It worked and she deserved the money. She should've paid him for rent when she was supposed to and it looks like she messed up the house (not including what the baby daddy did), but the landlord is not a good person anyway. So now she doesn't have to pay him for the rent that she owed him.

    I can attest you do get sent to a drug program if your abuser says you are on drugs. My abusive ex told them I was on drugs, I have never done a drug in my life, however, I had to go to drug classes and take drug tests. My tests all came back negative while my ex's came back positive. The social worker told us our results in front of each other. With an attitude, she told me she is surprised my tests came back negative and then she turned to my ex, put her hand on his shoulder, and told him "oh honey, you came back positive, we have to work on that". It didn't help me that my ex was a medic. He lost his certifications when he was arrested for beating on me.

She took advantage of him and expected him to pay her rent for her, causing him financial strain.     The judge twists the plaintiff's words, when she said she had 'taken in a STRAY pitbull with her 7 year old', but in reality she found it AFTER she had put her child on the school bus and by that evening the owner had come to get it, so it wasn't a stray and she didn't 'take it in'...

    This is sad. I say more than not Judge Milan and I disagree. Yes, the landlord should be an adult but 9 times out of the the courts side with the tenants and think landlords are wealthy. My husband and I worked decades on 2 rental properties we owned. We both had full time jobs and worked in the evenings and weekends cleaning up after out tenants when they moved out. We never in 30+ years charged them for paint, only one time had charged them for the new carpet we had installed before they moved in that they ripped. Evicted 4 tenants in all that time and never collected on a award that we received in court. Twice we had a sheriff actually come out and evict. This landlord told you she ruined the carpet and you awarded him cleaning costs, not new carpet. She took in rescue dogs so you know that she had little care for the owners. The two doors were broken when she lived there so it should have been her responsibility to fix them. He told the truth as he knew it about her collecting child support, welfare, etc. so she really could have paid him what she owed. I had a doctor friend who was evicting a woman who had not paid rent in over a year. The judge would not give him a judgement or eviction notice because the judge made the call that he was somehow wealthy and could afford to take the hit. This is a shame.

      @ReaP JoY we don’t know that he lied, just because a caseworker shouldn’t do something doesn’t mean they didn’t. It is very possible the caseworker did tell him that stuff. The worker wasn’t there to testify, so we don’t know either way

    I disagree on the verdict. She planned on never paying. And although it was in bad taste I don’t believe it met the burden of defamation. Just my opinion.

    I don’t agree with the verdict. If you’re a Deadbeat and not paying rent, you deserve to be shamed. Landlords have to live too.

      There was no proof of her having to have drug counseling or what he said about her daughter. He claimed her case worker told him and there is no way that would ever happen. His only truth was she owed him back rent.

      @@lauraanne5175 she said they put her in a drug program, drug program and feasted are 2 different things. But sometimes social services does fuck up and lie about things. Not always but sometimes.
      All I’m saying is her owing him money, and at least being tested for dugs and put in a drug program and being involved with domestic violence is all true. But I do kind of agree with the judge since he couldn’t prove some of the other things he was claiming and he couldn’t prove who told him either. So reducing what she owed due to defamation makes sense in this case.
